When you install an app that is able to send SMSs, you have to click on a dialog that says "you allow this app to send SMSs". It does the same with a variety of stuff, from internet access to GPS use. So I wouldn't call it exactly "unsolicited".
I think people that download stuff from shady Internet sites and install them on their phones deserve other names. Here's a short list: stupid, ignorant, irresponsible and dumb.

I'm not arguing about the present differences between US and Egypt. I'm warning about possible similarities in the (relatively) near future, and the use of the word "Never".
At some point in time, Egypt itself was the biggest civilization known to man, much like the US has been. And it was one of the World Powers for more than 2000 years. The US total existence, in contrast, barely lasts 250 years.
The proportion of people with "somewhat decent lives" in the US is diminishing, while the differences between the rich and the poor increase. If that tendency continues, "never" can be really a short-term period, historically speaking. "This century" short.
It would be very nice if the US went all 'Iceland' on itself instead of going 'Egypt'.
Others are saying thar the law makes this "unburyable". I'd argue that, from a Lawer's point of view (by the way: IANAL), something put on the EULA or terms and conditions is not "buried". It's explicit. As in, written there. Even if you normally don't read it, those guys do. And those guys are the ones that send cease-and-desist letters; they are the only ones that matter.
So, in my humble opinion, the OP is right; putting it on the EULA or whatever will be good enough.
