There was a case a while ago about an iPhone being used as a medical device. And it was several times cheaper than the comparable tool. But it wasn't allowed because it was a phone/toy and not suited for the purpose.
Personally, I think these big companies are missing an opportunity. Why wouldn't nintendo gimp the wii, stick it in a sturdy box and allow people to use it for one purpose only, then double the price and sell it as a medical tool. Same with cellphone companies that could be producing today's tricorders.

Increasing speed of chips and ram could help relieve that pressure mind you. As programmers can tade off more processing for less drive usage, or count on faster ram and compress everything. This will give us a bit more time. Beyond that we will simply have to get more inventive on how we use computers.
Very very fast internet could become important, if users feel they need access to 10million TB of data personally. That may not be physically feasible on a personal computer. So 'cloud' type services would be important. Having a few duplicates rather than 1million duplicates of any given song is clearly a big improvement. This of course feeding into the idea that when we made the internet we stopped making machines, we just started making components for the one ultimate computer. And when you think of it from that perspective there is tons of room for improvement even if some of the parts are nearing the useful maximums.

I bet there are cases of actual hackers getting busted for counts in the tens of thousands or hundreds of thousands of the same, or similar intrusions. And get about the same time.

The difference is subtle. It means that there isn't a minimum bar that you have to get over before justice evens out. Which would seem to make sense, if you can't hire a good lawyer you are obviously screwed. But that even amongst the very rich, the one with the deeper pockets still wins. Figuring out why that might be the case seems important.
Though in reality it is likely that justice MOSTLY flattens out for the rich vs richer. But rich vs rich corporation is a fresh jump in inequity.
