Give them an interest free credit until the rightful owner has proven rightfulness. In the case of Wikileaks this probably means an interest free credit until the end of time.
I aways thought that one is innocent until declared guilty by a appointed Judge and Jury. Or if time is on the essence there should at the very least be an Injunction.

Sadly Linux is still GPL 2 and there is indeed a loophole in the GPL 2. Google for tivoization. The loophole is fixed in GPL 3.

Scala is multiparadigm and even when you ignore/don't use the functional part Scala is still a better language then Java.
Apart from that: What I really wanted to push is awareness of the differentiation between Java and JVM or Java-SE / Java-EE.
The original article got it right: this is an issue about then JVM and not Java.
