    As for how HP is LIABLE :> that's another matter. I would guess (INAL) that the arguement goes HP used Intel Pentiums. Intel Pentiums violated the patent. HP should have checked before using the Pentiums if any such violations etc existed - any if they did and intel said no then liability would pass to intel - if they didn't then they're liable for not carrying out due diligence.

    IANAL.

    This is a bit dangerous advice. If you actually check for patent-claims, find one and still buy/sell/use/import/export/etc the product, then you're liable to TRIPPLE damages. Yes, that's right, you're punished for checking in advance!

    Maybe HP can pressure Intel, but any small company can't afford to not buy anyways.

    Patents are not good for society.

    Unfortunately, if Intel has to pay up, prices will go up. In the end, we all have to pay up for all these litigations and excess use of resources on legal claims.

    And if you don't think that could/would happen without patents, then you are sadly mistaken.


    It's called competition.

    What often happens is this:
    Company A patents all their ideas and inventions, down to the most absurd.

    Company B develops some similar technology with their own independent research (who can understand the text on patent-claims, or have the time to read the millions of bogus and unuseful claims? The directory of patents is only useful to lawyers.)

    Company B becomes successful for having a superior product.

    Company A sues company B for patent-infringement some years later. Company A is usually in a downturn at this point, with no good and proven products.

    How are patents productive to society? Company A would develop the technology some time or later, it's usually incremental changes in existing technology which are mostly patent-free and public domain.

    Software patents and litigations will kill an industry based on building and sharing on ideas. Where would programming languages be, or anything in this society, if everything was to be patented. Progress would slow down.

    And the small guy who wants to produce products are squeezed out, because lawyers are expensive.

    Compare this with that people will get ideas all the time, usually at different parts of the world at the same time. Patents will not make these ideas pop up any faster, only raise the barrier to implement these ideas.

    Big companies never produce any ideas by themselves..

    Always seeing the negativity, is really depressing and nothing good will come out of it. The more you hanker and focus on it, you just become more negative yourself.

    The media should really learn from this, because the constant onslaught of negative news, are really affecting us. (Try go a week without watching TV and reading the news, you'll be amazed. A month, you will balk.).

    I remember reading some astronomy predictions on Gates, and the interpretation specifically mentioned that Gates would donate TONS of money for good causes. This was in the late ninties, and he wasn't really that famous for his donations then.

    This donation is just the beginning. Mark my words, when the world needs it, Gates/MS will donate incredible amounts of money in order to restore economic power. I'm pretty sure he will be prominent in getting other rich people along on it too.

    I believe Gates thinks he is entitled to all the business opportunities he can get, and frankly, it's only natural for bussiness to try to reach monopoly. So this is not to clear any "conscience".

    In the future, Bill Gates will actually become pretty popular because of his big heart (and wallet). Everyone's heart opens when trouble rams, just like the Tsunami.. The idea of having the super-rich will not seem so bad.

    It's just too bad people need crisis in order to start to care.. *sigh*

    If you are a cynical rationalist this will just seem like empty rambling. Just wait and see though. I'm pretty confident in this source.

    I'm typing this in a normal user account in XP with no special privileges. There's no way this account can write to the Windows hosts-file, except for a root-exploit. I've set most files to read-only.

    Actually, the XPs security system is more sophisticated than the typical UNIX file-attributes. The only stupid thing is that it's global RW by default, and the installation routine doesn't create an unprivileged account for the people to use.

    Of course, it made Microsoft more money to make it easy for people, and now we're all paying the price for the stupidity..

    Sounds like you want something more out of life than the regular sheep. I can heartfully recommend Art of Living.

    When you begin to see the emptiness in the world around you. You are very lucky. It's the only way out of habitual patterns and endless search for self-gratification.

    In time, the emptiness will seem full of life, because space has the biggest potential and energy-level. So go into that empty feeling, instead of trying to fill it with more objects and events. It's different to what we're used, to really go into every feeling and situation 100%, so it's only for those who are bold enough. To flee from it, creates those patterns that you have started to recognize, and patterns limits our options.

    You are so correct. I'm not saying we should ditch male concepts, merely incorporate more female aspects. When we can use both sides effectively, they will cease to be sides. Conflict arise from separation, so making both integral will almost make conflict disappear.

    The world has been decidedly male the last thousands of years, that is why we dearly need more female values and human values in society now. So we can rest in both, and become one the way it is meant to be.

    Controlling seeds and how other people use "your" product, just to create a higher profit, is unnatural, is not "Right" (whatever that means) and should not be allowed in law and ethics at all.

    Monsanto does not have a right for profit, or maximum profit. It's just a company. Never forget that.

    Why should seeds be burned just because a company sets arbitrary limits to its customers? Why should we tolerate to be held ransom to large international companies? We're talking about Life itself here.

    My only rational conclusion must be that I have fed a troll. Nobody can be this stupid and cynical.

    I recommend everybody to read the CIA report, parts of it anyways. However, read it consciously with this in mind:

    It's only about power, force, strength, competition, threats, tactics, etc, etc. It's ALL MALE concepts of how the world is supposed to be working.

    In the extreme, male-thinking, is only about fear. It might leave you blind to the obvious: Let's be friends, not allies. If you read the CIA-report, it's all fiction. Just read about young Europeans growing anti-americanism because they didn't witness WWII themselves. It's a poor argument covering up the truth. Deluding oneself will only distort clear vision. Who wants to follow a blind?

    You cannot build a bridge between nations based on fear. "The New World Order" will not weather the storm of time, if it's based on fear and covered threats.

    I believe the future of international politics will include more and more female values, like nurturing, cooperation, upliftment, virtue, idealism, hope, trust, honesty.

    Are we so fearful, we don't dare to take in these values and develop ourselves? This goes for EVERYBODY. Instead of radiating fear, insecurity and indifference, we can boldly radiate trust, strength and caring. It'll make you happier, and people around you will remark a difference, even change a bit themselves.

    Btw, I'm male. You don't have to be female or gay to incorporate female concepts. ;-)

    This is not about "Make love not war", it's much more down to earth and natural than that. It's the bold way to live. There's so much wisdom in the world, let's use the best of the best, instead of relying on old paradigms.

    As a European, it is incomprehensible to me that anybody could vote for somebody like Kerry. Bush is clearly the one you must vote for. So I urge every patriot US consumer to vote for Bush. You have to! Somebody must be left to save your Country!? I am seriously concerned about you.

    For an extremely easy and streamlined CRM solution that works alot like Wiki's, I've recently been pointed to Typo3.

    I'm not sure if it has WikiWiki-words, but that's not so important to me as it is for projects like wikipedia or wiktionary. For normal use, WikiWords are just confusing to regular people.

    Typo3 is fully user-editable from the browser, with authorisations and fine-tuned privileges. It even has real WYSIWYG editing (IE only for now, otherwise there are some tags). It is GPL, open source, documentation in Open Office format.

    I'm perhaps not the right person to advertise this project, as I've only tested their demo. But after having messed around with pmWiki, TWiki, checking out TikiWiki and others, I can safely say that Typo3 is the best free as in speech solution for a WYSIWYG CRM I've encountered. Forget teaching people to use tags, only programmers will do them. WYSIWYG is where the real Wiki revolution will come.

    Of course, finding the right tool for the job may mean another tool is better suited to your unique needs.. E.g pmWiki works for me now, since I don't want to pay for hosting and mess with databases.

    All the difference is between KNOWING what's best and LIVING it.

    Most people have heard some words of wisdom, but the wise take it to their heart and out into the world. They are delighted to give and receieve more wisdom, and the beauty only increases even when it's heard before.

    What is being said is not so important as WHO is saying it. Words become empty when they just remain words, and do not sprout into action.

    Depression is not living true values and becoming dull. The best remedy is to take action, do all you can, taking care of others instead of constantly thinking about oneself.

    It depends what you do on the net, and if it really makes you happy.

    And it depends what kind of life you have outside the net, and if that world makes you happy.

    For example when I join an Art of Living course for a week or two, I come back invigorated and ready to rock the world. I'd just had an extraordinary time without any computers!

    Then I sit down in front of a computer, and all that energy is drained into silly bugs, and a dozens things I have to repair and fix in order to remain sane.

    I can imagine if I didn't have something really worthwhile outside the net, like Art of Living, I would miss the online world, just because it's an easy way to hide from it. Obnoxious commercials all over the place doesn't help either, but a walk in the forest and mountains works wonders :-)

    Sure, two countries are ahead of the pack, Sweden and South Korea, but how many others? Norway for instance is still in the gutter with ISDN and losy ADSL speeds unless you pay bussiness prices.

    But what I read out of this is:

    Hey, "everybody" else have much better broadband access than WE do!

    It's not "everybody" else. Just a few countries that have subsidized this via taxes. I just can't understand a mindset where you have to be First and Best in Everything, or else your ego is crushed. But maybe you like it that way.. *shrug* It seems like a lot of agony and stress to me..

    Btw, I have Bredbandsbolaget in Norway. It helps to check a little before moving ;-)

    Do you think it was fear that made Nelson Mandela handle the situation like he did? He could easily be murdered by some blacks who REALLY wanted revenge, just like he could have been executed or whatnot in many situations.

    Don't glorify fear. Fear makes people make BAD decisions. They tend to panic and lose perspective. Fear has nothing to do with this, although a little fear is always good for staying alive.

    It's about seeing how small we really are. What does one life matter, my life? I can go without a new DVD-player, if it could help the situation. When you recognize how little you are, demands starts to dwindle and you can relax and enjoy life on a completely different scale. Even when everything is dark and black, you know, that all is transitory, things will change. It always does. Even when you're depressed, there's a spark inside you that knows it's just your way of expressing yourself right now, that it'll change like everything in this world.

    When you start to recognize these things, you can start making DECISIONS and ACTIONS, and not RE-ACT your old behaviour patterns all the time. You become aware of more and more how the mind plays tricks on you. You stop identifying with personality traits and expand your vision of being larger than petty small things in a small life.

    A mature sould like Mandela knows all this, and lives by it, putting down/accepting his fears. For that he and his likes should be respected and emulated. It's not like it's anything extraordinary: Every human being possess the potential of something "extraordinary", if we just start LIVING the knowledge, the extraordinary becomes ordinary. Life becomes extraordinary! Why do people want ordinary lives? Well, they get what they want, always!

    So while a little fear may be good for survival, carrying out a peaceplan like this require a mind transcendent of fear and courage. It just knows what is the RIGHT THING to do, and is very careful about stepping on others' Right Thing to maintain harmony..

    It's good scientists and general people are focusing more on emotions and thoughts these days. But forgive me for saying this, but these people haven't got a clue about the powers of the mind.

    Science would like us to believe that we are like machines. If X happens, then we feel Y, etc. Just like a nice automaton.

    But personal experience tells me, maybe I'm wrong, I'm just suggesting this for now, that we DECIDE how to feel every moment! We may not be aware of it on a daily conscious-level however, and then we fall victim to circumstances and events. (Note: I'm not discussing the scientists PERSONAL beliefs here, they MIGHT have a clue, and want to steer the boat on the right course.. I just feel it's going a little slow, and want to contribute my share..)

    So these experiments tells us what is commonly happening when people experience an event they recognize as "sweet revenge".

    But if these people were aware of how little they actually are, especially when doing this, when they need "revenge" for some arbitrary small thing that happened to them in the past, I doubt they would feel that sweetness. They would feel small and stupid, because of their AWARENESS of the fact.

    So being AWARE, you can transform a petty little "sweetness" feeling, into... well, anything you like, I suggest, again I might be wrong. In my experience, when you get above/below/inside the world and how it works, you feel natually BLISSFUL. What's the point in all this, when you can just laugh at all the foolishness and say SXBLXyNGZ? Or something similarly silly? ;-)

    But it's not silly. A state that is independent of any external event. It's a natural state, it's just that we're so used to the idea that we should do this work and that thing, earn a little more, so that we can buy that or get laid with this chick, so that we'll definately, absolutely positively, become happy, in the future, maybe, if it all works out the way WE WANT IT TO...

    Desires.. Funny how the world works, or seems to work anyways. We spend most of our lives waiting for happiness in the future, missing out all the opportunities that are POURED DOWN on our "daily lives". It's amazing really, when you start to take notice, things start happening more and more.

    Unless they go through every page on the SCO-site manually, they probably got it from some news-source. I wouldn't be surprised if searching through /. is actually becoming standard practice for lawyers to get ideas about their angle of attack/defence on technical issues.

    Don't underestimate the value of opinions from thousands of people across the globe.. It's unprecedented in our history. IBM certainly knows the open source community well enough to warrant that a substantial portion of their employees reads /. and similar sources.
