    I think it applies here, but instead of welding they used an off brand bike lock and they claim if we see inside the hood we'll start making cars just like theirs and selling it.

    IEEE is on our side. The Association of Computing Machinery is on our side. The DMCA is on our side just biting itself in the ass.

    Kaplan is on his own side anyhow.

    No it pretends to do it the other way around but that's just a smoke screen. I as user of a DVD have no obligations to the MPAA. The MPAA even says so in court. There's no means to authorize or authenticate the user like with DivX (Circuit city thing not MP4).

    If CSS wasn't an access control measure, you wouldn't need to break it to view a DVD.

    What it's a trade secret or classified? No. Then why the hell should I be prevented from viewing? There is no agreement between the MPAA and the user. Even the MPAA admits it in court. They tried to do things through the manufacturer. I have no problem with that. Except that they failed miserably to assert any specific intent. MoRE did not sign any license preventing them from producing a player. They didn't include any authentication of the user.

    It stops everyone from viewing not just the unauthorized user. There is no authentication of the user.

    It is, at heart, an access control measure that has nothing to do with "piracy".

    No one should be allowed to put arbitrary road blocks. Why should the equivalent be allowed with the MPAA?

    Their claim is that libraries are just as much modules as are modules. I firmly disagree, but c'est la vie.

    Um libraries are drivers/modules. Man teach these people a few lessons about orthogonality.

    Which he did. It's a bad law, but DeCSS pretty clearly circumvents an access control device, and the law doesn't care for what purpose - all such circumvention is proscribed.

    That whole line is dead. Kaput. CSS does not prevent any sort of access.

    It's been concluded several times on the list that CSS is a market control measure. That's all.

    I know the strength of CSS is not an issue. Under the DMCA efficacy doesn't matter. What matters is that CSS does not in anyway prevent piracy (access control).

    After recently reading the amicus brief filed by the CCIA and ALU as well one by the IEEE, I know that at least the reverse engineering ruling will be in favor of the defendants. There's too much at stake to require every business to have to start from scratch when designing a better product. It's a waste of time, patience, talent, and hurts the economy by keeping businesses locked either at square one or in court when they could be innovating. It's not what you invent that counts but how you do it when you're talking about quality.

    The case brought by the MPAA is also a joke by itself. They've got a weak argument about authorization. They have a circular argument that says you can use this player cuz we say so. Sorry that's like Ford saying we should all drive black Model T's.

    But this just made my day. Originally I thought hey it's not like either side has been completely impartial (pirates stealing, MPAA causing people to lose their jobs), but having seen the affidavits posted on EFF.org, I'm just shocked Kaplan was ever let into this case.

    If people had personal goals they wouldn't be making more humans. Making babies is a collectivist goal. I'm not talking about the activity so much as where it originates. But that's beside the point. You want to shut down gambling because it "kills people" (hint: this refers metaphorically to guns)? How about ending this self-guilt bullshit and allowing people the freedoms and self-respect they earn by being responsible? How about not SHUTTING DOWN BEFORE A TRIAL? How about the over loaded judicial system taking some responsibility and choosing NOT to HEAR petty cases? They have the constitutional power to do that. I absolutely agree with it.

    If you change something you must include sources. If you simply copy or compile, you only have to mention where it can be downloaded. Every package already does that on its own.

    Think about it for a second. What's the difference between making a standard distro and not including the extras at the web site? Nothing.

    Finally, we're talking about hundreds of separate programs. People need to get the concept of blocks and pieces and how they go together. Let every package maker be responsible for that.

    RedHat is the messenger and gift wrapper. That's all they do. And support. They must provide access to changed code but you can get that at the package site or sourceforge anyway.

    Otherwise you'd have everyone hosting the Entire Internet.

    Different technology... yeah maybe in some alternate universe. Maybe there you can add a cherry on top of your product and not have the laws of physics trash it to pieces.

    It's like saying if companies want to compete in the bottled refreshment industry they have to use different Hydrogen and Oxygen. I hate to burst your bubble but that's the curse in this universe.

    Hint: that's why software was invented. Adapter cards are dead weight much like a water wheel without water. Software is the key. Software allows engineers to get out of the confines of physics.

    The laws of physics aren't democratic. They don't give a crap about what you intend to do, only tell you what will and won't work. You can't just pull an idea out of your arse and say let there be light. With patenteers (those who don't need the protection to survive), it becomes extremely difficult to get in the game. There's very little room in the laws of physics for new products. There's a lot of room in the production stages for better quality. However you can't even talk about better quality because you're not even allowed to build the general thing itself. In a sense a WHOLE class of devices are patented by one patent.

    That's just how science works. Everything you design comes back to haunt you. Every step you make is going to be a road block. No way around it. Just look at caches in cpus. Every improvement fucks up something else. Nature is a stubborn bitch.

    Consumers don't give a damn about new ideas only useful things that should work. This means making a buck means making the same old shit better than everyone else. In specialized markets it means using the SAME technology, just taking better care of the component parts. Different technology is for quacks who have money to burn.
