Not first
Late last year TeaM-ACiD1C released a proof-of-concept custom firmware. Though admittedly this may be the first useful custom firmware.

So, what was that about PS3 homebrew always being illegal because it uses Sony's leaked SDK? Or are you saying that because some of it does, especially right now because there's not a *mature* tool chain yet, that any future homebrew created without using Sony's SDK will somehow also be using Sony's SDK even though it isn't?

3.42 has been released...news anyone?
Just noticed that 3.42 has been released. Nothing posted on the official PS3 website...I wonder what it's going to do? Keep an eye out here. Figures...I did one update since I'll be able to use Linux now and Sony has to come and spoil my fun.

Re:It's all bullshit to the sixth degree. PS3 vs XI call bullshit for two reasons:
- The reason games cost the same on the PS3 and 360 is pricefixing, pure and simple. If I wanted to release a full retail game on either system (assuming I had a studio and a license to develop for the systems) I would be forced into selling it for $60. It's only after the game had been out for a while and sales declined that the retailers would start lowering the price.
- The PS3 does have hacks available, even if it doesn't have true piracy yet (Example. Warning: mildly NSFW ads.) I suspect a large part of the reason there's no true piracy yet is because of the Blu-Ray format. A single BD-R costs $12.85 on Amazon, and I can't imagine that it's easy to create/load a ROM of a game stored in that format.
