    Yes. For a company that was really badly managed I have seen off-shoring chunks of work to India work. Basically because the Indian project management was better than the American project management.

    1) The government does not bother to enforce this law.
    2) The law says you can not sue unless you are personally affected.

    Exactly. Most developers are incapable of producing code that anyone would ever want to use.

    In multiple companies for which I have worked, it was known who was capable of producing code that could actually be shipped and who could not. Management highly valued those who were capable of producing shippable problem free code.

    The basic problem is developers are incapable and do not want to produce software that actually works and expect "lower level" people to fix their work.

    Virtually no computer than came installed with Windows XP can be upgraded to Windows 8 because Windows 8 has additional hardware requirements.

    We have managed to survive many many years without doing much in the way of protection. Why do you have a belief that the future will be any different from the past?

    When applying to another company they ask if you are subject to a non-compete agreement. If you answer "yes" you are less likely to be hired.

    They don't have to hire a detective to find out where you work... they just need to check linkedin.

    Very few computers running Windows XP can be upgraded to Windows 8.1 because of the additional requirements for the OS.

    In California employers can fire people because "didn't wanted them around". They just can't fire an employee solely because he is a member of the Nazi party.

    I have a perfectly functional laptop that is running Windows XP. The reason I haven't upgraded is that Windows 7 will not run on it. I am not interested in Windows Vista or Windows 8.

    And, it isn't 13 years old. Vista was available when I purchased the laptop, but I preferred Windows XP.
