The information overload is a problem, when we are reading about the same story several times. The question always is what is the information source? Are all the different reporting and perspectives from the same source. Or are they from different sources. The determining what is fact and what is spin and opinion question.
The internet has potential to create that old "group think" phenomenon, like the urban legend thing.
You will get no argument from me about the absurdity of IP. If I have an idea why should I own it, there are probably thousands of people out there with the same idea. But if I am first to file, then they can't use their idea any more??
Corruption in government? surprise, surprise!!! Russia and China and other asian countries are actually being pressured to adopt US type IP laws, enforcement is another matter, but the laws have to exist first. Europe already has the laws, and they are being arm twisted for more stringent enforcement.
And as to your bully theory, didn't they take down Sadaam because they claimed he was a bully, only to become bullies themselves. The bully thing does not work, because there will always be someone around to knock the crap out of the school yard bully. Didn't we just get through an episode of MAD (mutually assured destruction) and how did that work? Did it make the world a better or safer place. Or did the bullies dam near destroy the whole world including themselves? Aren't the terrorists trying to intimidate and bully now, isn't that what bullying is all about, everybodys own little power struggle???
"many otherwise civilized nations have been modelling changes to their "intellectual property" laws after the way the United States".
This has not been because they believe that this is the best "model" or solution, but because they have been arm twisted by the US government and it's shill the WTO. They in essence get denied "free trade" with the US unless they tow the party line.
But some emerging economies like India, China and even Russia are stepping back and taking another look. And asking do we really need the US trade that badly to let them interfere in our internal laws and policies?
Well yes, the US puts a gun to everyones head, are you really that naive? The US tries to force it's values and political views on countries that it trades with. The transactions are never totally business, where it is dollar for dollar exchange deals. Like the Sadaam deal, "we won't buy your oil, nor will we let anyone else buy your oil, unless you do this, and this, and this. That's not business, that's blackmail, which I believe is illegal in the US. The US does all international trade this way. I have seen the US break deals with countries that were originally negotiated per the terms of the WTO. They recognize no other authority but themselves.
But that is all about to change!!! The EU is a larger economy than the US now, and shortly China will be a larger economy than them all, with a more powerful military. How will the US deal when they will be forced to recognize other authorities? "When the gun is to their head" which will be in not too many more years. Russia, the second largest oil producer, is setting up to control who it will sell oil to, the Middle East is doing the same. China is a big big customer, so "US piss me off and you will get no oil" is coming. And the US will not be able to walk in and take it, like they did in Iraq. You reap what you sow.
Didn't want to use that one, because of sensitivity for the kids in Iraq, and all the military personnelthat have ever put themselves in harms way. The military folks can use it as an internal joke, and that's OK.
Sorry, Sorry, That was an obvious oxymoron wasn't it. There are just some words that should not be in the same sentence. Like lawyer and ethical code of conduct. Or "I'm form the government, and I'm here to help you"etc.
Is CP/M the one that Bill stole and made proprietary? Where he sent the infamous e-mail to the original hackers saying this is mine, mine, all mine. How could something so good go so wrong?
You can look at the specific or you can look at the general, you can look at the small picture or you can look at the big picture. But the small picture is always contained in the big picture. But any way you look at it, specific or general, MS is not the most stable and secure OS out there. There are others that have posted greater immunity and much longer run times. Would you agree to that???
This is on the dark side of the ethics spectrum. But then every activity is driven by some form of motivation. Is this altruism or personal greed? Has this whole RIAA thing been about right or wrong, or about greed, greed, greed???
They never let you peek behind the curtain, but I am guessing from the results that I have seen from all the cases so far, that the lawyers are on commission, as some percentage of the proceeds. So maybe priming a witness is a reality of a greed motivation.
The focus has never been about "cease and desist", but about how much money can the RIAA pry out of the victims. They are suing many thousands of potential customers, do they think that these and others that are aware of this, are going to run out and buy all sorts of music now?? How is this sue your customers strategy working for SCO?? Are customers rushing to buy their products??
I have about 400 big black LPs, and I was thinking about buying CD copies of some of the favourite ones, but I have already purchased fair title to listen to this music on any media format. So maybe I should purchase an A/D converter before the RIAA get their government patsies to make these illegal.
It's not the 9X series that I am writing about, it is Win XP SP2. Do you really think that this system is immune from malware? Keep a daily check on the malware news, is there not an unpatched one out there right now that can trash an XP system??? Why do you think that DELL is installing Firefox as the default browser on some of their machines? Because they have to pay less money to MS??? I don't think so!!! It is more likely to be because they anticipate less help desk calls on crashed systems. When your DELL system crashes, who do you call?? MS?, DELL?, or Gost Busters?
I have XP SP2 and the only thing that I have found to keep it reasonably safe is NOD32 AV. And that is because its heuristic engine has never failed to detect a virus in the wild. It is a little late to have protection after threat discovery, and the time it takes for an AV pattern to be written and installed, thousands of computers can be infected in this interval. But even so, if I drive XP hard and it will still freeze, stall, crash.
I have tried a lot of the Linux products, and have SUSE 10 currently installed, these may still be a little rough at the edges, but the stability never has been a problem, no matter how hard I drive them, I can even install software (and OS kernel software) without rebooting. That was a promise of XP, but did it happen???
Expecting fair treatment from MS with their track record, especially when you have no bargaining hammer or lever, is like expecting fairy tales to be true.
On the other hand I work for a Corporation that has a similar "Contractor" or third party labour situation. The corporate policy is the treatment of all employees, contractors, customers with dignity and respect. But also there is fine line of not being in breach of any existing "co-employment" laws or regulations.
So expecting some amount of fair treatment from MS is a reasonable expectation, but what are your chances of actually getting it??
That's not really the way business works. Any achieved cost efficiency is usually used to be more market competitive, if they are in a competitive market, or to add to the profit margin. It is never really directly passed on to the customer, but used for some business advantage. The customer may only see an indirect cost savings.
It all depends on what you mean by "better" I guess. If you don't mind the constant risk of system crashes and reboots, and your HD getting wiped out, or even your BIOS being trashed due to malware, then I guess Windows is better???
The music recording and distribution companies have come to the end of their usefulness. They are like dinosaurs in the space age.
Because recording and distribution has now been commoditized by the internet, there is no need for a "Recording and Distribution" specialized commercial function between the music artists and their fans and customers.
Don't you think that the recording industry sees that reality, and when anything is fighting for it's life, like the music Recording Industry is, there are "no holds barred". But that won't stop nature taking its course, extinction and replacement with something more suited is always inevitable.
