In hindsight they should have just let him bleed out on the battlefield. Knowing that future detainees may end pouring out their hearts on Oprah I hope the military makes a strategry adjustment: take no prisoners. Ask a few questions, give them a smoke, and pop a few rounds in their head. That's what you're supposed to do to combatants out of uniform.

My uncle stole a shipping container full of MREs after the first gulf war and sold them. Survivalist, campers, backpackers, etc. buy them as fast as he could get them. He was turned in but they didn't prosecute and he was allowed to retire about 8 years later. Treasury agents told me they wanted him to turn himself in because they had better things to do. Those "better things" turned out to be burning women and children to death at Waco soon after investigating my uncle. Good news though, he's now a police officer and just shot a man to death who had a toy gun. See, things do balance out in the end. Hey, wait a minute...

The judge is a moron. Her opinion reads like a post on democratic undergound and will be overturned. Gathering signal intelligence is a military operation. You don't need a warrant to listen to what the enemy is saying. The Roosevelt administration listened to every overseas phone call during WWII without any warrants. The president of ITT talked to Adolph Hitler once a week throughout the war. It was an intelligence gold mine and to claim a warrant was needed is pure madness. These arguments are all a result of BDR, Bush Derangment Syndrome. The lawyers that argued the case before this ACLU ringer are Muslims that have ties to terrorist:

The problem is that there is not a clear view of a 747 running into the pentagon.

There's an easy explanation for that: It wasn't a 747!
    Flight 77 was a Boeing 757-223.

It's no longer a "theory" when the plotter(s) admit in videotapes that they indeed did plan and execute the attacks. On the other hand the nuts that claim the Jews, ZOG, and or the Neocons were behind the attacks haven't gotten any such confessions to back up their kook conspiracy theories.

Article II gives the president authority over the military. The NSA is a military asset. Congress passed the AUMF shortly after 9/11 and SCOTUS concluded this was a declaration of war in Hamdi v. Rumsfeld. On top of that if you're talking to Al Qaeda you have no expectation of privacy.
