I don't see how as from what contracts have been summed up on the web the contracts are to give them access to the whole of MSFT's patents and weren't written to specifically call out any patents by themselves. it reminds me of that old story from Sun, where IBM basically aid 'If these patents don't get you do you REALLY want us to go back and find some that do?" and they cut the check so they'd walk away.
So from everything I've been taught about contracts frankly it doesn't matter if MSFT came in there with fedoras and acted like Al Capone, all that matters is in the contract itself. And from what has been leaked MSFT's lawyers earned their hookers as it is a standard blanket licensing agreement, nothing more. I don't see how they would have cause since the license agreement wasn't written about these specific patents so their status really wouldn't affect the contract.
Of course you and everyone else is betting they'll get tossed and while i still think software patents are shit that is a BIG IF my friend. hell who would have thought the courts would agree that a square plus icons equals Apple property but that is what they've ruled, and if the courts side with MSFT B&N is gonna be in a world of pain. MSFT can afford to lose, I have serious doubts with the kindle eating their lunch that B&N can say the same.
Yeah but is it real or is it "playboy" real? I've seen waaaay too many issues of playboy where they have used so much airbrushing to cover up any natural curves and folds to where the finished result looks like a Barbie doll with a slit drawn on the crotch. Hell if you only wanted to see her in plastic there is plenty of CGI cartoon crap that will give you any celeb in any pose you want.
as for TFA great for the TLDs, lousy for everyone else. I was wondering if they would pull this "pay us or you may have a porn site in your name" crap and have to wonder if all the talk about having multiple new TLDs isn't just a way to keep the money flowing. I can easily see a day where every time the number of sales drops off they come up with another TLD and pull the same scam, so I really hope the porn guys win this one, sounds to me like a racket.
I'd say even then its kinda pointless unless you are developing Android apps. I mean what is the point of firing up an entire computer only to run ANOTHER full computer in a USB form factor? talk about "Yo Dawg, i heard you like computing so I put a computer in your computer so you can compute while you compute"!
I still think the better way to go is Expressgate/SplashTop. you have a single chip that plugs into a USB port on the motherboard and you have an instant dual boot that works at the BIOS level. no extra CPU, no extra RAM, just use what the machine has on it to run a fast stripped down web environment.
The fact that they are running dual core and only say "it is expected to run under $200" makes me think this thing will be $199 PLUS the cost of whatever device you run it on. hell at that price you could just buy a real Android device!
Exactly and did you notice not a single one dared to even attempt to answer my question? Its really simple, here are the facts. Fact 1.-The current IQ is at 103, with an average loss of about 1-3 IQ point per decade. Fact 2.- Unlike in every previous technological revolution when the low skilled were able to move up to a SLIGHTLY more skilled job, such as the loom replacing weaving, or the assembly line replacing hand craftsmanship for the first time in history the are not being UPGRADED by the machines they are being REPLACED wholesale. A factory where once 3000 men worked can now be run by three guys. Fact 4.- you have nearly a half a billion people in the US if you count the illegals and of those maybe 30% have skills currently required right now, and more and more of those jobs that once required skill are being replaced. look at the new blade servers for example, where it balances itself and if anything goes wrong it calls a parts monkey to change the blade.
So what do you do with all these people who simply can't trade their labor for capital because their labor isn't required? do you starve them? Sterilize them? put them into camps? what? all those that stick their fingers in their ears and believe in the invisible hand can't argue with the fact that NEVER before in our history has things been so top heavy, where more than 70% of the wealth of the entire nation rests in so few hands that you could put them all in the average HS gym and have seats left.
So what do you do in a capitalist system with those born with no capital and no way to trade their labor? Make work? Pay them to push a paper from slot a to slot b just to have an excuse to pay them? No matter how much they sugar coat it THIS, this right here, is the ugly truth...many that are born today simply aren't needed for their labor in a technologically advanced society. Soon the cars will drive on GPS and radar, Honda bots will do the shit work and little bots will scurry up trees to pick the fruit. We don't have enough work to go around NOW, what happens then if we don't plan for it?
Actually I live about an hour's drive from a pair of reactors, we all get electricity thrown in with our rent. Its nice, i have all my computers and it doesn't matter how much juice they pull, the handyman will just run me another line.
And if you had bothered to learn your history you'd know the designs being used now are MUCH more expensive than thorium reactors and were built NOT to generate electricity as a primary purpose but to supply us with weapons grade material for our little cold war with the USSR. it has been that way since the first one was built in 1947 which they didn't even bother tapping the juice from that one into the grid for nearly two years because they were more concerned about keeping the locations of their weapon producing reactors hidden than they were about power.
And sadly the only idiot here is YOU, since you seem to think you can go hug a tree and sing Michael row the boat ashore and that will magically solve our energy needs. FACT- The current technology of wind and solar if you are given half of AZ for the plants will ONLY supply around 13%, and that is the best guesstimate from the guys that actually build the things. FACT- Even those trying to sell green tech like molten salt solar (feel free to look them up, they should be one of the first links) say that at BEST their technology can be a SUPPLEMENT and NOT a replacement for current tech. finally FACT which you see to ignore, the wind don't blow all the time and neither does the sun shine on the USA 24/7. that means you HAVE to have a way of generating power or storing it and the battery tech? Its an energy LOSS when you figure in the costs to mine and dispose of it.
so don't get your big girl panties all twisted because your tech sucks, you have nothing that can generate anything near even one of those 1950s reactors in the same amount of space, that isn't even including thorium designs, which BTW after reprocessing wouldn't be any hotter than the uranium that is sitting in the ground all over this country. so you might want to read up a bit on the tech you are cheering for so much, you might find your emperor is a little bit nekked.
Allow me to laugh at you and your pathetic self BWA HA HA HA HA HA... I have provided links showing millions of dollars and thousands upon thousands of users RUNNING AWAY from your "operating system" and what can you do? what can you say? 'I don't like you you you you...stinky poo poo head!" I have showed your security is a joke, your a rotting corpse in retail, but you be sure to say some nasty names while you jerk off to a bash script. hell I bet you can't even get it up without looking at a picture of RMS, ha ha ha ha ha!
Now go wrap yourself in your tux blankie while the real men have a conversation, okay little girl? you are championing a system that can't even beat a 5 year old Java based POS. hell I wouldn't be surprised if Win2K and Win98 still have more users than you, now go compile something bitch.
Nah, I kinda doubt that and here is why: Look at how many companies that HATE each other, like AMD and Intel, or AMD and Nvidia have cross licenses. Even when AMD and Intel were slugging it out in court neither tried to revoke those cross licenses, why? Because they knew that once you get into the thousands of patents you are looking at mutually assured destruction which is why you don't see these megacorps tear into each other as much anymore.
I have a feeling Google bought Motorola not because they give a shit about protecting android OEMs, after all they didn't give a shit before and it wasn't hurting them, no I think its because they still want into the "whole stack" approach ala Apple and MSFT with Nokia so they are buying their own warchest to make sure any attempt to troll them by MSFT will equal MAD.
Sadly the only ones that get slapped around by these things are the little guys. Compare B&N to someone like Google or MSFT and you'll see they aren't even in the same league which is why they are trying to fight back, they don't have as much to lose and every dime counts when they are facing the kindle. For everyone else they'll either cut the check or cross license, just one more way our system helps the big guy and fucks the little guy.
Ya know, I hate to say this, but at least they were only stealing from the stores. i used to work in a little shop down the street from a Best buy and we were always swamped taking care of the PCs Worst buy "fixed". it was bad enough when we would get floppies put in upside down, hard drives literally beat into the cage because some clueless GS worker didn't know how to release the latch, but i don't know how many time i had to tell folks the reason their PC was slow, or their new graphics card was running like shit was because somebody at Worst Buy palmed it and gave them some shit out of the back if they didn't just rip it straight from the hinges like they'd do with RAM. That was how I met my last GF, I had to tell her the reason her PC was slow after she took it in to get cleaned was because while her PC was supposed to have 1Gb of RAM someone had helped themselves and left her a 256Mb stick in its place.
The bitch is the guy running that BB had to know something was hinky just from all the complaints he got from folks that would call them right from my counter but he made it clear that unless they had some before and after pics or some other proof he didn't give a crap what they or even the label on the side of the PC said, it wasn't his problem. Frankly I really wasn't surprised when they ended up moving to a new location because 'business was down' in that area. No shit, ripping off your customers can have that effect or so I hear.
as for TFA Newegg, Tiger, and Amazon are my three favorite places to shop anymore, never have a bit of hassle, never have a problem. Every time i've tried dealing with local shops I've found piss poor selection, clueless help, and insane prices. With Newegg you can tell pretty easily if something is junky just by the amount of negatives, just look at the rating on some of the Seagate drives for an example. Personally i'd rather shop there than deal with retail hassles, thanks Newegg!
Not to mention for MSFT this really is a "heads I win, tails you lose' situation. think about it, what is the worst that will happen for MSFT? In a couple of years, maybe more as the case drags on and on AND ON those 5 patents get invalidated. The cost to MSFT? Not really anything, their lawyers are on the payroll and the court fees will be a joke. What do they gain? Well they have already made lots of money off of Android licensees, which BTW won't be affected at all by this since their contract was access to MSFT's patents not just these 5, so their contracts will still be upheld.
So while I have always said software patents shouldn't have been allowed in the first place it was actually a shrewd move on the part of MSFT. They probably scared some away from Android, others they got paid just like they were selling WinPhone, I bet if one looks at the final numbers MSFT will have made a pretty damned nice profit without having to sell a single unit. Man I wish i could get paid for nothing like that, must be nice.
Oh please, they are making money hand over fist, getting paid for the majority of Android handsets AND their own WinPhones, and the case will take YEARS which is years of check cashing. Meanwhile you still think half a sentence proves...you can't copypasta? It doesn't surprise me, living in CLI copypasta is probably all you do anymore and you fail at even that. Perhaps you'd like some links on Linux getting pwned and failing, yes? Just to brighten you day? Maybe you can use a Daemon to download the pages and read them in an email client, just like your beloved RMS does. How sad though that you HONESTLY believe your OS, which BTW you STILL can't fucking update without the damned thing breaking, has a shot. remember what your numbers are?
Get ready, heretheycome! Kinda makes that koolaid just a little bitter now, don't it? I believe in using the best tool for the job, but to say Linux is secure or better than any other complex OS is frankly bullshit. Hell I was talking to a 15 year Linux admin on one of the other sites that had gotten so sick of Linux desktop fuckups they were going to BSD and if THAT didn't "just work" they were gonna wash their hands of FLOSS on the desktop and just go Mac.
BTW if you'd like a little more food for thought, what OS was 3 of the 4 CAs running that were compromised? takea lookand see. Maybe they just had bad configs? Surely someone with knowledge would be safe right? Guess again and its not a flukeby any means.
And of course on the retail side you have a decade old Windows beating the shit out of Linux on netbooks proving that your latest and greatest couldn't even compete with a decade old OS,ASUS has given up on your bullshit, remember them? The ones that actually STARTED the whole netbook thing with Linux? And you can't even keep them! Or how about Walmart running away from linux as fast as it can? You got the crazy koolaid drunk enough to say they ALL are paid shills because they won't do your forum dance or CLI horseshit? Meanwhile your "hero" Torvalds the great says Linux isn't planned it grows like a virus!, yeah that would be an STD and explain why you are still a decade behind on the driver front. Oh and when you respond with your usual bullshit and lame excuses could you please go here so we can see which lameness you are gonna use? The current most popular are "use esoteric workarounds" which is ALWAYS popular in Linux land, and "It works for me!" because you neglect to mention the weekend you waste every 6 months to make that statement true.
Oh and in case anyone is curious about the half of the sentence that makes him wet himself in fear the complete sentence is as far as the user is concerned there is NO command line in windows which of course is 100% true, because their OS simply doesn't need it. Here is another sentence for him to fear BTW Linux IS Windows 98, no more, no less because what was
Because people come and go, planes fly overhead, clouds roll in, too many constant changes for it to make a good target. if you look at both the USA and the Chinese targets they are built in areas with almost zero clouds or rain, so that nothing ever changes. its always there, its always the exact same shape, size, color, etc.
Its like that test pattern they used to show at sign off, by giving you the exact same pattern every single time they made it easy for the techs to spot problems with just a glance, whereas with a changing target closer scrutiny would be required.
Why would I do that? he gives me what I want and never balks at giving me referrals! Since my mom is a nurse with 40+ years experience she knows exactly what will work on me and knows his nurses since the dawn of time so I don't even have to deal with the waiting room crap but once a year.
So he likes to give out Z-Pacs, so what? I don't take them, I just give them to mom and she gives them to my nephew who they work miracles on (and who doesn't have insurance) and I just get my good old Eyrthro which always works for me. works out quite well for everybody, thanks.
The problem with SSDs is that it looks like all but the enterprise "ZOMG look at the price!" drives are going MLC and as Atwood at CH points out those MLC drives really have to be judged on a hot/crazy scale because while the speed is smoking hot the failure rate is fucking crazy. I know after seeing a couple of my gamer customers shell out frankly insane money for the fastest drives and seeing both fail in less than a year that broke me of wanting to mess with them. sure they got replacement drives but so what? didn't get their data back.
At least with modern HDDs it has been years since I've had a drive "just go" on me. the always seem to give plenty of warning nowadays, you get SMART errors, delayed write errors, heat issues, something to let you know "Uh oh, time to get the data off" whereas with both SSDs it was 'flip switch, drive no go" and no getting squat back as far as data. While I agree it'd be nice, it doesn't look like they are gonna be cheap and reliable, just cheap.
Have you looked at Paragon Drive Backup Server software? You can backup live servers, back them up to VMs or vice versa, its pretty nice.
As for TFA I deal with more SMBs now than I do corp but with the SMBs we switched to HDD backups. A Tb drive will easily hold a year or two for the average files a typical small business puts out and just switching the drives once a week for the offsite and syncing them makes for an easy and cheap offsite backup for a small office situation.
As for the big corps frankly i wouldn't be surprised if the bean counters are just too damned cheap with the economy being down. i know that even when times were good "Hey lets screw IT on the budget!" seemed to be the order of the day and I doubt anything has changed. Everyone always seemed to see IT as a waste of money until shit broke, then it was blame the IT guy, not the bean counter that has already moved up thanks to his "cost saving measures". That was the main reason i got out of corporate, got tired of being given incredibly difficult problems and a shoestring budget to fix it with.
How did he do that? He said "We didn't detect this with 1987a which was a much larger event" which means he is merely comparing two data sets. Considering how many measurements were taken of 1987a all over the world it is a valid argument about the possibility OPERA is wrong. Perhaps something isn't calibrated right, perhaps there is a malfunction somewhere.
So I don't how you can say that a person pointing out an event with many more measurements doesn't support the results a single group is getting is somehow anything at all to do with faith, just seems to me he is pointing out that when multiple groups get A on their results and only one group gets B suddenly saying B is right may not be the best course of action.
I may be a little humble shop owner but I can't see any flaw in that logic and it sure doesn't sound faith based to me.
Didn't bother to read the entire FL did you? It was under embedded because they had just released their latest Coreboot for an embedded system but if you'll read about the middle of the page he says " Finally, AMD is now committed to support coreboot for all future products on the roadmap starting next with support for the upcoming Llano APU. AMD has come to realize that coreboot is useful in a myriad of applications and markets, even beyond what was originally considered". Now since Llano isn't an embedded but a mainstream laptop chip I doubt they are talking about embedded, don't you?
And I would say it would very much be an antitrust issue if the ONLY machines that can get a "designed for Windows" sticker belongs to Intel. And considering Intel has more than one investigation ongoing I doubt they'd want the attention either. If the reports are correct the ONLY way one will be able to get the DFW sticker would be to have secureboot AND have it active. Now since as I just linked to that would be cutting out the FOSS bootloader AND cutting out any AMD PC from carrying the sticker I think the EU might want to have a word with them about their approach. Its just a damned shame our DoJ hasn't got any teeth anymore, hell if the MSFT trial happened today not only would MSFT win they'd probably get a tax break and an apology!
Don't worry friend, because talking to my customers and showing them the win 8 screencaps all I have gotten is HATRED, they HATE the "cell phone" UI as they call it, they HATE the irritating FB way of having things, they HATE the entire design and want NOTHING to do with it!
I personally think the engineers have gotten sick of Ballmer's bullshit and are letting him have every stupid thing his big fat clueless heart desires. you heard the expression "give them enough rope"? I think that is EXACTLY what we have here. he ran off Chen, hell even ran off Ozzie whom I thought would die as a Microsoftie, and from the rumors on the net Win 7 was only saved by letting the office team come in and fix Ballmer's mess. finally you add in the fact Win 7 is supported until 2020 (letting people easily skip this horror show) and I smell a setup.
No friend I think this is the true blues inside MSFT getting fed up with a decade of ballmer and are letting every single stupid ass idea he has go into the OS. Instead of anyone pointing out how dumbshit it is to fuck up the brand by putting win 8 on ARM and calling it win 8, which of course is sure to flood retailers with returned tablets when folks get these "Windows" tablets home and find their X86 software won't run, they are all saying "Sure Steve, that is a WONDERFUL idea, you're a fucking genius!" and kicking back and waiting for the fail so the shareholders can finally force the sweaty monkey to "pursue other interests" and they can go back to making a solid desktop again.
Wow you are so wrong i don't even know where to begin with your wrongness. People don't want their land polluted? See Monsanto as to what you would have, where Monsanto pollutes your land with GMO spores and then sues your ass! In true capitalism he who has the gold makes the rules and if you have no gold you ARE the peasant in China.
And getting rid of the minimum wage? are you stoned or just insane? Did you not read where ALREADY walmart is giving training videos on how to get on food stamps because their pay is so shitty? you think having to pay LESS would make things better? Oh and the reason the poor are fat is because SHIT FOOD is cheap, whereas healthy food? EXPENSIVE. potatoes and fatty meats and HFCS is cheap as dirt but a decent cut of meat and decent non GMO veggies cost you an arm and a leg, not to mention the poor are working more hours than EVAR without being able to get ahead so they end up eating Mickey Ds because they are too fucking tired to cook!
But don't worry I predict the right wing will force through many of the things you desire, then we'll have our own Arab Spring! Capitalism is a failed system, with more than 60% of the wealth concentrated in so few hands you could put them all in a HS gym and have seats left over. As we have seen with OWS the embers are starting to catch, as they break out the dogs and the hoses it'll get a LOT nastier. Notice there is pretty much a news blackout of NYC now? They don't want you to see what is going on.
Actually we COULD be building the nice small thorium reactors if it weren't for the NIMBYs (Hi NIMBY!) that force us to use 30+ year old designs. Oh and I'd love to see that magical battery that is gonna hold all that juice, especially since every study I've seen shows electric vehicles don't even add up when you figure in the energy it takes to create and dispose of the battery.
The simple fact is if it weren't for massive subsidies the "green" tech would frankly be so damned expensive nobody would be messing with it. We simply haven't progressed far enough to develop a true "green" tech that doesn't cost more than it is worth. to this day fossil fuels give us as much as 4 or 5 times more energy out than we put in, followed by nuclear and renewables are way the hell on down there.
Doesn't mean we shouldn't continue to subsidize it in the hopes we can make it work some day, but if you think you can run the planet at the current rates, much less with the constant power growth we have year after year with nothing but wind and solar I have a really nice bridge I would like to sell you. If we were to get rid of fossil fuels and nuclear tomorrow we'd have to go back to 1930s levels of power usage. Feel like sitting by your single light bulb and listening to the radio for one hour before going to bed do you? Or freezing in the winter or cooking in the summer? Personally I'll keep my quad core gamer rig and enjoy my heat and air, thanks ever so.
Don't forget the sewer systems and water supplies. I remember reading in a magazine how many drugs could be found in your average river because the sewer systems end up one way or another into the rivers, be it leaking pipes, floods, etc and you end up with all these drugs from antibiotics to painkillers to hormones in the water supply. Then of course fish absorb the drugs, animals and people absorb the fish, and around it goes.
And finally let us not forget the massive bribes...err I mean "incentives" the drug companies give out to doctors. I could always tell which drug my local doc was getting a nice vacation package from because that is what he is pushing for EVERYTHING, funnily enough the current one fits right into TFA because his handout drug ATM is an antibiotic called Z-Pac.
Fine, although I'd say that's a pretty ballsy move for you to just cancel them like that. You sir must have....balls of steel! Which of course means you're not allowed within 500 yards of the school in TFA.
Now for something serious...who the fuck decided we have to babyproof the world? Did I miss a memo? Hell when I was 5 I had my own minibike, most of the other kids had minibikes or go-carts as well. Did we get hurt? fuck yeah we got hurt, but you know what? We went home, put a band-aid on that shit and went back out again!
Hell its no wonder kids are coming out so fucked up nowadays, parents treating kids like they are made out of glass! Can't play outside, can't trick or treat, I had one bump into me at a grocery store and when I simply said "excuse me young lady" I had her mother whisper "stranger danger", needless to say I went off on her ass at how teaching basic manners instead of acting like everyone was gonna snatch her kid would make the world a hell of a lot better place.
Frankly I'm so damned sick of idiot parenting that it ain't even funny. i'm just glad that the parents in my building are actually teaching their children to behave instead of acting nuts. I had to knock on one of their doors the other day just to compliment her on raising such a polite child, who actually held the door open when I was loaded down and said "good morning sir" when I approached. How damned sad is it when simple common everyday courtesy has to be treated like some rare and precious accomplishment.
Nope just use Google images to check out the AZ desert and White sands in NV and you'll see similar targets like bullseyes and zig zag and all kinds of other targets. It is simply a cheap and easy way to calibrate a spy sat since all you need is a piece of desert and some white paint. IIRC there are also some bombers and fighters left in the middle of the desert in NV near an abandoned runway that is used for practicing taking shots of aircraft on the ground, its easy practice since its always in the same place and same position so it is easy to compare.
If anything to me the interesting part is how much more poor the resolution on the Chinese sats are to the Americans since the Chinese targets are fricking huge and the bullseyes they have in AZ go down to some pretty tiny center targets. I'm sure in another decade though they'll have it tight enough they'll be able to read the license on a car, they'll just need a GUI in VB like the CSI guys.
My problem with Paul is he has made it clear that as a Libertarian his goal is true laissez faire capitalism and as we have seen time and time again that is a recipe for disaster.
For a good example of that just look at China which despite all their talk of communism is more laissez faire than anyone else. Sure their economy is rolling while more than 10% of their farmlands are poisoned and a person living in their cities sucks down more toxins in a week than an American does in 5 years. Take a look at the top 10 cancer causing cities in the world and 9 out of 10 are in China, the only other one being an abandoned Soviet era chemical factory town.
If anything I'd say we need a more socialist system, and no what we have now is only "socialism for the rich" as in TARP and too big to fail. there is NO reason why every American shouldn't have clothes on their backs, food in their belly, a roof over their heads, and medicine when they are sick, NONE. If they want more than that? Work. But of course for them to have work you'd have to get rid of this "free market" horseshit, which is just what it is as India and China don't follow our regs or play by the rules, China going so far as manipulating their currency to make sure our imports are too high while their exports are cheap.
No I'm sorry but laissez faire capitalism just doesn't work, in fact I'd argue that capitalism as a system has nearly reached the end of its course, why? simple as tech progresses we are seeing the need for fewer and fewer workers and I truly believe we are at the point when many being born today simply won't be able to trade their labor for capital (the entire basis for capitalism) because their labor simply won't be needed.
We are in an IQ musical chairs and more and more simply can't find a seat. They are already working on robot fruit pickers and field hands, machines that can crank out a home from prefabbed pieces, what do you do with all these people? Do you execute them? Create "make work" as we have done with the fast food industry? BTW did you know that Walmart shows as one of their training films how to get on food stamps? How much you wanna bet that without that "government assistance" making labor cheaper than it should be that Walmart would just replace them with automated stockers?
The technology already exists to replace most of your low end workers, and those that work with their muscles and not their brains. The average IQ is 103, these people simply can't be trained to be rocket scientists and frankly we wouldn't need that many rocket scientists anyway! What do you do? send them to a camp? Take away their rights to have families? The only answer I can see is going towards a more socialist system where someone can live without having worked a day in their life, because otherwise we have to become Luddites and smash the machines or we are gonna have to seriously thin the herd.

Well you just hit on what will be the nasty "gotcha!" of HTML V5...the DRM. There is NO WAY that MPAA and others like you that want to get paid for their content will allow their videos and games to be snatched as easily as copying a JPEG so there WILL be DRM.
Which frankly I have NO problem with as long as its fair. Steam has DRM and works just fine. what i DO have a problem with is MPEG-LA has already made it clear you will "Pay your $699 license fee you cocksmoking teabaggers!" to rip off an old meme, just look at how they made it clear Mozilla isn't allowed to have an H.264 codec unless they bend over and do the Goatse pose.
So what you are gonna end up with is a fractured all to fuck web that is WORSE than we have now. At least Adobe has made it clear its fine and dandy to distribute their decoders, in fact they haven't said boo about gnash either. with MPEG-LA you have a company clearly hostile to anyone not cutting them a check, which cuts out anything FOSS.
Here is my prediction, watch how sadly it comes true...H.264 will allow the big three, Apple, Google, and MSFT to lock down the web, Android will end up closed by eFuses or code signing so that Google can sign the NDA and play protected content, and FOSS users will end up being told "Buy a copy of Windows and dual boot when you want to watch videos". I don't know about you but I want the web OPEN and while flash isn't the greatest thing out there frankly its 1000% more open than H.264 is now. If the world jumps on the iBandwagon mark my words they'll look back at when you could do things without being on one of the big three corps products as a golden age, because that day will surely be gone.

1.-No it isn't if it requires H.264 which is locked up tighter than a nun's thighs by MPEG-LA. See the Linux distros that got threatened for distributing an H.264 codec without a license.
2.- No it will require an expensive MPEG-LA license, whereas Adobe at least allows the decoder to be distrbuted for free and even allows open source alternative like Gnash
3.- Again wrong as H.264 acceleration is part of protected path on BOTH AMD AND Nvidia cards, hence why even a FOSS friendly company like ATI can't give you the specs.
4.- not a DB guy but I doubt most folks care about writing DBs in CSS.
5.- Yeah like THAT can't be easily abused. Security Tool style dialog boxes anyone?

So again you have a format that is MORE locked down, uses MORE resources right now , MORE proprietary and is GUARANTEED to fracture the web WORSE than it is now, because Mozilla and Opera have done made it clear they will NOT support H.264, as well as FSF and most Linux distros, and this is supposed to be progress?
Again i stand by my statement, this is Dilbert PHB's idea of progress, which is to say none at all. if they would have went with theora or WebM I would agree with you, but H.264 makes this a non starter.
Get ready, here they come!
BTW if you'd like a little more food for thought, what OS was 3 of the 4 CAs running that were compromised? take a look and see. Maybe they just had bad configs? Surely someone with knowledge would be safe right? Guess again and its not a fluke by any means.
6.- Better pay your MPEG-LA license fee you cocksmoking teabagger will replace the old SCO meme, yay!
7. - Not everyone has a tablet, but that sounds more like a GUI problem than a flash one
8. -Again GUI problem and we've had the ability for years to base a website on the referrer.
9. - Yeah all you'll have to do is throw everyone you own out and buy all new stuff! Please tell me when you get everyone else on board, I'd like to buy some OEM stock!
