Permit May Be Required For Public Photography in NYC
G4Cube passed us a link to a New York Times article about a troubling development in public photography rights. New York City is considering requiring a permit for photographers, film-makers, and even possibly tourists who want to shoot imagery in the Big Apple. "New rules being considered by the Mayor's Office of Film, Theater and Broadcasting would require any group of two or more people who want to use a camera in a single public location for more than a half hour to get a city permit and insurance. The same requirements would apply to any group of five or more people who plan to use a tripod in a public location for more than 10 minutes, including the time it takes to set up the equipment. Julianne Cho, assistant commissioner of the film office, said the rules were not intended to apply to families on vacation or amateur filmmakers or photographers. Nevertheless, the New York Civil Liberties Union says the proposed rules, as strictly interpreted, could have that effect. The group also warns that the rules set the stage for selective and perhaps discriminatory enforcement by police." -

Ban On Price Floors Abandoned, Internet Prices May Rise
paro12 and i_like_spam informed us of a 5-4 decision by the US Supreme Court which abandons a 96-year-old ban on manufacturers and retailers setting price floors for products. The Slashdot community discussed the issue when the case was argued back in March. The ruling means that anti-competitive complaints based on price-fixing will have to be argued case-by-case and will be harder to prove. Discounts and discounters in all venues may be under pressure, with internet sales possibly the hardest hit. "Importantly, this case points a dagger at the heart of the most consumer-friendly aspects of the Internet. The Internet has shifted power to the consumer in two ways. First, it allows consumers to search for and gather information in a cost-effective, efficient manner. Second, it provides a low-cost means of retailing, making it easy for discounters to offer products to the public. This combination squeezes excess profits and inefficiencies out of product prices. Retail price maintenance seeks to short circuit this extremely consumer friendly process. By setting minimum prices, manufacturers can build in excess margins for themselves and for their favored retailers -- prices that consumers have no choice but to pay." -
US Prepares for Eventual Cyberwar
The New York Times is reporting on preparations in the works by the US government to prep for a 'cyberwar'. Precautionary measures are being taken to guard against concerted attacks by politically-minded (or well-paid) hackers looking to cause havoc. Though they outline scenarios where mass damage is the desired outcome (such as remotely opening a dam's gates to flood cities), most expect such conflicts to be more subtle. Parts of the internet, for example, may be unreachable or unreliable for certain countries. Regardless, the article suggests we've already seen our first low-level cyberwar in Estonia: "The cyberattacks in Estonia were apparently sparked by tensions over the country's plan to remove Soviet-era war memorials. Estonian officials initially blamed Russia for the attacks, suggesting that its state-run computer networks blocked online access to banks and government offices. The Kremlin denied the accusations. And Estonian officials ultimately accepted the idea that perhaps this attack was the work of tech-savvy activists, or 'hactivists,' who have been mounting similar attacks against just about everyone for several years." -

The study focused on men, particularly 'on teasing out the biological effects of birth order from the effects of social status,' but indicates that the senior boy in a family (either by being firstborn, or if an elder brother died) has an average IQ two or three points higher than younger brothers. Virtual world economist Julian Dibbell travels to Nanjing, China, for a look at the working conditions and first-hand experience of farming gold from virtual monsters as a way to make a living. From the article: 'At the end of each shift, Li reports the night's haul to his supervisor, and at the end of the week, he, like his nine co-workers, will be paid in full. For every 100 gold coins he gathers, Li makes 10 yuan, or about $1.25, earning an effective wage of 30 cents an hour, more or less. The boss, in turn, receives $3 or more when he sells those same coins to an online retailer, who will sell them to the final customer (an American or European player) for as much as $20. What Happens If You Don't Pay for Goodmail?

The news will probably generate another round of editorials like the ones written a year ago about AOL's plan to use Goodmail, including this one from Esther Dyson (for it) and this one from the EFF (against it)." Follow the magical clicky clicker below to read the rest of this story.If I could ask one serious question of anyone who was defending pay-per-email, or sitting on the fence about it, this would be it: Suppose you sent an extremely urgent e-mail to your doctor or your lawyer, who for the sake of argument you're not able to reach by phone. The recipient's ISP owner happens to see the message before the user retrieves it, and realizes how urgently you need to get it through. So he moves it to the recipient's "spam" folder, and then calls you up and says: pay me $1,000 to move it to the recipient's inbox, or they'll never see it.
Does the ISP have the right to do that? If not, why not?
Perhaps you'd say that Goodmail's 1/4-penny-per-message is reasonable, but $1,000 for one message is too much. But then who decides what is "too much"? The marketplace? Then isn't the ISP admin just another player in the market, and $1,000 is what they want to charge? If you don't like it, you can go somewh... oh, wait, you can't, because there's no other way to get through to the recipient. If you ever get through to your doctor or lawyer, they might switch ISPs after they hear what happened, but should that be your only recourse?
The problem with the ISP charging $1,000 to deliver your message is not that $1,000 is "too much", but that they're charging for a service that has already been paid for. If your doctor or lawyer pays for an e-mail address, they're doing so with the understanding that their ISP will make a reasonable effort to deliver the non-spam e-mails that people try to send them. If their ISP then turns around and asks you for $1,000 to deliver the e-mail, then they're trying to double-bill for the same service, and if they block the message because you don't pay the $1,000, then the ISP is cheating the recipient out of a service that they've already purchased. And it's not just the recipient being cheated; if the recipient has an arrangement with you, as your doctor or lawyer would, then the ISP is interfering in their business relationship with you.
Now, if an ISP using Goodmail offers to let you bypass their filters by paying 1/4 penny per message, how is that different from the doctor example? Well, on the face of it, it's different in at least two ways: first, because the ISP is charging "only" 1/4 penny per message instead of $1,000, and second, they're not saying that your mail will be blocked if you don't pay, only that it might be. But are these qualitative differences, or just differences in degree?
Take the cost-per-message. I have a (verified opt-in) mailing list of about 50,000 people that I send mail to twice a week. In the aggregate, it is just important for me to get mail out to those subscribers, as it is for some people to get a single mail through to their doctor or lawyer. Also, in the aggregate, it would cost me about $1,000 per month if the ISPs collectively asked for 1/4 penny per message and threatened to block them otherwise. So is there any real difference between requesting $1,000 to unblock 50,000 e-mails, and requesting $1,000 to unblock a single e-mail, if you're just doing it because you know the sender urgently needs to get them through? (It's not a reflection of the ISP's costs -- downloading and storing 50,000 messages at 3 K each, costs almost nothing, certainly not anything close to $1,000. And again, I would argue it's a moot point anyway, because those services have already been paid for.)
And how much difference is there, really, between saying that a message (or a group of messages) might be blocked, and saying that a message definitely will be blocked? If it's bad for your doctor's ISP to call you up and say, "Give me $1,000 or there's a 100% chance that your message doesn't get through," what if they say, "Give me $1,000 or there's a 50% chance that your message doesn't get through," isn't that at least 50% as bad? You could say that in my doctor example, the blocking was deliberate, but in the case of the spam filter, it's accidental. But if an ISP chooses not to fix problems with its spam filter, then in a way it's still deliberately creating a certain percentage of cases where the spam filter will block legitimate mail, even if those cases occur at random.
There is one more difference between Goodmail and the scenarios I've described, which is that Goodmail not only lets you bypass an ISP's spam filters, it also certifies that you are trusted and not a phisher. If an ISP like AOL controls the user-interface that a user uses to check their mail, it can display the blue-ribbon "CertifiedEmail" icon next to a Goodmail-certified message. In this case, an ISP can plausibly claim that they're letting all legitimate e-mail get through, but they're still offering a benefit to Goodmail senders. The problem with this is that since phishing only works on users who are gullible to begin with, a phish could just as easily display the CertifiedEmail icon in the body of the message to try and gain a user's trust. It's all very well to say that a user should know that the CertifiedEmail icon only "counts" when it's displayed in the inbox, not in the message itself. But a user who knows that, would probably also know that their bank's Web page is not 209.211.253.169. And besides, most users of Comcast, Cox, RoadRunner and Verizon will be using their own mail clients like Eudora which won't display the "CertifiedEmail" icon anyway.
So it seems pretty clear that the main benefit of using Goodmail will be deliverability. And that's the basic Catch-22: If an ISP gives the same deliverability to non-Goodmail-certified messages, then who's going to use it? On the other hand, if an ISP gives better deliverability to Goodmail-certified messages than to other messages (much more likely), then they are to some extent misrepresenting the services they sell to their users, since users expect an ISP to make the best effort to deliver all legitimate e-mails, not just the ones from paying senders.
Goodmail likens their service to FedEx or UPS for "enhanced delivery" of paper mail as a way of getting the recipient's attention. But the difference is that if you're trying to reach your lawyer, then the office complex where he works (or the city that maintains the streets to his house) is providing the service that he expects and has paid for, namely, allowing different companies to deliver stuff to him there -- and because you have different choices, that means FedEx, UPS and the USPS have to compete with each other, and that keeps the delivery prices down. On the other hand, if an ISP blocks you from mailing their customer unless you pay their fee, then the ISP is going against what the customer expects them to do, and it is precisely that betrayal of trust that gives the ISP a monopoly on your ability to reach the customer -- which leads to them charging monopoly-style prices, like $1,000 to receive and store a few tens of thousands of messages.
There is a lot of debate about whether "the market" would fix problems of legitimate e-mail being lost. Esther Dyson's editorial was a classic libertarian defense of the free market as the arbiter of systems like Goodmail: "If it's a good model, it will succeed and improve over time. If it's a bad model, it will fail. Why not let the customers decide?" Actually I don't think the free market does fix most e-mail deliverability problems -- I've been involved in a few business that sent bulk e-mail (to subscribers who requested it and confirmed their subscriptions), and have had conversations with dozens of others, and we've all had problems sending to Hotmail, AOL, and Yahoo, and I've never, ever heard anyone say that their deliverability problems were solved by "the market". (Usually the problems just come and go, and nobody knows why.) But in a way this is all beside the point. Even if the market would stop more egregious abuses, what gives ISPs the right to charge senders for e-mail services that their customers have already paid for?
I actually met Richard Gingras, the CEO of Goodmail, and Charles Stiles, the postmaster of AOL, at a conference in Seattle last year where they were on a panel defending against the Goodmail controversy. They seemed like nice guys who were genuinely blindsided by the criticism that Goodmail had been receiving. It's easy to see the point of view of Goodmail's defenders -- if Bob wants to pay Alice to "certify" Bob, why would it be anybody else's business? It isn't, until it leads ISPs to steer people towards a system where if you want to be treated like a non-spammer, you have to pay -- even if, strictly speaking, the recipient is already paying to receive your mail.
As for the much-vaunted free whitelisting privileges that non-Goodmail senders will continue to enjoy, in the pre-Goodmail era I once found that AOL was blocking some of my mail to their users, so I called their postmaster department and learned the following facts:
- The first person I talked to, said that he checked the logs and our mail was being blocked because we didn't have reverse DNS set up. I thought this was odd because we did have it configured, but I thanked him and hung up.
- Then, I called back and got someone different. I asked them the same question and they said that according to his logs, our mail was being blocked because someone else at our ISP was sending spam. I asked him why they were blocking our IP address, if it was different from the IP of the alleged spammer; he paused and said, "Is there anything else I can help you with?", and this repeated several times as I thought my phone or his headset wasn't working, before I realized he was just being a dork.
- Then, I called back and got yet another person, and this person said that he could see our mail was being blocked because it contained banned content. I was pretty sure that was wrong, because you get a different-looking bounce if you're sending mail that contains a banned string, but I took a note of that anyway.
- Then, I called back and got a fourth person, who said that our mail was being blocked because some of their users had flagged mail from our IP address as spam. He paused for a brief conversation in the background, then came back and added, "This has already been explained to you, sir." I said that since I had gotten four different explanations in four different phone calls, I figured I could just keep calling and tallying the votes that I got for each explanation, until one of them emerged as the winner.
Much later I found out from someone else about the AOL whitelisting program, which I'm currently trying to see if it prevents us from getting blocked. But if none of the people answering the phone at the postmaster department knew or told me about it (and I confirmed that it did exist at the time), how many other organizations or businesses don't know?
ISPs adopting Goodmail say that while Goodmail senders can bypass their spam filters, non-Goodmail senders will continue to enjoy the same deliverability rates that they have in the past. That's what I'm afraid of.

Justice Dept. Defends Microsoft Against Google

The complaint, lodged late last year, was revealed Saturday by The New York Times in a story about the Bush administration's handling of Microsoft antitrust issues. The real story, though, is not the Google complaint itself, but how the Justice Department is failing to enforce the Microsoft anti-trust decree. According to the story, Thomas Barnett, the assistant U.S. attorney general in charge of antitrust issues, sent a memo last month to state attorneys general across the nation, seeking to persuade them to reject Google's complaint." -
Attorney Sues Website Over His Online Rating

The story covers the controversy of computers grading humans. 'Browne, who has participated in a number of high-profile cases in the state, including the defense of arsonist Martin Pang, said in an interview that Avvo is being irresponsible with the ratings and called them a fraud. And he questioned why Supreme Court justices and prominent lawyers score so low. Three other attorneys interviewed by the P-I also expressed doubts about the rating system, while News.com reported that the site "seemed to be riddled with bizarre errors."' Such practices are not new: the New York Times earlier this year reported on Google using algorithms to determine applicant suitability. But what happens when you don't like the result? U.S. Bans Some Cellphones For Patent Reasons

The International Trade Commission said today that the import ban would not apply to mobile phone models that were imported on or before June 7." Inkjet Photo Print Longevity Lacking

As the article's title says, somewhat alarmingly, "It isn't that images fade, it's that they can vanish." The problem is actually more nuanced than this; it's that no-one has a reliable and standardized way of testing inkjet prints for longevity. From the article: "The life of color inkjet prints has also been hindered by the origins of the technology, which was mainly intended for printing things like pie charts, said Nils Miller, a scientist at Hewlett-Packard. 'The initial emphasis was, how do we get bright colors on plain paper," Dr. Miller said. "Permanence was not really on the radar screen yet.'" -

"Freshness" defines how many recently changed pages appear in a result. They assumed old pages were better, but when they first introduced Google Finance, the algorithm couldn't find it because it was too new. Some topics are "hot". "When there is a blackout in New York, the first articles appear in 15 minutes; we get queries in two seconds," said Singhal. Classifiers infer information about the type of search, whether it is a product to buy, a place, company or person. One classifier identifies people who aren't famous. Another identifies brand names. A final check encourages "diversity" in the results, for example, a manufacturer's page, a blog review, and a comparison shopping site." -

A copy of his genome, recorded on a pair of DVDs, was presented to Dr. Watson on Thursday in a ceremony in Houston by Richard Gibbs, director of the Human Genome Sequencing Center at the Baylor College of Medicine, and by Jonathan Rothberg, founder of the company 454 Life Sciences. 'The first two genome sequences belonging to individuals are now being made available to researchers within a few days of each other. One is Dr. Watson's and the other belongs to J. Google Street View Raises Privacy Concerns

'The issue that I have ultimately is about where you draw the line between taking public photos and zooming in on people's lives,' Ms. Kalin-Casey said in an interview. 'The next step might be seeing books on my shelf. If the government was doing this, people would be outraged.' Wired has started a contest on the most interesting photos found using the new Google Tool that now includes sunbathing coeds, alleged drug deals, and the google van itself. FTC Investigating Google-DoubleClick Deal

The investigation is in response to privacy group concerns over the amount of information Google will have available to it via its ad service and DoubleClick. Between a few days and a week from now the FTC should either declare the all clear, or elevate the process to a 'second request' stage. That would indicate more serious issues the federal body has an interest in. Google stated it was confident the purchase would hold up under scrutiny. 'In the complaint, the groups noted that Google collects the search histories of its users, while DoubleClick tracks what Web sites people visit. The merger, according to their complaint, would give one company access to more information about the Internet activities of consumers than any other company in the world.'" -

The business, an outfit called NameMedia, has made a concerted effort to quietly purchase vast tracts of 'real estate' on the internet. The ultimate goal is to provide additional advertising and page views for content sites. 'Behind this suddenly active business category -- which includes companies like iREIT in Houston, Marchex in Seattle, and Demand Media in Santa Monica, Calif. -- is the recognition that not all Internet users turn to a search engine when they are confused about where to find something online. Rather, 5 percent to 10 percent of people will simply type in a name that sounds as if it might suit their needs. The so-called direct search or direct navigation approach is seldom fruitful for users, nor has it been particularly profitable for owners of the sites that they visit. An obscure Web address may have four or so visitors a month, and perhaps half will click on an ad.'" -

The New York Times reports on the efforts of big companies to harness consumer enthusiasm for assistance with advertising. Heinz, for example, is running a campaign asking users to submit videos using their product in inventive ways. The problem, of course, is that most of the submissions are utterly terrible. The result is a headache in terms of quality control and making use of the turned in submissions. 'Heinz hopes to show more than five of them, if there are enough that convey a positive, appealing message about Heinz ketchup, he said. But advertising executives who have seen some of the entries say that Heinz may be hard pressed to find any that it is proud to run on television in September. "These are just so bad," said Linda Kaplan Thaler, chief executive of the Kaplan Thaler Group, an advertising agency in New York that is not involved with Heinz's contest. One of the most viewed Heinz videos -- seen, at last count, more than 12,800 times -- ends with a close-up of a mouth with crooked, yellowed teeth. When Ms. Kaplan Thaler saw it, she wondered, "Were his teeth the result of, maybe, too much Heinz?"'" -

The Case For Perpetual Copyright
Several readers sent in a link to an op-ed in the NYTimes by novelist Mark Halprin, who lays out the argument for what amounts to perpetual copyright. He says that anything less is essentially an unfair public taking of property: "No good case exists for the inequality of real and intellectual property, because no good case can exist for treating with special disfavor the work of the spirit and the mind." This community can surely supply a plethora of arguments for the public domain, words which don't appear in the op-ed. In a similar vein, reader benesch sends us to the BBC for a tale of aging pop performers (virtually) serenading Parliament in favor of extending copyright for recording artists in the UK. Some performers are likely to outlive the current protections, now fixed at a mere 50 years.

The exact location of the wreck is still undisclosed. Odyssey is a for-profit, publicly traded company. 'In seeking exclusive rights to that site, an Odyssey attorney told a federal judge last fall that the company likely had found the remains of a 17th-century merchant vessel that sank with valuable cargo aboard, about 40 miles off the southwestern tip of England. A judge granted those rights Wednesday. In keeping with the secretive nature of the project dubbed ''Black Swan,'' Odyssey also is not discussing details of the coins, such as their type, denomination or country of origin. Powerful Supernova May Be Related To Death Spasms of First Stars

Conservative Sarkozy Wins Presidency of France
Reader reporter tips us to a story just up at the NYTimes reporting that the tough-talking conservative candidate Nicolas Sarkozy has won election as the president of France. His opponent, Socialist Party candidate Ségolène Royal, the first woman to get as far as the runoff in a presidential contest in France, has conceded defeat. The vote went 53% to Sarkozy and the turnout was a remarkable (by American standards) 85% of registered voters. Sarkozy is seen as a divisive figure for his demand that immigrants learn Western values (and the French language). -
Some Schools Ending Laptop Programs
The New York Times reports that schools are abandoning their laptops-for-students programs. It turns out that the expense of providing laptops, expense of repairing laptops, difficulties of school network management, and discipline problems stemming from pornography, cheating, and cracking more than outweighed the educational benefits. Indeed, a number of schools have concluded that far from improving student achievement, laptops either had no effect or actively hindered academic performance. Apparently, politicians embracing technology as a quick fix for social problems doesn't always work out. -

According to the New York Times, Vonage is preparing to take it's case back down to the lower courts for a retrial of the lawsuit against them from Verizon. More Than 1500 Schools To Deploy DDR By 2010

Adopted by educators as a way to fight obesity among young people and encourage participation, the article states that by the end of the decade some 1500 institutions will be using the game in classes. "As Leighton Nakamoto, a physical education teacher at Kalama Intermediate School in Makawao, Hawaii, put it: 'The new physical education is moving away from competitive team sports and is more about encouraging lifetime fitness, and D.D.R. is a part of that. Dell Rethinking the Direct-Sales Market
Dell has always sold directly to consumers via their web site and phone operations; it's a basic element of their business. Chairman and chief executive Michael Dell is now conceding that the company may need to rethink basic practices by considering alternative methods of selling their products. While initially no specifics are given, the thought seems to be than eventually the company will begin working with a retail chain. "Dell's direct model came under pressure as the market for PCs shifted to notebooks from desktops last year. It is harder to custom configure notebook computers, so they had to be manufactured in advance, which lost Dell some of its cost advantage. In addition, consumers were showing a preference for touching and feeling a notebook PC before buying it." -

New MySpace China Tells Users to Spy on Each Other
Anonymous Chinese Coward writes "MySpace has launched in China, the world's most populous nation, but this definitely is NOT the MySpace you're used to. Members are told to click a button to report any 'misconduct' by other users. MySpace's definition of 'misconduct' includes actions such as 'endangering national security, leaking state secrets, subverting the government, undermining national unity, spreading rumors or disturbing the social order' — according to the site's terms and conditions. In China these are all crimes which carry a hefty prison sentence. Any attempt to post content containing phrases that the Chinese government doesn't like, such as 'Taiwanese independence', the banned 'FaLun' religious movement or the Dalai Lama, produces the following message. 'Sorry, the article you want to publish may contain inappropriate content. Please delete the unsuitable content, and then try reposting it. Thank you.'"
