Due process (rest of the gitmo detainees) The constitution guarantees nothing to them (and the Geneva convention doesn't either, sorry, you don't get to qualify for that by just breathing air).
Protection from cruel and usual punishment (um, hello?) Hello. What are you referring to? The guys at Gitmo having to salute an American flag and stand in an air conditioned room? Or the false Newsweek stories about Koran "desecration"?
Right to peaceably assemble (protests at RNC and Presidential Inauguration) There seemed to be plenty of protests during both of those. All over the place. Now, at the DNC... I seem to remember a fenced off protest zone that was located under a bridge.
Prevention of the federal government from assuming powers not granted in the constitution (war on drugs) The "War on Drugs" is one of the weakest examples of that. The federal government uses its powers to regulate interstate commerce in the strangest of ways.

I still see Giuliani as McCain's VP. Giuliani is more moderate when it comes to issues like abortion (he's pro choice) which a lot of conservatives won't like, but he's also tough on crime (or, at least he's perceived to be) which conservatives would find appealing. His greatest asset may just be that a lot of the charges being thrown at Bush won't stick to McCain (I mean, any mention of the word "torture" in a debate and McCain can say "I've been tortured" and that's the end of that).

As I've stated before: McCain will become president in 2008 with a platform including reduced spending, paying down the national debt and government reform. He's not exciting for a lot of conservatives, but oh well, better than Hillary.

Another explanation: selective polling and oversampling of women (this is definitely done) in the exit polls. I watched the exit poller at my place of voting select about 80% women to 20% men, even though a roughly equal number of women were voting. Another explanation: majority of polling done during normal working hours, many traditional conservative voters (men with 8-5 business jobs) don't vote until after work
There also seems to be a trend that conservatives are less likely to want to answer political surveys than liberals.
There were polls that up until election time were showing Bush with a small lead. But everyone went with Zogby's poll (since it showed Kerry leading).
