Both Sony AND MS are insisting that the HD era is ready for primetime, and both companies are touting that aspect of their new consoles. Sony is not "the company trying to plug...," that's the entire movie industry and software industry, including MS. The fact is, Sony is distancing itself from that aspect of HD video. They have already promised to not use HDCP with their own movies. The reason for that is simply the lack of compatibility with over 90% of current HD televisions.
What is making life difficult for consumers is people like you and the OP who have no fucking clue what they're talking about and spreading FUD. Without all the FUD, it would be easy(ier) for consumers to make a decision they would be happy about in the end.

FWIW. In more serious shops that do real scientific computing and whatnot(or a place like Google), this does potentially eliminate OS X as a candidate for their datacenters.

That's bullshit. A gun has no "history" unless it is legally registered. There are millions of unregistered firearms in the U.S. alone. Any cop is going to be able to get his hands on an unregistered firearm, as that is what a lot of perps deal in.
To be fair, the BSD license isn't doing the restricting you're referring to. It's the developer, who takes the BSD code and closes it up, and attaches his own license to it.
However, the argument is still over whether to protect the (immediate)developer or the end-user/developers further down the line. BSD does the former, GPL the latter.
NVIDIA was considering open sourcing their drivers. In the end, they decided not too, for at least two reasons. The first reason is the great competitive advantage their superior drivers give them over ATI. ATI is still catching up to NVIDIA witht their drivers. With how competitive the GPU market is now, neither company can afford the slightest slip. The second reason is that they don't own all the code in their drivers. They are legally unable to open source them, period.
Until the market these companies are in changes, their hands are tied.

Your numbers are a bit flawed, since the $500 PS3 doesn't have HDMI, which some people require to watch HD content on their TVs, also some Blu-Ray discs are planned to be released as only playable via HDMI (to prevent copying or some such nonsense), so the non-HDMI PS3 can't really be considered a full-featured movie player like the $600 one.
A.) The 360 doesn't have HDMI out, neither version.
B.) You do not ever need HDMI out to watch HD (sorta)
C.) All HD movies will play over non-HDCP outputs, just at a reduced resolution. These movies are encrypted when sent over HDCP compliant outputs, and decrypted by the television. Considering that most HD sets today do not have HDMI inputs, HDCP may be dead in the water. Several major movie studios are backing away from HDCP.
And, just FYI, since the 360 does not include HDMI, it will have to be made available as an addon. I don't see why the same couldn't be done for the base-model PS3. If there IS a reason, someone, please do tell.
I really don't think they'd want to push HDMI output through a USB periperhal, but I dunno. But, the main AV output of the PS3 is supposed to be extremely flexible, so, who can say right now whether or not HDMI output can be added?
Regarding BD movie playback... BD has support for HDCP, so, any studio that wants can limit non HDCP playback to (IIRC) 480p, so you wouldn't get the full resolution. But, HDCP is coming under fire lately, and a number of movie studios are backing away from it. Currently, most of the installed base of HD sets do not even have HDMI inputs.
FYI, the Xbox 360 does not include an HDMI output, and that will be an addon made available later. I see no reason the basic PS3 and the Xbox 360 aren't in the same boat.
How do you know the PS3 cannot be upgraded? It still has Bluetooth and USB support, I'm pretty sure it can handle peripherals. It also has very flexible AV In/Out support. Whether memory card and wifi peripherals, and HDMI output can be added is not something I'd be speculating about just yet.
And your comments about CPU utilization are wrong. The multiple cores on the 360 don't do much without being programmed for. IIRC, Microsoft has said that none of the current crop of games take much, if any, advantage of the extra cores.
