    As far as why the SCOTUS reviews them disproportionately, I should think it were obvious: In recent years the 9th circuit has been dominated by Democratic appointees, and in any case, Senate confirmation process rules encourage appointment of district Judges whose politics are roughly similar to the residents of their district, which in this case includes a heck of a lot of liberal Califonians. Meanwhile the SCOTUS is 7-2 Republican appointees.
    This is totally OT, but I thought you guys were meant to have separation of powers, making the judiciary apolitical, but it seems that you have one of the most politicised judiciaries in the first world. OTOH here in the UK, the highest court is the upper house of the legislature, but we seem to have a less politicised judiciary. I couldn't tell you which law lord votes which way (they sit in the house of lords, but do not represent any political parties), for example; they leave their politics at the door when sitting in judgement; at least on the surface. I wonder why that is? I'm sorry, I had a point; I seem to have lost it...;p

    Indeed, I wonder how different these sites were to the ones here in the UK that told you which way to vote in order to keep the tories\new labour out? The media called it Tactical voting in this country, personally I think we should use the Single transferable vote system. But the politicians, have too much to lose; there's a reason that it was supported by Labour when they were in opposition, but now they are in power they're against it. The First past the post system benefits the incumbents, so it will continue to be used.

    I don't know about the USA, but somthing similar certainly happens here in the UK; it's called "pairing", Parties will let their MPs pair off with one another one from a different party, so that both can abstain rather that being disciplined by the party for rebelling against the party line.

    You shouldn't be allowed to make an agreement with someone that dictates how you should vote. Quite the opposite, you make an agreement with someone when you vote; the person you vote for. I certainly know that when the candidates come knocking on my door (I live in the UK, they actually do that here*) I discuss their party policies with them, and form my opinion about who to vote for.
    In essence you are saying to that person I'll vote for you, if you vote for these policies.

    *That's not 100% true, it depends on where you live, if you live in a marginal you'll get home visits from the candidates and lots of senior party figures visit the area; if you live in a seat where a sheep with the right coloured rosette would win, no chance.

    Female librarians earn less than garbagemen, not because of discrimination, but because so many applicants compete for the safe, clean, comfortable, convenient, fulfilling jobs women prefer. Whoever wrote that is a Moron, and dosn't know the first thing about Librarianship; Your average Librarian needs has a degree should earn between £18500 - £22500 newly qualified, once they have experience, and a chartership, they can be earning up to £28000.     If that happens, you can leave the job and claim that you were "forced" out (usually this will happen if a person is repeatedly passed over for promotion), and still claim unfair or perhaps wrongful dismissal. If passed over for hiring in the first place, IIRC there's not much you can do unless you can prove discrimination on the grounds of sex, race, disability, religion or sexuality. So, in theory, a white Christian male is protected against a blind, black, lesbian woman bushiness owner as well as vica versa. In other words the scope for a court case is quite wide, though they are not all that common as most recruiters now use a points based system with the same questions for each candidate. Thus any independent expert in the field should be able to say if the "right" person got the job.

    If it's anything like the field I'm currently in (Librarianship; I've done a degree in Software engineering, and can't code for shit; I'm hoping to start my Masters in LIS* next year), although it's female dominated, the top management is still mostly male.
    There are signs that this is changing though, and the "glass ceiling" is slowly disintegrating.
    However being only one of 4 blokes in a 13 man team, two of whom are solely IT guys, and the other is a manager, makes for an interesting life (I liaise between the IT side and library side of our team).

    *At first it was amazing how much overlap there is between Library and information science and CS, though once you think about it, it should be obvious, the "information science" bit should give it away; and what are Librarians if not the flesh equivalent of Google (not just the search engine, but the whole "organize all the world's information")? And our brains will outpace Google's CPUs for quite some time.

    P.S. Anyone else a little dissapointed by the A-10s' cameo in Transformers? 40mm SABOT infantry rounds were effective, but 30mm depleted uranium wasn't? Oh well, it gave the gunship a chance to shine. I have a similar complaint about a movie I was in, but I'll save that for another time. If you concentrated more on telling people that you were in a movie, and less on Transformers trivia, you'd be far less "hated". Unfortunately (perhaps fortunately for you), we live in a fame oriented, fickle world, and if you can show that you've been in a movie\on TV\in the News etc. if you play your cards right, you've got it made as a daytime TV presenter on Sky channel 94. Eventully graduating to channel 5, or sky two if you're lucky. That's how it works in the UK anyhow.

    Even if there was a law against this type of discrimination (if you want to call it that) how would you enforce it? How would an employee convince a court that this was the main reason for them not getting a job? We seem to manage it in the UK; as my other post says, we do it with laws against Unfair dismissal and the establishment of Industrial Tribunals

    But is it even legal for a company to turn you down from a job offer, or fire you, just because of something you did in YOUR free time and NOT during work hours? That depends on your country; here in the UK we have somthing called Unfair dismissal and industrial tribunals that mean that you can't. I don't know the situation in the USA.

    Reporters are paid to go and get the story. The only ethical lines they have are to report the truth in a fair manner. If the losers at DefCon really weren't doing anything wrong, they'd invite reporters in, with cameras and tape recorders and all the rest. Not to everything, but to enough that the press could see the complete and utter lack of a black-hat trading show.

    (And if it IS a black-hat trading show -- well, then I've got no respect for them.) The media *can* go in, they just have to admit to being part of the media; From the Defcon FAQ:

    Q: I'm press, how do I sign up, why can't I get in for free (I'm just doing my job)?
    A: Please email press[at]defcon[dot]org if you wish press credentials. Lots of people come to DEFCON and are doing their job; security professionals, federal agents, and the press.     The US Airline industry is very protectionist; even the recent open skies agreement with EU airlines doesn't go as far as most Europian carriers wanted and was seen to be bias toward the US airlines. (Both EU and US air lines can now land in more destinations, but EU airlines can't fly from one destination in the US to another; however US carriers can fly from one EU destination to another, a side effect of the EU being made up of many countries)

    Whilst I keep my web mail, bank and other important passwords in my head, I have no problem letting my browser remember my /. password or the ones for any number of random forums that I am a member of; or letting it remember the password I got from bugmenot so I could read some article on a site that has no need of my personal info besides data harvesting (For some reason newspapers do this a lot).

    It's not as if someone changing the password on my /. account would do me any real harm, it's a weak password anyway, so why should I bother having to type it in very time I visit?

    Assuming (and it's not a particularly big assumption) that you are referring to 'Americans' thinking that.. I think they know. Since when do American speak English? They use all sorts of strange words that us real English don't (e.g. soccer instead of football), and to make matters worse, the mis-use other words (the pavement is not something you drive on, not something you drive on)...;p

    I'm joking, but whoever it was who said that the USA and the UK were two countries divided by a common language had a point.

    not that the Yanks* are much better, at least the frogs* have reedeming features within a train ride or or even driving distance. to be pompous and patronising to the face of the rest of you guys costs a small fortune, and takes hours on a long haul flight. ;p


    *note, I'm English, therefore I have a licence to call the Aussies convicts, Americans Yanks and generally insult the French. In return they get to call me a Pom, Limey or generally insult me. when these activities are performed by other nationalities (including, but not limited to the Welsh, Scots, Germans or Americans) it's trolling. From us English, it's friendly rivalry and banter.
    This licence is irrevocable and non-transferable.

    On reflection you're probably right, I totally forgot that the launches of the Wii\PS3 were in the run up to Christmas. However I don't think that you can entirely rule out the impact of the increased media interest in consoles helping the 360 either. I'd guess it was a mix of both: around 80% Christmas, 20% Wii\PS3 (Yes I made those numbers up, but this is /., if I can't make stuff up here, where can I do it ;p).

    Yeah, well I bet you thought "Wii" was a dumb name as well. It didn't do the console any harm. And WiiFit seems to fit in (pun definitely intended) alongside Wii Sports, Wii Play and Wii Music nicely. You might not go out and buy it, buy there are a lot of people who will. Apparently it's all about the casual gamer now; and for me that's good as I seem to like games aimed at the casual gamer; probably because I am one, I just don't have time to dedicate a 20 hour gaming session to my latest game (unless it's Civ, but that's another matter; we all have our vices ;p).

    Artificial demand? Looking at the numbers I think that the problem is just that they can't get them out the door fast enough. They've almost sold as many as the 360 which had a yeas lead over them. In fact on closer inspection you can see that the 360 gets a boost due to the launches of the Wii and PS3. Without that effect (essentialy help fro Nintendo and Sony) they would have already sold more.
