    This isn't an issue of profit versus art, or even single track versus album, the issue here is that EMI had a god damned contract with the artist that specifically said NOT to do something...which they then did. And then excused it with the thin excuse that "it didn't count" because it only applied to physical albums...which then by their own argument meant they had NO contract rights to electronic distribution.

    Any ruling OTHER than overwhelmingly in favor of Pink Floyd would have set a precedent that would basically invalidate all artists rights and let the studios run roughshod over everyone.

    So rather than say "yay, Pink Floyd won!", we should be saying "what the fuck did EMI think they were doing?".

  2. eBook industry has FAR deeper problems than this on Freescale's Cheap Chip Could Mean Sub-$99 E-Readers · · Score: 1

    This is like putting a band-aid on a decapitation. The cost of the reader is TRIVIAL compared to the cost of the books read over the device lifetime. $200 or even $300 is NOT unreasonable to pay for a high end device.

    The serious problems include:
    1. no ebook standard format. competing formats are a market killer, 100% of the time
    2. ebook price is too F'ing high. charging $10 - $15 for an ebook that I could buy a paperback of for $6 isn't a formula you need to study too deep to find FAIL in. eBooks should cost a fraction of treebooks and they'd still turn HIGHER profits.
    3. ebook collections are PITIFUL today. Find me any ebook store that has all the books of a series greater than 3 books, and I will eat those books.


    The ebook industry can't seem to figure out why the public isn't embracing this format in much the same way a stalker can't figure out why his victims don't invite him to dinner.

    You are cutting yourself with the razor. That is not what "Occam's Razor" is or how it is used.

    Occam's Razor is the principle that "entities must not be multiplied beyond necessity".

    Not the principle of doubting the capacity of the media (that should be common sense).

    Apparently cutting and pasting from wikipedia doesn't bestow comprehension.

    Well the class action complaint (yes, I did Read The Filed Material linked to by the boingboing page) explicitely talks about remotely activating cameras, so the hypothesis that it would only be the kid taking pics and then leaving them on the laptop clearly doesn't match the available facts at this time.

    I would argue that at this time there are NO facts, only allegations. The details of a lawsuit filing are not exactly unbiased.

    The point being that the behavior being alleged is so utterly ridiculous that there are far more plausible explanations. That doesn't mean the allegations aren't true, just that it would be VERY surprising if so.

    So... how do you feel about morons (like you) who can't read? The "one moron" was backed up by his supervisor, *and* a cop, *AND* the airport manager. Last time I checked, four was more than one.

    You should check your reading *AND* math skills.

    The supervisor didn't say he agreed with the guy, he's quoted as "walking away" when the father said he would file a protest. The cop asked what was going on, doesn't seem to have offered an opinion on the situation one way or another. The airport manager had a "terse" message left on her answering machine.

    Basically, you took every person listed in this story, regardless of their involvement, and decided to list them as "supporting" the security idiot.

    Yes, people like you embarrass me. Please move to France.

    When the media reports a story that sounds utterly beyond the pale of sensibility, take a deep breath and exercise some skepticism.
    I got $100 that says the next few days will see some "clarification" of this story that will make it seem significantly less reprehensible.
    My bet is the kid used the webcam to take some photos that then ended up back at school.

    Seriously...duh? this is news to someone? Although in the US I've never seen cell phone replacement insurance that would do ANYTHING other than give you a refurbished ones of the exact same model. I've never heard of anyone being "upgraded".

    The reason they put it in the medical journal.. was because it was a 1 in billions event.

    Actually if you RTFA you'll find there is no mention of it being "verified", it's nothing but a published "case report". Which is an anecdote. Further, if you'd paid attention and bothered to click anything you'd have found this anecdote is from 1988.

    I don't know what's worse, people publishing bullshit, or the people who lap it up.

    Why watch a DVD when you can watch streaming media.

    We're doing less and less directly on our PC these days - its all moving to the net. Webmail, Google Docs, YouTube, Hulu, BBC iPlayer, etc. So for the majority of the general public they don't want a quad-core 32GB box which can play Crysis at 80fps.

    Well, the obvious answer is I might want to watch a DVD if I actually HAVE the DVD to watch and don't have other options for it. If you're sitting next to me on an airplane, you're going to be very jealous of my DVD while your Hulu fanboy laptop is playing yet another round of solitare.

    I always hated that statement, and real scientists should avoid it like the plague. Yes, I know Carl Sagan said it, doesn't mean he was correct. There are no levels of "evidence", there is only evidence or non-evidence. The claim itself will define what evidence is required, there's no special additional evidence that fantastic claims require...just plain old EVIDENCE.

    WiFi does exist, but that's not the paranormal claim, being allergic to it (no less just being able to SENSE it) most definitely IS a paranormal claim. The JREF makes no requirement that the person taking the challenge believe the claim is paranormal, they handle that part for them. In fact the most common claim they receive is plain old water dowsing. Water can be "detected" through many different processes, a forked stick just isn't one of them.

    I don't know about everyone else, but I haven't gotten a new release from Netflix in under a month in at least a year. If I look in my queue now, EVERY movie that was released less than a year ago is in "very long wait" to "long wait" status. In fact, it's to the point right now that my "four at a time" plan hasn't resulted in actually having four movies out at a time in a month. Netflix is having delivery problems, add on top of that gouging for Bluray "access" (with no promise of actually delivering any) and now release delays, I'm seeing their days numbered.

    I swore I'd never go back into Circuit City the last time I swooped in to pick up a svid cable in a hurry. 20 minutes later I was still unable to find anyone to actually SELL me the thing, so I left and went to Radio Shack.

    Their little clever plan of "let's have no checkout locations so people will HAVE to get salespeople to ring stuff up, and upsell them..." was transparent, annoying, and suicidal.

    Frankly, screw them. I never did go back, that was about 9 years ago.

    I expect that as technology progresses that the batteries will get better, but I am still hopeful that there will be more effort put into developing hydrogen powered cars. Then you would not need the huge acid lead batteries, emissions from the vehicles would be literally just water, and all the innovation could be focused on generating hydrogen.

    I wish people who don't understand basic laws of physics wouldn't spout nonsense with this level of confidence.

    Do I really have to explain that the energy required to produce the hydrogen is greater than the energy released by burning it? Obviously I do, that was a rhetorical question.

    All a hydrogen economy needs it an unlimited free source of energy to use to produce the hydrogen in the first place...of course, if you HAD such an energy source, you don't need the GODDAMN HYDROGEN.
