If so, they'd better start pulling an Apple and consider it an "incremental" upgrade, with modest prices. Who'd pay full OS price for that?
Also, pie menu is interesting, but problematic. Does it float over the other windows or sit under? Can it be moved around? Will we have to alt-tab to get to the Start menu? How nice will it play with multiple screen setups and other non standard desktop layouts?
Well, I would imagine it might be not unlike the pie menus available for Firefox. I tried them, but frankly, with a mouse, I find them to be a bit of pain, personally. As always, YMMV.

Yes. Expect Microsoft to cover this fact up with completely new eye candy features. I also expect them to make important changes in IE, DirectX, etc., that will only be available in Windows 7, in order to drive sales of an OS that will end up being just like Vista -- no reason to upgrade.

The legal issues are more complex than that, such as fair use. Think about the whole 'time shifting' issue of using VCRs to record live TV. Then, some will argue that 'media shifting' is a valid form of fair use. The MAFIAA may be within their rights to limit me to 1 play (it constitutes a 'performance' of the music, like a juke box), but whether they can control the device on which I listen to it is a matter the courts still have not decided.
