I find this to be incorrect. I wasn't sued. But the MPAA sure did send me a nasty letter for downloading T.V. shows, and my ISP turned off my internet for two weeks, and then demanded that I either submit to federal jurisdiction or write were I put the file on my computer and how it was removed. I of course chose the option C. Cancel my account and take my business elsewere. But it stands to reason in my mind, that if i'm being threatened in this way for downloading, then they have the means to back it up.

That's incorrect. You have to back up your certificate and usually good to go, failing this (and hopefully a bit of forthought) you can recover encrypted volumes through use of a recovery agent. A recovery agent is a user account with a certificate capable of recovering the lost volumes. On workgroups this is the local administrator account. On a domain it's the domain administrator by default. The catch is that before you implement EFS you have to designate the recovery agent. So it's very possible to recover lost data on an ntfs volume. You just have to be smart about it.

My guess is that her reputation was such that editors allowed for an oversight when it came to fact checking her articles. Would you bother to check a Bruce Sterling article if you were the editor of wired? I would hope you'd say yes, but more often than not I'd say that his reputation was allowed to substitute for actual fact checking. Then again, you'd never have to fact check Bruce Sterling articles anyway because their all op-eds.
