Clinton Grants $1 Million To Edible Insect Farmers
An anonymous reader writes "Former US President Bill Clinton, through the Clinton Global Initiative, has awarded $1 million to a group of Canadian MBA students who are looking to solve urban hunger by feeding people insects. The students will use this as seed money for their start-up, Aspire Food Group, which aims to farm, produce, and sell edible insects as a way of solving world hunger, particularly in slums. Aspire says it will even work toward replacing livestock farms with insect farms in some areas." Insects as food aren't necessarily incompatible with conventional livestock, either. -
Car Dealers Complain To DMV About Tesla's Website
cartechboy writes "State and national car dealer groups have been battling Tesla Motors for years, trying to stop them from selling its electric cars directly to buyers. Most of the time, the dealers work behind the scenes to change state laws and and force Tesla to conduct its sales through 'independently-owned third parties' which are... well, car dealers. But in California, Tesla's operations are legal, so that tactic won't work. So dealers there are taking an interesting new tack — complaining to the DMV about Tesla's website." -
Brooklyn Yogurt Shop Sting Snares Fake Reviewers For NY Attorney General
Hugh Pickens DOT Com writes "Reuters reports that nineteen companies caught writing fake reviews on websites such as Yelp, Google Local and CitySearch have been snared in a year-long sting operation by the New York Attorney General and will pay $350,000 in penalties. The Attorney General's office set up a fake yogurt shop in Brooklyn, New York, and sought help from firms that specialize in boosting online search results to combat negative reviews. Search optimization companies offered to post fake reviews of the yogurt shop, created online profiles, and paid as little as $1 per review to freelance writers in the Philippines, Bangladesh and Eastern Europe. To avoid detection the companies used 'advanced IP spoofing techniques' to hide their true identities. 'This investigation into large-scale, intentional deceit across the Internet tells us that we should approach online reviews with caution,' said Attorney General Eric Schneiderman. 'More than 100 million visitors come to Yelp each month, making it critical that Yelp protect the integrity of its content,' said Aaron Schur, Yelp's Senior Litigation Counsel." -
Extreme Microbe Brewing: the Curse of Auto-Brewery Syndrome

It's called gut fermentation syndrome or auto-brewery syndrome, and it's 'a relatively unknown phenomenon in Western medicine' according to a study published in July's International Journal of Clinical Medicine. 'Only a few cases have been reported in the last three decades' according to Dr. Barbara Cordell, the dean of nursing at Panola College in Carthage, Texas, and Dr. Justin McCarthy, a Lubbock gastroenterologist, the study's authors." China Allows Most Online Criticism But Cracks Down On Mobilization and Gossip
hackingbear writes "Harvard sociologist Gary King has just completed two studies that peer into the Chinese censorship machine — including a field experiment within China that was conducted with extraordinary secrecy. Together, the studies refute popular intuitions about what Chinese censors are after. He found that the censors actually permit 'vitriolic criticism' of China's leaders and governmental policies but the censors crack down heavily on any move to get people physically mobilized to act on such criticism. In a related development, China's top court issued a ruling on Monday to threaten a 3-year sentence for people posting online rumors viewed by 5,000 internet users or reposted more than 500 times. Though, in the same ruling, the court also clarified that a person reposting false rumor should not be punished if he or she does not clearly know the information is false, even if real harm is done. " -

The Internet Association, National Restaurant Association, National Retail Federation and Food Marketing Institute Patent trolls — a term known more among geeks than the general public — are about to be the target of a national ad campaign. Beginning Friday, a group of retail trade organizations is launching a radio and print campaign in 17 states. They want to raise awareness of a problem they say is draining resources from business and raising prices for consumers." -
Is Europe's Recession Really Over?

They're all based on the news that Eurostat, the keeper of economic statistics for the European Union, says GDP grew 0.3 percent within the EU's borders from the end of March through June. As Olli Rehn, Eurostat's vice president, writes on his blog: 'I hope there will be no premature, self-congratulatory statements suggesting "the crisis is over."' He calls the GDP report only another sign of 'a potential turning point in the EU economy.' The quick conclusion by some economists and some in the news media that a slight rise in one quarter's GDP means a recession is over ignores how experts figure out when an economy is either in a significant downturn (a recession) or enjoying steady growth (an expansion)." -

Neurologists Shine Light On Near-Death Experiences

However, survivors regularly report having powerful experiences when they come close to dying, often saying they had an overwhelming feeling of peace and serenity. Frequently they describe being in a dark tunnel with a bright light at the end, and many report meeting long-lost loved ones. 'Many of them think it's evidence they actually went to heaven — perhaps even spoke with God,' says Jimo Borjigin. Now scientists at the University of Michigan have found that the brain keeps on working for up to 30 seconds after blood flow stops, possibly providing a scientific explanation for the vivid near-death experiences that some people report after surviving a heart attack. In the study, lab rats were anesthetized, then subjected to induced cardiac arrest as part of the experiment while researchers analyzed changes in power density, coherence, directed connectivity, and cross-frequency coupling. In the first 30 seconds after their hearts were stopped, they all showed a surge of brain activity, observed in electroencephalograms (EEGs) that indicated highly aroused mental states. 'We were surprised by the high levels of activity,' says George Mashour. 'In fact, at near-death, many known electrical signatures of consciousness exceeded levels found in the waking state, suggesting that the brain is capable of well-organized electrical activity during the early stage of clinical death.' Borjigan thinks the phenomenon is really just the brain going on hyperalert to survive while at the same time trying to make sense of all those neurons firing and it's like a more intense version of dreaming. 'The near-death experience is perhaps really the byproduct of the brain's attempt to save itself,' says Borjigan" While interesting, it's important to remind ourselves that this research is not conclusive: "Borjigin and Mashour hesitate to state a direct connection between their findings and near-death experiences. The links are merely speculative at this point and provide a framework for a human study, Borjigin said." -

New Android Eyewear Wants To Compete With Google Glass
DeviceGuru writes with this excerpt from LinuxGizmos: "GlassUp, an Italian startup, has started taking pre-orders on Indiegogo for an Android eyewear display system billed as a simpler, lower-cost alternative to Google Glass. The GlassUp device is a receive-only Bluetooth accessory to a nearby mobile device, providing a monochrome, 320 x 240-pixel augmented reality display of incoming messages and notifications. GlassUp was unveiled at CeBit in March, and is now up for crowdfunding on Indiegogo, where pre-sales opened today ranging from $199 to $399, depending on whether it's a pre-release, pre-production, or full-production version. This is less than a quarter the price of the $1,500 Google Glass Developer Edition. Already almost two years in development, GlassUp is expected to ship to presales customers in Feb. 2014, around the same time Google Glass is expected to ship in commercial production form." And for Google Glass itself, there's at least one project to bring Google's own hardware an alternative operating system. -
US Director of National Intelligence Admits He Was Wrong About Data Collection
Gunkerty Jeb writes "In a highly unusual move, James Clapper, the director of national intelligence, said Tuesday that he misspoke when he told a Congressional committee in March that the National Security Agency does not collect data on millions of Americans. Clapper said at the time that the agency does not do so 'wittingly,' but in a letter to the chair of the Senate Select Committee on Intelligence, Clapper admitted this statement was 'erroneous.' Clapper, the top U.S. intelligence official, has been quite vocal in his defense of the NSA's now-public surveillance programs such as PRISM and the metadata collection program. In statements published shortly after the leak of classified documents by Edward Snowden about those collection efforts Clapper said that they both have been repeatedly authorized by Congress and the executive and judicial branches over the years." -
Florida Keys Prepare For Sea Level Rise
An Associated Press report details how the Florida Keys are starting to prepare for seasonal flooding and rising water levels overall. "A tidal gauge operating since before the Civil War has documented a sea level rise of 9 inches in the last century, and officials expect that to double over the next 50 years." Flooding used to be a much rarer occurrence, but now many businesses are finding it necessary to have plans in place to deal with it. "The Keys and three South Florida counties agreed in 2010 to collaborate on a regional plan to adapt to climate change. The first action plan developed under that agreement was published in October and calls for revamped planning policies, more public transportation options, stopping seawater from flowing into freshwater supplies and managing the region's unique ecosystems so that they can adapt, too." The Keys are one of many places beginning to seriously evaluate their options for dealing with flooding after witnessing the damage caused by Hurricane Sandy. -
TN Man Indicted For Romney Blackmail Attempt: Wanted $1M In Bitcoins
OakDragon writes "A Franklin, Tennessee man has been indicted for his attempt to blackmail Mitt Romney. Michael Mancil Brown allegedly claimed his intent to release some of Romney's pre-2010 tax documents unless one million dollars was converted to Bitcoins and deposited into an account which he specified. Demand letters were sent to Republican and Democratic Party offices in Tennessee, and Pricewaterhouse Coopers (whom he claimed to have stolen the documents from). Pricewaterhouse Coopers denies that he ever obtained such documents. Brown was also attempting to "sell" the documents to others (presumably the Democrats or other interested parties) for the same amount. And yes, he was apparently well aware of the Dr. Evil reference." -
Was That A Tsunami?
Rebecka Schumann writes "The East Coast was hit by a tsunami earlier this month, but apparently, no one was the wiser. According to the National Oceanic and Atmospheric Administration a rare six-foot wave collided with the region in early June, a phenomenon currently under review. The wave is being considered 'complex' and is believed to have been caused 'the slumping at the continental shelf east of New Jersey' or a strong storm according to the West Coast and Alaska Tsunami Warning Center. While speculation regarding the mystery tsunami is rampant, another individual is claiming the surge could possibly be a 'meteotsunami,' meaning it was not caused by seismic activity but merely a change in meteorological conditions. Paul Whitmore, an NOAA tsunami center director, said a weather system's ability to change air pressure is enough to 'generate waves that act just like tsunamis.' The alleged tsunami caused three divers to be swept off rocks, two reportedly requiring medical attention after suffering from non life-threatening injuries due the storm. A few weeks ago you had the chance to ask James Logan, the founder of Personal Audio, about the business, the patents the company holds, and the lawsuits it has filed. James answered most of the questions in great detail. Read below to see what he has to say and what question he passed on and why. Why are you doing this interview?

I am curious why you would volunteer to step into the lion's den.
Logan: There is an active debate going on now about whether the patent system should be changed again while we are still adapting to the American Invents Act of 2011, the largest patent reform since the 1950’s. We have strong views on this and want to weigh in on the debate.
Yes, we understand the leanings of Slashdot readers but sometimes going into the “lion’s den” is the best way to get your point across. That’s probably why you see James Carville on Fox News from time to time.
There are some legal risks to us wading into the den, however. Lawyers may try to take things we say and use them against us. You know how that goes. So, we apologize in advance if some of our answers have to be circumspect.
What do you do?

What exactly is Personal Audio? Your website is slashdotted, so I can't find what you make or what your business model is. But you claim not to be a patent troll. You're even willing to come to a hive of kneejerking anti-patent-trolls and answer our questions to try and convince us of this. So, if you're not one, why not? What do you make? What do you sell? What do you do?
Logan: Personal Audio, LLC is a holding company. That is, we own property and our main activities relate to earning a return on that property. Now, it just so happens that our property consists of patents—not real estate, artwork, or copyrights—and that has apparently put us on the wrong side of the patent debate in the eyes of some people (see Lion’s Den above).
The term “patent troll” has emerged in recent years, and to the extent that words matter, this phrase has served as an effective piece of negative branding for those who want to reduce the rights of patent holders. But the debate should go beyond catchy name-calling. Whether we are, or aren’t patent trolls, whatever that term means, isn’t the issue. The issues are what purpose do patents serve and how do we best foster innovation? Which brings us to the next question
To promote the Progress of Science and useful Arts

The intent of patent and copyright laws is "to promote the Progress of Science and useful Arts". Certainly back in the 18th century when the Constitution was written access to information, resources, and research specialists was limited and costly. Now in the 21st century, with global economics focused on knowledge and service sectors, these assets are extremely abundant. Would the progress of Science and the Arts be better served by eliminating legal barriers to innovation, such as patents, and letting the market decide which unencumbered producers survive? If not, why not?
Logan: Nick, thanks for this question. Yes, patent rights are laid out in the Constitution and perhaps a few words about history here would be of interest. The U.S. patent system was derived from the earlier, successful English system. According to a recent book by Willliam Rosen,
“It was England's development of the patent system that was the decisive factor (in giving England the dominate role in the Industrial Revolution). By aligning the incentives of private individuals with those of society, it transformed invention from a hobby pursued by the idle rich into an opportunity for spectacular commercial gain open to anyone with a bit of skill and a good idea. That allowed England to harness the creative potential of its artisan classes in a way that no other country had managed before.”
But the English patent system was a rich man’s game and it was expensive to get a patent. It did lead to the successful development of many “heavy industry” inventions (think steam engines and railroads) but not a lot of “micro-inventing”. When Nikola Tesla (the greatest geek who ever lived) came to America later in the 1800’s, he marveled at the innumerable ways that inventive Americans had improved, and patented, everything they could lay their hands on.
You suggest that today, with globalization and an economy focused on knowledge and services, we might be better off without patents. That a world without patents would foster innovation. This really is the most fundamental question of the whole debate.
I think the suggestion is wrong. Patents are even more important in today’s information economy then they were in past centuries. To see why, let’s broaden the debate to include all intellectual property (“IP”).
If there were no copyright laws, do you think AMC would spend $3 million on each episode of Breaking Bad? If anybody could just copy it and give the content away on the Internet why would they? Without copyright laws there would be no Mad Men, New York Times, or Call of Duty.
(Of course, the irony of comparing patent rights to copyrights isn’t lost on us. We’ve come under blistering attack from the media, including NPR, for asserting our patents against some rather large media businesses—companies that wouldn’t blanch at suing teenagers who copy their songs, websites that offer free movie downloads, or even Google who might offer too-detailed of an article summary. And of course, we all have to sit through their FBI warnings at the beginning of a DVD.)
These same copyright arguments apply to hard goods, and by extension to patents. Would Cisco be able to afford its R&D if factories in China could copy its products and sell them here for a fraction of Cisco’s price? Would Microsoft be spending millions on Windows 8 if each update could be freely copied and distributed? Would GE spend money designing wind turbines if others could copy the designs at will?
Would innovation happen without patents? Of course, just not as much. The risk involved in R&D would increase, investors would be less interested, and researchers tired of being “ripped off” would do other things. The pace of progress would slow. As the economy shifts more and more to knowledge-based work, it seems clear to me, that we need even stronger IP protections.
Do you deserve a patent without doing the work?

Why do you believe you deserve any money in licensing fees at all, when you haven't apparently done any of the work required to produce a product?
Logan: Well, I could answer this question by arguing that I did try to build a product. That I spent $1.6 million of my own money trying to realize our vision of a custom listening experience that ended up, at the end of the day, being implemented in the form of a cassette tape product, and not the digital player system we envisioned and patented.
But I think that story is beside the point. The question is whether we should have a patent system that requires the inventor to build a product in order to receive a patent. I think that’s exactly what we don’t want and by way of example let me explain why.
I started my first company in the 80’s, when I was working with a young MIT engineer, Blair Evans, to develop the first analog capacitive touch screen. Were we struggling to make it work when we got a letter in the mail from an inventor in Maryland, Bill Pepper, who was literally working out of his garage. He had been working with Bob Moog, inventor of the world’s first electronic synthesizer, on a touch sensitive piano and from that research had gotten several patents on a touch tablets.
Bill had tried unsuccessfully to license these patents to several large companies (“Call me back when there’s a market”, they said) when he heard about our attempts to make a capacitive touch screen. We realized Bill had the solution we were looking for and we promptly signed an exclusive license for his patents. MicroTouch went on to become the world’s largest touch screen company, selling the precursor to today’s projected capacitive touch screen found on all smart phones. When I left MicroTouch to start Personal Audio in 1996, we employed 500 people making touch screens in Massachusetts. Without those patents, we would never have gotten the company off the ground.
The point of the story, besides the fact that patents can play a leading role in driving innovation, is that often the inventor and the implementer are, and should be, two different people or companies. Bill had no desire to build or run a company. He retired off our royalties and went on to invent other things. Blair and I went on to build a company and an industry.
Why would you want a system that mandated such “vertical integration”, where the inventor has to be the producer? A recent paper (pdf) published by Yale looks at the history of patent monetization over the last 200 years. It describes how “the ability to quickly find buyers for patents was an important driver of inventive activity during the late nineteenth and early twentieth centuries, when patenting rates in the United States were at historic highs.” In fact, both Edison and Tesla sold off most of their patent rights. The paper goes on to say that 24% of hi-tech patents were sold off in the twenty-year period leading to 2000.
The whole history of tech over recent decades has been an ever-increasing specialization of labor. In 1980 IBM made everything from chips to software to mainframes. We all know how that evolved—Intel, Microsoft, Adobe, and others came in and took a slice out of that stack, each becoming a master specialist in one function.
The horizontal slicing of technology food chain has continued and has worked its way to intellectual property to an extent. Today you have Cisco, Yahoo, Google and others buying small companies, for their engineers, products, customer bases, and sometimes intellectual property.
There is still work to do, however, in developing more of an actual “IP market”—one where ideas and inventions are sold outright and not necessarily encapsulated in products or services. It’s a hard market to develop because each patent is, by definition, different and speaks to something new and unknown. If commodities are the easiest things to buy and sell, patents and intellectual property are the hardest. In addition, many companies have strong “not invented here cultures” that build barriers to buying-in technology.
But do you think the large tech companies that rail against “patent trolls” would really want rules that required a product to be produced before a patent was granted? After all, these companies get patents all the time for things they only invent on paper.
Even if you had such a requirement, how would you manage it? Would you have to just “produce” a product or would you have to sell it, too? Google dabbles in lots of areas and works on lots of long-range projects. Are you going to tell Larry Paige that if he doesn’t sell a driver-less car within five years those patents expire? Or if he doesn’t ship or offer for sale at least one, 10, or 100 such cars a year his patents expire? Does each car have to use every claimed feature? Does it have to work (well)? Can it be sold at any price? Who would decide all that?
If there were a requirement that only producers could own patents, then Personal Audio would probably start a podcast just to meet the requirement. But then you’d say, “That doesn’t count. You need to have 1% of the market to qualify.” Or maybe it’s 5% (so one doesn’t get patent protection until one succeeds?) Or do you want us to sell ourselves to CBS thus ensuring a system where only large companies have valuable patents?
Even if you don’t agree with my view that the world would be better off if inventors and implementers were sometimes different people, you can see that setting up a system to mandate otherwise would be a nightmare of micro-management with no obvious benefit. Except, I suppose, that there would never be a case where somebody would say, “He or she doesn’t deserve a reward just for inventing something”.
The debate of whether it was necessary to produce a product to get a patent has been thrashed out in the past. The U.S. patent office used to require inventors to send models to Washington DC before a patent would be issued. But inventions were getting more complicated, took longer to implement, and were getting more abstract. So in 1880 the U.S. patent office dropped the “implementation” requirement.

Here's a "comment" from the Computer World story linked above: "'The company was able to hang on to several patents, however, and put them "in a drawer for 10 years," Baker added. "Is that a troll?"'
Yes it is. That is exactly the definition of a troll. They weren't able to make it work, had no impact on the industry, failed and no one has ever heard of them. But when someone more enterprising independently comes up with a similar idea, solves all the problems that Personal Audio couldn't solve, popularizes the concept, and makes it work, they somehow feel they are entitled to a piece of the action. Your thoughts?
Logan: AC, you summarize well points we have heard from others. Let me start off by saying that over 1,300 patents have cited the Personal Audio patent set (meaning these later patent applications referenced the Personal Audio patents as “prior art” to their applications). A lot of folks read our embodiment and probably some of what we taught in the patent did end up in other people’s products and implementation. That still doesn’t answer your question, however, as to whether we are “entitled to a piece of the action”, as you put it.
But our patents, like others, fall under a two-part incentive system. The first incentive gives the hope of a temporary monopoly to the entrepreneur. That hope fosters innovation by getting people to push the envelope and try new ideas, not just copy old ideas. The hope of creating a business protected by patents, like the one I had at MicroTouch, motivated me to create and move forward with Personal Audio.
The second incentive offered by patents, however, is to investors. During the life of Personal Audio, I invested $1.6 million, and lost it all. Personal Audio, LLC, the patent holding company, is the attempt by the investor, me, to get a return on that investment. When investors like me get our money back, plus some if we’re lucky, it means that startups are not as risky as they might otherwise be. To that extent, patents lower the “cost of capital” to startups, that is, make it easier in the long run for them to raise money. If you’ve shopped plans around to VCs, you will see that often they are very interested in the IP potential of the ideas being pursued. They are interested in both the monopoly power it might offer a startup as well as the safety net it provides in case things don’t go well.
So to answer your question, we are small players in a larger system, one set up to foster innovation by turning inventions into property. We are merely using our property as the system was designed. You may not like every outcome of this system, but in general it has served its purpose well over many years.
Why individuals?

Pursuing the end users of a product which infringes upon one's patent is practically unheard-of. Why have you done so?
Logan: We appreciate the gist of your question, Sockatune. Let me clarify by saying that we have not done anything to approach “end-users”, who technically would be listeners of podcasts or viewers of other episodic content. But you’re probably referring to podcasters or video producers themselves who are on the smaller side of things.
With that in mind, it is worth noting that the cost of negotiating and setting up a patent license is not trivial. As such, it does not make sense for us to deal with hobbyists, non-commercial ventures, and small entities. The economics of it would be prohibitive. As such, we will be focusing on the largest users of our technology and those that collect significant revenues from ads placed on their podcasts or episodic video content, or who gain commercial value from that content in other ways. Finding good information on this score can be challenging, however, so we can’t be certain that our efforts are always perfectly aligned with our strategy.
When did you first hear of podcasting?

When did you first hear of podcasting and why didn't you file your infringement suit immediately instead of waiting until many people were already using the technology?
Logan: We filed the ‘504 patent (U.S. Patent 8,112,504) in 2009, a short time after we filed suit against several infringers of the ‘076 patent (U.S. Patent 6,199,076). The patent then issued in early 2012. We have had a lot of questions concerning how we could have filed for a patent covering podcasting in 2009, years after the first podcasts started coming out, so let me briefly explain that.
Under certain circumstances, specifically when the patent office has not finished prosecuting a family of patents, the inventor is allowed to apply for additional claims that derive from the original invention by filing a “Continuation Patent”. The priority date, or date of invention, that is given by the patent office to this Continuation is the filing date given to the original patent application in the family. In our case, then, the priority date of the ‘504 patent is October of 1996—the date we filed our first patent application in which the material that describes podcasting was included.
Another misconception is that we “waited all those years” while podcasting evolved and then sprung the ‘504 patent on the industry. The fact of the matter is that Charlie Call, my co-inventor and patent attorney, and I were busy working on other things when podcasting as an industry was emerging. We didn’t get focused on the Personal Audio patents until 2008. That delay is unfortunate for Personal Audio because as a result the ‘504 Continuation Patent did not issue until 2012. As a result, we are only able to collect license fees from that date forward. All the activity that happened before the ‘504 issued is not covered

Can you explain, in terms I could tell the average person, how your patent is novel enough that anyone who wants to distribute audio over the internet should license it from you? I'd appreciate it if you could address how the distributions of podcasts today widely differs from downloading audio files in 1995 and how your patent help change this.
Logan: Trcooper, this is one of those of questions that could get me in a boatload of trouble—with my lawyer, that is. Any comments I make regarding the claims and how they are different from previous systems, can and will be used against me in court. So I’ll have to take a pass on this one.
Cassette Tapes

The only business you made with these patents was sending cassette tapes with some recorded articles that were chosen by the customer through the mail. How does this transfer to creating playlists and podcasting? Picking the listening order of sound files I got from the internet doesn't really seem like it should be protected intellectual property. How do you justify what you've done (a failed business in 1995) to justify payment (much much later) from people who had never heard of you or your patents when they made their services/products, and who apparently never tried to patent that process as it seemed too obvious to them?
Logan: CaseCrash, you touch on a few different areas with your questions, so let me tackle them one at a time.
First, the cassette tapes that Personal Audio sold in 1997 have nothing to do with the validity of the patents that were filed in 1996. Are you suggesting that if a company changes its business strategy, it has to abandon any claims to things it might have invented before the switch? Or if you go out of business you have to donate your patents to the public? If so, be sure to let the creditors of A123, the now-bankrupt pioneering battery company, know that their only remaining asset is now toast. Ditto for the Fisker car company. That all sounds a bit like the culture in Europe where entrepreneurs are severely punished for losing. I’m not sure that’s the startup culture we want to embrace here.
Secondly, you seem to be implying that Personal Audio’s patents should be invalidated for obviousness. Well, I’m not at liberty to discuss specifics around this issue in our case, but one of the main functions of the patent office is to screen for obviousness. Some large companies expended significant resources to prove Personal Audio’s patents were obvious but they were unsuccessful. In general, though, things often seem obvious in hindsight, particularly when the idea has been around a while. So we’re not surprised when people say that about our patents.
In addition to a jury trial, some of our patents have also been through more than one re-exam, an extensive process where the patent office prosecutes the patent all over again. While some consider these do-overs to be a quality control step, it can also be thought of as a form of double jeopardy, retrying a case over and over again. Re-exams create an aura of uncertainty over a patent, making it harder to license a technology and get it to market. Think how hard it would be to put up a building if mortgage holders kept coming out of the woodwork.
Ironically, there are now new laws before Congress to institute even more re-exam procedures. I think that is unfortunate. One of the better features of the America Invents Act of 2011 was to allow for an expedited patent process whereby you can get a patent in less than 12 months—a new speedway that is working as advertised. Now you can come up with an idea, get it patented in a matter of months, raise money on the IP, and be off to the races.
Other changes to the patent system are also being considered, including the SHIELD Act, which would force an NPE (a Non-Practicing Entity) to pay the other side’s legal bills if the NPE loses in court. It would be unfortunate (if not unconstitutional) if this passed. As this article in Forbes recently pointed out, NPEs serve a real purpose in offering inventors, investors in failed companies, universities, and even smaller operating companies a way to participate in the market for intellectual property.
While NPEs have been ceaselessly disparaged, one of the most common criticisms has been that they have been responsible for doubling the number of annual patent lawsuits. In their defense it should be said that two factors outside their control have accounted for most of that increase. First is that the America Invents Act mandated that any patent lawsuit can only have one defendant whereas previously a case might have had multiple. This has dramatically increased the nominal number of cases and skewed the data being hurled against NPEs.
Second, is that over recent years many companies have started using a tactic of preemptively suing a prospective licensor the minute they receive an offer to license a patent. This has led to a counter-strategy where many licensing companies decide to sue first then enter into licensing discussions later. This again, has greatly skewed the numbers.
In any case, the IP market today is dominated not by NPEs but by companies like Google, Apple, and other large firms who own tens of thousands of patents. They buy patents by the thousands, cross-license each other, and then go on to hoard their patents effectively shutting out others from the market. Talk about stifling innovation—try to go license a patent from Microsoft or Google.
And these same U.S. tech companies that rail against patent trolls have few qualms about taking ideas from others. They will buy competitors’ products, conduct teardowns to analyze components and features, and incorporate the best of what they find. Yet it rare that these companies check to see if the “borrowed” ideas are patented. If fact, ask anybody in Silicon Valley and they’ll tell you that engineers in many, if not most, R&D labs are specifically requested to refrain from looking at the patent database when designing products.
Finally, many of these firms are themselves now engaged in so-called trolling. They are spinning off unused patents and either selling them to NPEs (often hiding their ownership) or setting up their own patent assertion companies. In effect, they lobby for one thing, while doing that which they lobby against. And the hypocrisy doesn’t stop there. Look here, in fact, and you’ll see that Mark Cuban sponsored the EFF’s “Chair To Eliminate Stupid Patents” in the same year he went for a quick buck by buying 7% of VRingo, a public NPE that has famously sued Google.
But despite all the consternation about NPEs, and who is one and who isn’t, in general I feel the patent system is not broken. The ever-rising number of U.S. patents being filed, the explosion of incubators, and continued flow of venture capital into new enterprises points to vibrant culture of innovation in the country.
How can I license your podcasting patent?

Hi Jim, I am about to start a podcast of my own, and I want to make sure I do this in the right way. I looked on your website, but there is no information for how to license your podcasting patent. No online shopping option. No form to mail in. No price. In fact, in the This American Life episode, Richard Baker says "We have a price. We just don't want to make it public."
It seems that the only way to license with you, is to first launch my podcast and then settle with you once you threaten to sue me.
You argue that you are really just a legitimate business man and not a patent troll. But despite the ongoing growth of new podcasts, you have not made it possible for an aspiring podcaster to realize what their financial liability to you might be. This makes it very risky to decide to invest in a new podcast and growing the number of subscribers, since I could be sued out of existence if I succeed.
My question: If you are not a troll, why have you chosen only to sue and threaten, and never directly license to interested customers who are joining the growing podcasting industry?
Logan: David, we have no intention of making podcasting a risky endeavor for anybody. Our license is a modest one and reflects, we feel, the relative values of our intellectual property, the podcasters’ copyrights, and the marketing and other efforts that make a podcast succeed. Our licensees are our customers and we want them to succeed just like any business wants its customers to succeed.
We hope to publish our ‘504 license schedule in the coming weeks. If we do, that will give you a sense of the affordability of a license. In any case, if you think you will need a license please contact us and we would be glad to discuss the details.
The EFF

Claiming that the EFF is some sort of enforcer working for large companies to beat up small ones is an idea that can only have come from heavy use of hallucinogenic drugs. Which ones does your team take?
Logan:None of our team-members is on drugs as you suggest, and one of us has even sworn off caffeine. (Not sure how that works.)
Regarding the EFF, I think our point was just that with our limited resources, our primary focus is addressing the larger entities that are podcasting. To that extent, the EFF can be seen to be weighing in on the side of large media conglomerates such as CBS and NBC.
More generally, I think it’s a bit anomalous that patents often get such a bad rap by individuals, such as some engineers in Silicon Valley, or groups like the EFF, which purport to stand for David (vs Goliath). Patents are a great tool for the little guy. If you want to start a company, build it around some patented technology (like Google did). The patents, or even pending applications, will help you raise money, ward off competition, and give you a fighting chance. They’re the ultimate equalizer.

You don't seem to have any presence outside the US, despite apparently having invented podcasting. Why?
Logan: We don’t have any international patents and as such, don’t have any activities outside of the U.S., although we have licensees that are foreign companies.
Why don’t we have any international patents? The answer is that it is very expensive to apply for, and “prosecute” such applications, and the benefits can be scant. One of the beauties of the American patent system is that it provides reasonable protection to inventors, has modest costs associated with it, and the resulting patents cover a critical part of the international market. If a company can get coverage in the U.S. for its products, as we hoped to do when we filed in 1996, it gets a measure of worldwide protection. That is because it’s hard to compete in today’s global economy if you can’t sell in the U.S. This is one of the reasons that many European companies come to the U.S. first to file patents on their inventions—and often bring over their R&D work, too.
Today, patent rights are rapidly being eroded in the U.S. through recent court decisions, legislation, and new patent office regulations. Meanwhile, the Chinese are rapidly strengthening their patent system. Hopefully, we don’t find that in 10 years the tables are turned—that China has the biggest economy and has created an IP fortress, where they incubate and protect products that are then shipped to the U.S.
While we’re on the topic of protecting American intellectual property, let me also point you to a recent report stating that overseas intellectual property theft is a problem that costs the U.S. economy $300 billion a year, a number about 10 times larger than the damages recently ascribed to “trolls” by President Obama.

GMO Wheat Found Growing Wild In Oregon, Japan Suspends Import From U.S.
An anonymous reader writes "NPR reports that an Oregon wheat farmer found a patch of wheat growing where he did not plant. After RoundUp failed to kill the plants, he sent them to a lab for testing. Turns out the wheat in question is a GMO strain created by Monsanto but never sent to market. Oregon field trials for the wheat ended in 2001. 'Nobody knows how this wheat got to this farm. ... After all such trials, the genetically engineered crops are supposed to be completely removed. Also, nobody knows how widely this genetically engineered wheat has spread, and whether it's been in fields of wheat that were harvested for food.' The USDA is currently investigating and says there is no health-risk. Meanwhile, Monsanto has released a statement and Japan has suspended some wheat imports from the U.S. 'The mystery could have implications on wheat trade. Some Scientists Question Whether Quantum Computer Really Is Quantum

Why Trolls Win With Toxic Comments
Hugh Pickens writes "The Web is a place for unlimited exchange of ideas. But according to an NPR report, researchers have found that rude comments on articles can change the way we interpret the news. 'It's a little bit like the Wild West. The trolls are winning,' says Dominique Brossard, co-author of the study on the so-called 'Nasty Effect.' Researchers worked with a science writer to construct a balanced news story on the pros and cons of nanotechnology, a topic chosen so that readers would have to make sense of a complicated issue with low familiarity. They then asked 1,183 subjects to review the blog post from a Canadian newspaper that discussed the water contamination risks of nanosilver particles and the antibacterial benefits. Half saw the story with polite comments, and the other half saw rude comments, like: 'If you don't see the benefits of using nanotechnology in these products, you're an idiot.' People that were exposed to the polite comments didn't change their views really about the issue covering the story, while the people that did see the rude comments became polarized — they became more against the technology that was covered in the story. Brossard says we need to have an anchor to make sense of complicated issues. 'And it seems that rudeness and incivility is used as a mental shortcut to make sense of those complicated issues.' Brossard says there's no quick fix for this issue (PDF), and while she thinks it's important to foster conversation through comments sections, every media organization has to figure out where to draw the line when comments get out of control. 'It's possible that the social norms in this brave new domain will change once more — with users shunning meanspirited attacks from posters hiding behind pseudonyms and cultivating civil debate instead,' writes Brossard. 'Until then, beware the nasty effect.'" -
Orson Scott Card's Superman Story Shelved After Homophobia Controversy

Orson Scott Card, author of Ender's Game and its many sequels, was tapped to write a story for the new Adventures of Superman comic. The controversy arose because Card has become an outspoken opponent of gay marriage, going so far as to say giving it legal recognition could mark 'the end of democracy in America,' and suggesting 'traditional' married people will eventually have to overthrow the government. Many fans of the series objected, and some retailers decided they wouldn't stock the issue Card's story appears in. Now, the illustrator for Card's story, Chris Sprouse, has walked away from the project, saying he wasn't comfortable with the media surrounding the story. Because of that, Card's story is being replaced in the Adventures of Superman anthology. 'The news has inspired speculation about whether or not this could mean that DC will quietly kill off the controversial Card story entirely, with some suggesting that the story remaining un-illustrated gives the publisher an "out" to avoid any potential breach-of-contract legal response.' Personally, I'm not sure what to think about this. I enjoyed Ender's Game as a kid, and it tarnishes the experience a little to know that its authors can say such hateful things. On the other hand, Card seems to have kept his personal views out of his fiction, and it's unlikely DC would let him put those views into a Superman comic even if he wanted to. It's a free country; people are free to believe stupid things. On the third hand, he is actively advocating his views outside his fiction, and what better way is there for readers to fight back than organizing a boycott and voting with their wallets? Play Wii, Become a Better Surgeon

The study includes some interesting stats (e.g. while the control group showed a 10% improvement in accuracy, the Wii-playing group's accuracy improved by 83%). Twitter, American Express Letting People Purchase Goods Via Hashtag

American Express has announced a partnership with Twitter, giving customers the ability to sync "eligible cards" with the social network. Tweeting special product hashtags (i.e., #uselessjunk) will purchase a product via that synced card. American Express will then send a purchase-confirmation Tweet, and the usual shipping-and-handling of the product will commence. For Twitter, the partnership also holds significant advantages. If this initial foray succeeds, it could potentially evolve into a workable e-commerce model, and thus a separate stream of revenue for the social network aside from advertising. Also, research has shown that people tend to spend more money when using credit cards as opposed to cash. The Mathematics of the Lifespan of Species

Why "We The People" Should Use Random Sample Voting
Frequent contributor Bennett Haselton writes this week with his explanation of how an improved algorithm on the White House's petition-creation site could do away with Death Star petitions and even improve on the existing serious ones. Read on below for his modest proposal on that front.With a little boost from 4chan, a petition for the U.S. government to build a working Death Star has reached 30,000 signatures and counting, over on the White House's Department Of Let's See How Fast We Can Get 75,000 Signatures To Legalize Pot (or as it's officially known, "We The People"). This is the website where any of the member of the public can create a petition that other users can sign, and if the petition receives 25,000 signatures in 30 days, the White House will issue an official response. (Alan Boyle is taking suggestions on how the White House should respond to the Death Star request. How about: "4chan. You will never find a more wretched hive of scum and villainy.")
Cynics will say that the whole process was already a joke anyway. Even looking at the most popular non-Death-Star related petitions on We The People, most of them express standard left- or right-wing positions on hot-button topics in a manner that's extremely unlikely to convert anyone who doesn't already agree. Since everyone already knows that those some large segment of the population holds those positions, nobody would be surprised that any one of those petitions would be able to gather 25,000 signatures, and so there would be no pressure on the White House to change any of their official positions as a result.
On the other hand, I don't think this means that online petitioning can't work. Rather, I think a sligthly different algorithm could greatly improve the quality of the suggestions that get filtered to the top and trigger a response from the White House. At least one algorithm exists that (a) would prevent the system from being "gamed" by any large, organized group (whether 4chan or the NRA); and (b) would reward the petitions that were supported by the highest percentage of the general user population (or, if you prefer, the petitions that were supported by the highest percentage of credentialed experts in a given field).
The algorithm is the same one that I've advocated for preventing cheating on digg, or identifying the best "hidden gems" among newly released songs (and political arguments), or adjudicating Facebook abuse complaints -- have each petition voted on by a random subset of users registered on the We The People site. Based on this random sampling method, the petitions that have the highest percentage of "yes" votes, are assumed to be the ones with the broadest level of support among registered users, and the ones most deserving of a response from the White House.
Example: Suppose there are 250,000 registered users on the We The People site. A user creates a new petition, and somehow manages to pass some "threshold" that is implemented to screen out blatant time-wasters. (Perhaps you have to gain 100 signatures to pass the first threshold. I'd prefer it if you could clear the first hurdle just by paying $5 with a credit card, but this might anger purists who say that petitioning the government should always be free.) Your petition then gets emailed out to 100 randomly selected other users on the site, who vote to either Agree or Disagree. (In practice, in order to get 100 votes cast, you'd have to email more than 100 people, taking into account their response rate. So if only 50% of users respond to an email request for votes, email it to 200 randomly selected users to ensure you get about 100 votes cast.) Then petitions are sorted according to the percentage of users in their sample who voted to Agree. Petitions that got a high percentage of yes-votes, could be forwarded out to a wider audience (say, 1,000 users), to ensure that the initial high percentages of yes-votes wasn't just a fluke. Users in each random sample could also include comments about why they were voting a particular proposal up or down.
This sounds deceptively simple, but it makes it much harder for an organized online movement to hack the system. Say that 4chan manages to get 25,000 registered users in an attempt to push their favored petition to the top. This still means that, on average, their voters will comprise only about 10% of the randomly selected voters in any online poll - possibly enough to give an extra boost to a petition that already had broad support from regular users, but not enough to achieve a coup all by themselves.
Perhaps you'd object that even if such a system could not be manipulated by organized mobs, it would still leave the approval rating in the hands of non-expert ordinary citizens (even if citizens registered on We The People are slightly more informed than average). Whether you think this is a good thing, depends on whether you think the purpose of the site is to reflect the will of the people, or to provide informed advice to the President.
But if you want to get a random sampling of expert opinions, that's pretty easy as well. For petitions on, say, economic matters, just have a subset of users consisting of economics professors from accredited universities across the country. (These credentials would have to be confirmed manually by White House staff, but it's not that hard to verify that someone owns an .edu address and that their university webpage identifies them as an econ professor.) Then any petition on an economic matter could be submitted to a random sample of economics professors to be rated by them. If a petition gets a rating from economics experts that is wildly different from the rating it gets from the general user population, that suggests something interesting is going on (either econ professors are out of touch, or the general public is misinformed). But if a petition gets high levels of support from the public and the relevant expert group, that would seem to justify a response from the White House, much more so than some of the idiotic petitions currently pulling 65,000+ votes on We The People.
Something almost like this has actually been done by the IGM Economic Experts Panel in Chicago, which surveyed a group of 41 economists that the IGM believed to be among the best in the world, representative of the political left, right, and center. The survey found a high degree of consensus on questions that the general public is divided on, such as the fact that 40 out of 41 experts agreed with the statement:
All else equal, permanently raising the federal marginal tax rate on ordinary income by 1 percentage point for those in the top (i.e., currently 35%) tax bracket would increase federal tax revenue over the next 10 years.
To people who have heard celebrity conservative economists claiming that raising marginal tax rates lowers tax revenue, it might come as a surprise that virtually all expert economists in the IGM's sample, including a representative number of self-described conservatives, agreed that it does not. But don't just soak the rich and call it a day; most economists in the IGM's sample also disagreed that:
The cumulative budget shortfalls in the US over the next 10 years can be reduced by half (or more) purely by increasing the federal marginal tax rate on ordinary income for those in the top tax bracket.
Of course those were questions of fact (what economists call positive economics), while petitions address questions of what should be done (what economists call normative economics, and which varies according to your values and goals). But even economists with diverse political leanings often advocate similar policies; NPR interviewed 5 economists spanning the spectrum from left to right, and found across-the-board consensus in favor of 6 proposals, which you can read here. And hey, one of them is legalizing pot!
If We The People implements a system for polling a random sample of economics experts, I think their first order of business should be to have them rate the ideas in that 6-point platform. The five-person panel claimed that all of these ideas have broad support from economists across the political spectrum, but it would be good to know for sure. And for any of those six points that has broad consensus support from experts, it should be incumbent on the White House to declare whether they agree, and if not, why not.
More generally, random-sample voting will always reveal more useful information -- whether about the opinion of the public, or about the opinions of experts -- than a petition site that lets passionate users self-organize into signature mobs. As I've been saying ever since my first story advocating this algorithm, the only site I'm aware of that currently implements random-sample voting correctly, is HotOrNot, which shows users a random series of pictures and lets users rate the picture's hotness on a scale of 1 to 10. Can we not make at least that much effort to design a working system, when it comes to deciding which petitions get a response from the White House?

Why "We The People" Should Use Random Sample Voting
Frequent contributor Bennett Haselton writes this week with his explanation of how an improved algorithm on the White House's petition-creation site could do away with Death Star petitions and even improve on the existing serious ones. Read on below for his modest proposal on that front.With a little boost from 4chan, a petition for the U.S. government to build a working Death Star has reached 30,000 signatures and counting, over on the White House's Department Of Let's See How Fast We Can Get 75,000 Signatures To Legalize Pot (or as it's officially known, "We The People"). This is the website where any of the member of the public can create a petition that other users can sign, and if the petition receives 25,000 signatures in 30 days, the White House will issue an official response. (Alan Boyle is taking suggestions on how the White House should respond to the Death Star request. How about: "4chan. You will never find a more wretched hive of scum and villainy.")
Cynics will say that the whole process was already a joke anyway. Even looking at the most popular non-Death-Star related petitions on We The People, most of them express standard left- or right-wing positions on hot-button topics in a manner that's extremely unlikely to convert anyone who doesn't already agree. Since everyone already knows that those some large segment of the population holds those positions, nobody would be surprised that any one of those petitions would be able to gather 25,000 signatures, and so there would be no pressure on the White House to change any of their official positions as a result.
On the other hand, I don't think this means that online petitioning can't work. Rather, I think a sligthly different algorithm could greatly improve the quality of the suggestions that get filtered to the top and trigger a response from the White House. At least one algorithm exists that (a) would prevent the system from being "gamed" by any large, organized group (whether 4chan or the NRA); and (b) would reward the petitions that were supported by the highest percentage of the general user population (or, if you prefer, the petitions that were supported by the highest percentage of credentialed experts in a given field).
The algorithm is the same one that I've advocated for preventing cheating on digg, or identifying the best "hidden gems" among newly released songs (and political arguments), or adjudicating Facebook abuse complaints -- have each petition voted on by a random subset of users registered on the We The People site. Based on this random sampling method, the petitions that have the highest percentage of "yes" votes, are assumed to be the ones with the broadest level of support among registered users, and the ones most deserving of a response from the White House.
Example: Suppose there are 250,000 registered users on the We The People site. A user creates a new petition, and somehow manages to pass some "threshold" that is implemented to screen out blatant time-wasters. (Perhaps you have to gain 100 signatures to pass the first threshold. I'd prefer it if you could clear the first hurdle just by paying $5 with a credit card, but this might anger purists who say that petitioning the government should always be free.) Your petition then gets emailed out to 100 randomly selected other users on the site, who vote to either Agree or Disagree. (In practice, in order to get 100 votes cast, you'd have to email more than 100 people, taking into account their response rate. So if only 50% of users respond to an email request for votes, email it to 200 randomly selected users to ensure you get about 100 votes cast.) Then petitions are sorted according to the percentage of users in their sample who voted to Agree. Petitions that got a high percentage of yes-votes, could be forwarded out to a wider audience (say, 1,000 users), to ensure that the initial high percentages of yes-votes wasn't just a fluke. Users in each random sample could also include comments about why they were voting a particular proposal up or down.
This sounds deceptively simple, but it makes it much harder for an organized online movement to hack the system. Say that 4chan manages to get 25,000 registered users in an attempt to push their favored petition to the top. This still means that, on average, their voters will comprise only about 10% of the randomly selected voters in any online poll - possibly enough to give an extra boost to a petition that already had broad support from regular users, but not enough to achieve a coup all by themselves.
Perhaps you'd object that even if such a system could not be manipulated by organized mobs, it would still leave the approval rating in the hands of non-expert ordinary citizens (even if citizens registered on We The People are slightly more informed than average). Whether you think this is a good thing, depends on whether you think the purpose of the site is to reflect the will of the people, or to provide informed advice to the President.
But if you want to get a random sampling of expert opinions, that's pretty easy as well. For petitions on, say, economic matters, just have a subset of users consisting of economics professors from accredited universities across the country. (These credentials would have to be confirmed manually by White House staff, but it's not that hard to verify that someone owns an .edu address and that their university webpage identifies them as an econ professor.) Then any petition on an economic matter could be submitted to a random sample of economics professors to be rated by them. If a petition gets a rating from economics experts that is wildly different from the rating it gets from the general user population, that suggests something interesting is going on (either econ professors are out of touch, or the general public is misinformed). But if a petition gets high levels of support from the public and the relevant expert group, that would seem to justify a response from the White House, much more so than some of the idiotic petitions currently pulling 65,000+ votes on We The People.
Something almost like this has actually been done by the IGM Economic Experts Panel in Chicago, which surveyed a group of 41 economists that the IGM believed to be among the best in the world, representative of the political left, right, and center. The survey found a high degree of consensus on questions that the general public is divided on, such as the fact that 40 out of 41 experts agreed with the statement:
All else equal, permanently raising the federal marginal tax rate on ordinary income by 1 percentage point for those in the top (i.e., currently 35%) tax bracket would increase federal tax revenue over the next 10 years.
To people who have heard celebrity conservative economists claiming that raising marginal tax rates lowers tax revenue, it might come as a surprise that virtually all expert economists in the IGM's sample, including a representative number of self-described conservatives, agreed that it does not. But don't just soak the rich and call it a day; most economists in the IGM's sample also disagreed that:
The cumulative budget shortfalls in the US over the next 10 years can be reduced by half (or more) purely by increasing the federal marginal tax rate on ordinary income for those in the top tax bracket.
Of course those were questions of fact (what economists call positive economics), while petitions address questions of what should be done (what economists call normative economics, and which varies according to your values and goals). But even economists with diverse political leanings often advocate similar policies; NPR interviewed 5 economists spanning the spectrum from left to right, and found across-the-board consensus in favor of 6 proposals, which you can read here. And hey, one of them is legalizing pot!
If We The People implements a system for polling a random sample of economics experts, I think their first order of business should be to have them rate the ideas in that 6-point platform. The five-person panel claimed that all of these ideas have broad support from economists across the political spectrum, but it would be good to know for sure. And for any of those six points that has broad consensus support from experts, it should be incumbent on the White House to declare whether they agree, and if not, why not.

UT Professor Resigns Over Fracking Conflict of Interest
eldavojohn writes "Dr. Charles 'Chip' Groat, lead author of a study claiming there was no link between fracking and water contamination, has resigned at the University of Texas along with Dr. Raymond Orbach, the head of UT's Energy Institute. The reason is that Groat served on the board of a drilling company and received compensation totaling over $1.5 million from that entity over the last five years including time he spent writing the study. After the Public Accountability Initiative gave the UT report a thorough beating for failing to mention this it sparked UT to recommend the report's withdrawal. PAI said the original report was 'based on literature surveys, incident reports and conjecture' and criticized UT's press from downplaying the many caveats. PAI also said conclusions of the original report were 'tentative,' that the press coverage was 'inappropriately selective' and 'seemed to suggest that public concerns were without scientific basis and largely resulted from media bias.' This study was also covered by Slashdot via MSNBC quoting Groat and calling fracking safe in theory but not in practice." -
Historians Propose National Park To Preserve Manhattan Project Sites

Broad writes that a plan now before Congress would create a national park to protect the aging remnants of the atomic bomb project from World War II, including hundreds of buildings and artifacts scattered across New Mexico, Washington and Tennessee — among them the rustic Los Alamos home of Dr. Oppenheimer and his wife, Kitty, and a large Quonset hut, also in New Mexico, where scientists assembled components for the plutonium bomb dropped on Japan. 'It's a way to help educate the next generation,' says Cynthia C. Kelly, president of the Atomic Heritage Foundation, a private group in Washington that helped develop the preservation plan. 'This is a major chapter of American and world history. We should preserve what's left.' Critics have faulted the plan as celebrating a weapon of mass destruction, and have argued that the government should avoid that kind of advocacy. 'At a time when we should be organizing the world toward abolishing nuclear weapons before they abolish us, we are instead indulging in admiration at our cleverness as a species,' says Rep. Dennis J. Kucinich. Historians and federal agencies reply that preservation does not imply moral endorsement, and that the remains of so monumental a project should be saved as a way to encourage comprehension and public discussion. A park would be a commemoration, not a celebration, says Heather McClenahan, director of the Los Alamos Historical Society pointing out there are national parks commemorating slavery, Civil War battles and American Indian massacres. The Science of Roadkill
Hugh Pickens writes "Sarah Harris writes that roadkill may not be glamorous, but wildlife ecologist Danielle Garneau says dead critters carry lots of valuable information providing an opportunity to learn about wildlife and pinpoint migratory patterns, invasive species, and predatory patterns. 'We're looking at a fine scale at patterns of animal movement — maybe we can pick up migratory patterns, maybe we can see a phenology change,' says Garneau. 'And also, in the long term, if many of these animals are threatened or they're in a decline, the hope would be that we could share this information with people who could make changes.' Garneau turns students out into the world to find dead animals, document them and collect the data using a smartphone app RoadkillGarneau and she has already received data from across New York, as well as Vermont, Pennsylvania, Massachusetts, Michigan, Minnesota, Florida and Colorado. Participants take photos of the road kill, and the app uploads them through EpiCollect, which pinpoints the find on the map. Participants can then update the data to include any descriptors of the animal such as its species; sex; how long the dead animal had been there; if and when it was removed; the weather conditions; and any predators around it. 'People talk a lot about technology cutting us off from nature,' says Garneau. 'But I found that with the road kill project, it's the opposite. You really engage with the world around you — even if it is a smelly skunk decaying on the side of the road.'" -

Bradley Manning (WikiLeaks Source) Given Hearing After 2 Years In Jail

Manning claims that while remanded in custody in Iraq he 'passed out due to the heat' and 'contemplated suicide.' The United Nations special rapporteur on torture found Manning's detention was 'cruel and inhuman.' Manning wants the case against him to be dismissed because his pre-trial punishment was so severe. Manning's attorney, David Coombs, earlier released an 11-page letter detailing the conditions of Manning's confinement. Manning offered guilty pleas to minor charges, but not to spying, aiding American enemies or treason, and those pleas have been accepted by the judge." -
What "Earth-Shaking" Discovery Has Curiosity Made on Mars?

On the one hand, they'd like to tell everybody what they found, but on the other, they have to wait because they want to make sure their results are not just some fluke or error in their instrument. The exciting results are coming from an instrument in the rover called SAM. 'We're getting data from SAM as we sit here and speak, and the data looks really interesting,' says John Grotzinger. He's the principal investigator for the rover mission. SAM (Sample Analysis at Mars) is a suite of instruments onboard NASA's Mars Science Laboratory rover, Curiosity. Grotzinger says they recently put a soil sample in SAM, and the analysis shows something Earth-shaking. 'This data is gonna be one for the history books. It's looking really good,' he says." -
Tesla Motors Sued By Car Dealers

The dealers say they are defending state franchise laws, which require manufacturers to sell cars through dealers they do not own. Robert O'Koniewski of the Massachusetts State Automobile Dealers Association says, 'Those dealers are investing millions of dollars in their franchises to make sure they comply with their franchise agreements with the manufacturers. Sweden Imports European Garbage To Power the Nation
Hugh Pickens writes "NPR reports that Sweden's program of generating energy from garbage is wildly successful, but recently its success has also generated a surprising issue: There is simply not enough trash. Sweden has recently begun to import about eight hundred thousand tons of trash from the rest of Europe per year to use in its power plants. Sweden already brings trash from Norway and hopes to get garbage from Italy, Romania, Bulgaria and the Baltic countries. Sweden creates energy for around 250,000 homes and powers one-fifth of the district heating system. Its incineration plants offer a look into the future where countries could potentially make money off of their trash instead of dumping. Landfilling of organic materials – a highly inefficient and environmentally degrading system (PDF) — has been forbidden in Sweden since 2005 and emissions of the greenhouse gas methane from landfills has fallen dramatically (PDF). 'I hope that we instead will get the waste from Italy or from Romania or Bulgaria or the Baltic countries because they landfill a lot in these countries,' says Catarina Ostlund, a senior advisor for the country's environmental protection agency. 'They don't have any incineration plants or recycling plants, so they need to find a solution for their waste.'" -

'When we began this project, we thought that there would likely be some findings that would support the superiority of organics over conventional food,' says Dr. Dena Bravata, a senior affiliate with Stanford's Center for Health Policy and co-author of the study published in the Annals of Internal Medicine. 'I think we were definitely surprised.' Some previous studies have looked at specific organic foods and found that they contain higher levels of important nutrients, such as vitamins and minerals. For example, researchers found in one study that tomatoes raised in the organic plots contained significantly higher levels of certain antioxidant compounds. But this is one study of one vegetable in one field; when the Stanford researchers looked at their broad array of studies, which included lots of different crops in different situations, they found no such broad pattern. Here's the basic reason: When it comes to their nutritional quality, vegetables vary enormously, and that's true whether they are organic or conventional. One carrot in the grocery store, for instance, may have two or three times more beta carotene than its neighbor. But that's due to all kinds of things: differences in the genetic makeup of different varieties, the ripeness of the produce when it was picked, even the weather. Variables like ripeness have a greater influence on nutrient content, so a lush peach grown with the use of pesticides could easily contain more vitamins than an unripe organic one." -

Samsung Beats Apple In Tokyo, Itching To Sue Over LTE Patents
AmiMoJo writes "A court in Tokyo has ruled that Samsung Electronics did not infringe on a patent relating to transferring media content between devices. Tokyo District Judge Tamotsu Shoji dismissed the case filed by Apple in August, finding that Samsung was not in violation of Apple patents related to synchronizing music and video data between devices and servers." This particular battle is just one front in a patent war that spans ten countries and dozens of cases. Samsung also confirmed it was ready and willing to sue Apple if an LTE iPhone ever hits the market. Meanwhile, Apple was granted a number of new patents on Tuesday, including one for changing settings on a wireless device depending on its location (#8,254,902). For example, sound and light from the device could be disabled when entering a movie theater, or communications with other devices could be disabled in a science laboratory. -
What The Apollo 11 Crew Did For Life Insurance
Back in 1969 insurance companies weren't very optimistic about the odds of an astronaut making it back to earth after being launched in a rocket to the moon. The cost of life insurance for the Apollo 11 crew was astronomically high so they came up with a clever solution. A month before launch, the astronauts signed hundreds of autographs that were to be sold if they didn't make it back. From the article: "About a month before Apollo 11 was set to launch, the three astronauts entered quarantine. And, during free moments in the following weeks, each of the astronauts signed hundreds of covers. They gave them to a friend. And on important days — the day of the launch, the day the astronauts landed on the moon — their friend got them to the post office and got them postmarked, and then distributed them to the astronauts' families. Wikipedia Edits Forecast Romney's Vice Presidential Pick

Sarah Palin, her Wiki page saw a flurry of activity, with editors adding details about Palin's approval rating and husband's employment. ... Palin's entry was updated at least 68 times, with at least an additional 54 changes made to her entry over the preceding five days.' The obvious — in hindsight — implications of the Wiki activity: Aides were going into the entries to tune them up and clean out any material that was either embarrassing or erroneous. Now Mark Memmott writes on NPR that today's Wikipedia activity may lend a clue to Mitt Romney's vice presidential pick, expected to be announced within a few days. So what's going on now with some of those said to be among the leading possibilities to be joining Mitt Romney on the Republican ticket? On August 7, Rob Portman's Wikipedia page was revised 100 times, the Wikipedia page for Marco Rubio was revised 22 times, and the page for Tim Pawlenty was revised only 5 times. Of course, Memmott adds, somebody who knows about the 2008 Wiki tea leaves may just be messing with our minds." -
RMS Responds To NPR File-Sharer's Blog
New submitter UtucXul points out that Richard Stallman has penned a lengthy response to NPR intern Emily White for her post on the organization's site about how she failed to pay for a significant amount of recorded music, acquiring it instead through Kazaa, friends, and CDs owned by the radio station at which she was employed. (We previously discussed musician David Lowery's response; quite different from RMS's, as you might expect.) Stallman wrote, "Copying and sharing recordings was not a mistake, let alone wrong, because sharing is good. It's good to share musical recordings with friends and family; it's good for a radio station to share recordings with the staff, and it's good when strangers share through peer-to-peer networks. The wrong is in the repressive laws that try to block or punish sharing. Sharing ought to be legalized; in the mean time, please do not act ashamed of having shared — that would validate those repressive laws that claim that it is wrong. You did make a mistake when you chose Kazaa as the method of sharing. Kazaa mistreated you (and all its users) by requiring you to run a non-free program on your computer. ... However, that was in the past. It's more important to consider what you're doing now, which includes other mistakes. You're not alone — many others make them too, and that adds up to a big problem for society. The root mistake is treating a marketing buzzword, 'the cloud,' as if it meant something concrete. That term refers to so many things (different ways of using the Internet) that it really has no meaning at all. Marketing uses that term to lead people's attention away from the important questions about any given use of the network, such as, 'What companies would I depend on if I did this, and how? David Lowery On the Ethics of Music Piracy

How NASA and SpaceX Get Along Together

The relationship involves daily calls and emails between people who live in two different worlds: age versus youth, bureaucracy versus a flat startup-like structure, and a sense of caution versus a desire to move forward quickly. But they both have an almost religious belief in the need for humans to venture forth into space, a geeky love for rockets, and technical know-how — plus, they both need each other to succeed." The launch is scheduled for 4:55AM EDT (08:55 GMT) tomorrow morning. NASA TV will begin coverage at 3:30AM EDT, and there will be a press conference at 8:30AM. SpaceX's press kit (PDF) has mission details. The rendezvous with the ISS is scheduled for day 4 of the mission after a series of maneuvering tests to ensure the Dragon capsule can approach safely. It carries 1,200 pounds of supplies for the people aboard the ISS, and it carries 11 science experiments designed by students. -
FDA Cracking Down On X-ray Exposure For Kids
ericjones12398 writes "The Food and Drug Administration is proposing that manufacturers of X-ray machines and CT scanners do more to protect children from radiation exposure. If companies don't take steps to limit X-ray doses, the agency may require a label on their new equipment recommending it not be used on children. X-rays and CT scans can provide doctors with lots of useful information. But the radiation that creates the helpful images also increases a person's risk for cancer. There's been an explosion in the use of imaging tests. And rising radiation doses, particularly from CT scans, have drawn concern. The cancer risk increases with the dose of X-rays received during a person's lifetime, so kids' exposure is particularly important. It's also the case that children are more sensitive to X-ray damage. The FDA is also telling parents to speak up. If a doctor orders a test or procedure that uses X-rays, parents shouldn't be afraid to ask if it's really necessary. Also, it doesn't hurt to ask if there's an acceptable alternative, such as ultrasound or MRI, that doesn't rely on X-rays."
