Dual Shock 3 has both Rumble and Motion.. Amazing.
Yes it does have the motion sensing. If you read the keynote, when Kaz announced it he started off talking about how originally they thought there would be technical issues with having rumble and motion sensing but they have overcome those issues and have both in the new controller.
Apparently Kaz isn' a fan of the WarioWare Series, since Nintendo was able to do both in 2003 (when the game shipped in Japan). Perhaps he wasn't lying, and it had nothing to with Legal issues, maybe Nintendo has better engineers than Sony.

Re: Sony Needs to Hire Nintendo Engineers.
Apparently someone said you couldn't do both as the rumble would interfere with the tilt sensor. Despite Nintendo originally doing it in 2003 .

Re:Driving and flying and othersand Super Monkey Ball would be a natural.
However Sony said they pulled the Rumble since it would 'Obviously interfer' with the tilt sensor. If that is true, Sony needs to hire some Nintendo engineers.

Re:Not all of those things...
Besides what innovative gameplay are you experiencing?
The other poster mentioned Trauma Center and Kirby. But that's not all!
The game where you're a lawyer and can literally yell objection.
Yoshi Touch and Go which requires heavy use of the stylus.
Meteos which would be a different game without a touch screen (the ability to "launch" blocks with the stylus is half the game).
The Pac Man game where the action is totally controlled by drawing.
Lost Magic the first RPG with immersive spell casting.
Trace Memory makes use of nearly every DS bit of functionality.
The Princess Peach game which has levels and a mini-game that require blowing into the mic. Sexual innuendo, a lot of DS games seem to require blowing.
The Bomberman game where, in multiplayer, you can set bombs or blow them up by yelling nonsense.
Of course Warioware which has tons of way to play with the stylus. -

Don't forget Wario Ware http://www.warioware.biz/

More Prior Art
B&W, Palm, etc. have already been mentioned as having prior art. Honestly, this is why I hate corporations like that. But I think there's another party who also has prior art on such a thing. I mean, these kinds of patents are just stupidly ridiculous.

Re:My take
I bought my DS about a week ago primarily for Wario Ware Touched and also to play around with it. I didn't care about any of the other games and frankly couldn't have cared less if anything else was ever released for it.
I also picked up Super Mario 64 DS because I figured "why not".
After about 10 minutes of SM64DS I about gave up on the game. The control was terrible. I was either using a poorly designed cross pad or using the stylus on the touch screen which was awkward. That was not the end though.
I checked the net for reasons why people actually enjoyed this game. It seems that quite a few of the people who liked it were using the thumb stylus found on the wrist strap for movement control.
I gave it a go and although it was unnatural at first, I was able to get used to it rather quickly and was soon playing the game like a pro. I think that anyone who doubts the touch screen control should just try it for a while. I'm now having serious doubts that the PSP's little analog button could be as good.
BTW, it is a shame that most DS demo kiosks don't have the thumb stylus/wrist strap on them. You can use your thumb without it but it's not quite the same. -
Re:Where did these games go?Where are all the games like PacMan? I don't mean PacMan itself, but simple games like that which you can play in five or ten minutes here and there?
Mostly to cell phones and PDAs, though you can still play them online at places like PopCap. I'll also double another poster's suggestion about the GameBoy; WarioWare is a good example of simple game play for the new millenium. Simple game design seems to have been shunted to the "puzzle" genre of gaming.

Re:Games?
Try WarioWare - it's not one of thse 10 or 20 hour games, you can complete a game in 5 seconds. Oh, and it's horribly addictive. BestBuy had it on the display GBA and I highly recommend checking it out.
