I heard about that case, but I don't recall it saying anything about GPL being a contract, valid or otherwise.
In fact, now that I Google it, it doesn't appear the judge issued any ruling on the validity of the GPL, although she regarded it as a valid license during the trial.

P.S.=> CA also listed a freeware of mine as a "malware", falsely since it passed ALL 21 of their REMOVAL QUESTIONS no less!
They did not remove it, & other sites used as a "source" (like the faulty IKARUS database)!
The program was written in GOOD FAITH by myself, to help out a fellow forums person I knew at NTCompatible years ago, because he had an OLD version of Apache server on Windows which would not run as a tooltray icon while minimized & it was not implemented as a service he told me (that was so it was not visible onscreen and ran "in the background transparently" which most webservers now, do).
So, in good faith/being a "good neighbor", I wrote it up for he (it's NOT commandline argv/argc parameterizeable either, so it's NOT scriptable) in GUI form (only 2-3 lines of code & works via C/C++ type invisible "spawn" type parameterizations).
Next thing I know? It's out online being classed as a "malware" (1 of around 40 freeware apps I've done over time that did VERY well & were featured in respected publications in good reviews in reputable & respected publications like "Windows IT Pro" Magazine (it was Windows NT Mag back then in the 1990's - early 21st century) & others of like ilk).
Heck - it's NOT EVEN SCRIPTABLE for attack purposes! I saw that much, coming ahead of time.

I did that on the advice of an attorney (John Lowe of Hiscock & Barclay).
Afterwards when I told the attorney these results, he told me "Yes, you have a WINNING CASE for libel/defamation of character" etc. "and it's worth approx. $150,000 U.S. Dollars"!
So, to that, I said:
"Well, let's do it then on a 33.3% of the take for you as payment" (keeps attorneys 'motivated' doing it that way, plus, it's no init. money down for retainers etc./et al).

It's not a trade war disguised as national security, it's national security disguised as a trade war. There's been no evidence presented of any backdoors. Thor Schrock? Note he wouldn't answer when I asked him a couple simple questions (on HOSTS files + Spybot Search & Destroy or PING )?? Here is why in detail:
Fact is, according to CA (computer associates)- both can be classified as malwares because of Computer Associates tests criteria! For things ping can/could do "ping of death" &/or Spybot altering a HOSTS file.
Which Schrock posted to CA, AND USING MY MIDDLE NAME and LAST NAME ONLY (so I would not find it when searching my apps online when I was an avid freeware/shareware author as a student circa 1995-2002).
In the end?
Much went MY way, check it:
CA had to DOWNGRADE a single app of mine,to ZERO THREAT LEVELS, because I passed all 21 of their questions for malware testing (upon writing they on it).
Thor Schrock was made out as a FOOL to CA too, & that's why he posts that blog when I asked he remove it.
My app's NOT SCRIPTABLE: This is why Dr. Mark Russinovich of Microsoft has hassles this way @ times: He put in argc/argv commandlines into his app... I foresaw this & didn't in the app in question! It's never been used in an attack either...

(He was decent enough to thank me in email for my helping he by pointing out a VERY ROOKIE mistake in his hardcodes in it, how to fix them via the NT Native API too, & why (he overlooked things is why, good as he is at coding).
In fact, his pstools suite?

Thor SCHMUCK went 'silent' after that (which also shows he is NO "expert" by any stretch of the imagination).
Apps that can be used "both ways" get 'victimized' this way (which is like PING via "ping of death", or tools from NIRSOFT (good stuff) &/or SysInternals even (yes, even Dr. Mark Russinovich has had this happen to he (e.g. pstools) as it has myself & Nir Sofer of NIRSOFT) have tools that can be used "for the good" or "the bad", depending on WHO is using them & what they're up to (like a gun, guns don't murder people - other people do).
So, then I took CA's 21 point removal test & passed EVERY SINGLE QUESTION without fail no less, & they would not remove it (but, they had to put it down to "Zero Threat Levels")... I did that on the advice of an attorney (John Lowe of Hiscock & Barclay).
Afterwards when I told the attorney these results, he told me "Yes, you have a WINNING CASE for libel/defamation of character" etc. "and it'

Then, he replied "I can't do this case!" I was like "WHY?!?" & he said "Because larger companies have fleets of attorneys that will 'drag it out' for over a decade and by the time you collect, which you would? The overall COST of doing this would exceed your reward!"...
This is how the REAL world works, if you're not a "Financial Goliath" in other words - there is NO "justice", only money (and if you've got enough to take on the likes of these companies, then, & ONLY THEN, do you get real justice)... makes me ill, because the likes of CA know this, & abuse it! apk

What gives these bloody do-gooders the authority to "take over" other people's servers? Why couldn't this be an excuse for all sorts of network intrusions? "Oh, I thought this server was hosting malware or controlling a botnet, so I took it over with altruistic intentions". From the story a few days ago, MS went to court in order to get Waledac shut down. Seems like things could get tricky with jurisdictional issues as well. Maybe the U.S. government should issue some letters of marque so that private citizens could "attack" foreign malware servers?

I seriously doubt microsoft was involved in the development of tradelect. marketing in collaboration with accenture yes.

That's £40m over a short 2 years of service - work out the TCO on the depreciation cost alone! So, yes, I do think Microsoft has a lot to answer for because they were engaged at the highest levels. Also, Accenture have a lot to answer for. As soon as I saw "India", well, I'm sorry, but it's rare for an offshore project to meet requirements - in the same way that a project for Bank of India outsourced to the UK would probably fail.
It's worth a look at the Chi-X platform sales brochure (it's PPT, how ironic) which is a direct competitor to LSE and uses Linux successfully. Chi-X has about 15% or so of UK FTSE 100 trades. The amazing feature of CHi-X is its low latency - especially in trading where 20 ms is a very long time and can cost principals serious money. -
