    This is no different than a "tax break" for mortgage interest, or any other similar tax break, which is just a tax raise for the rest of us (i.e. people who rent their homes and therefore don't get the mortgage interest deduction) If the government can raise your taxes for not having a mortgage, it follows it can raise your taxes for not having health insurance. The Supreme Court decision is logical given prior precedent.

    Actually, a lot of anime fans assume that the fansub translators know what they are doing but have no way of evaluating the quality of the translations. The nonprofessional fansub translator will get the benefit of the doubt over a working professional simply because they'll leave terms untranslated or avoid using slang. Some fan translations are horribly amateurish, but the fans will assume they are better than the professional version.

    OZ experts disagree with this theory, pointing to the fact that there was no contemporary discussion of any sort of political interpretation when the book came out, Baum himself denied any political intention with the piece, and other case by case facts, such as the fact that there really were yellow brick roads in America at the time he wrote the books, he didn't have to be using yellow bricks to symbolize anything.

    I don't think the fair use defense is going to hold water. The situations in which you can claim fair use are pretty slim; a for-profit service, who is obviously deriving some economic benefit by using somebody else's copyrighted paper (by adding it to their database) is probably not going to qualify. I'm not sure what harm the students can claim, but if they have any decent lawyers at all, they'll find some way of doing it."

    I love that this is rated 5- insightful, as we just did a problem VERY similar in my law school copyright class on this very day, and my copyright professor certainly didn't say anything like the above, which seems to be uninformed at best.

    There are four criteria to determine fair use in the copyright statute section 107:

    1) the purpose and character of use, including whether its commercial.

    2) the nature of the copyrighted work

    3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole

    and

    4) the effect of the use on the potential market of the copyrighted work.

    Its a balancing test, the court thinks about it and makes up an answer. Everyone's free to speculate how these four tiers will weigh, but its clearly not an open and shut case. Economic benefit is not that important, only a factor, considering the purpose and character is to prevent plagiarism, which can be seen as a legitimate purpose.

    I lot of observers have commented recently that Sony is bad with software. Even their CEO has acknowledged this. They were able to get by in the last two generations, because their hardware was appealing enough compared to other consoles that developers flocked to their system, but now, with some very competitive hardware from Nintendo and Microsoft, they're in trouble. Sony's software deficiencies lost them the portable music market, and they're in danger of losing the console market as well. It doesn't help that they don't get that the fancies, most expensive hardware is not really all that important to the success of a system.

    I find this hard to believe. You can't patent things that were publicly known at the time of the invention, and even if you got the patent, it would be unenforceable. Maybe those Indians just needed a good lawyer. Maybe they couldn't afford one.

    The command bar is a major waste of real estate, and less useful than the menu bar. Is there no way to remove it??? It's probably a deal breaker for me.
