Indie Devs Upload Their Own Game To The Pirate Bay

dartttt writes "Indie game company tinyBuild Games, who released a platformer called No Time To Explain recently, uploaded their own game to the Pirate Bay. However, there's a key difference between the game they uploaded and the version you can purchase: the game characters wear pirate hats, and everything else has a pirate theme. One of the company's founders, Alex Nichiporchik, said, '[S]ome people are going to torrent it either way, we might as well make something funny out of it. ... You can’t really stop piracy, all you can do is make it work for you and/or provide something that people actually want to pay for. For us this is humor, we like making people laugh.'"

    How is this any different from RIAA or MPAA uploading fake torrents of their music and movies to make it more difficult for people to find what they want?

    1) This download does not contain malware.

    2) They will not drag you to court for downloading something that wasn't what you wanted to download anyway.

    The difference is that this is a playable game with a positive PR spin, whereas I assume the fakes that RIAA et al use are just blobs of pseudorandom data.

    The difference would be that using this pirate themed game, you can sense what the real thing will be like (and pay for it if you want it). The fake RIAA torrents don't do this.

      You can legally download anything you want. It's only distribution of copyrighted material that is illegal.

      It's quite difficult to download a popular torrent without also uploading. You'd need a hacked client in order to be able to achieve it, and most such clients get blacklisted by trackers when they're discovered.

      It depends on where you live, really... but knowingly downloading illegally copied copyrighted material really ought to be (IMO) in roughly the same category of severity of crime as knowingly possessing stolen property (I'm not saying that copyright infringement is theft here, by the way).

      The fact that they uploaded it *DEFINITELY* gives people permission to copy the version that they uploaded.

      Such permission does not extend into perpetuity however... they still retain the copyright, whether or not they freely distribute it, and they are also free to revoke such permission at any time. Reasonably, it should only be construed that as long as they are seeding the torrent, they are granting permission to download it. However, one could probably make a reasonable case that one was not aware that the copyright holder had withdrawn public copying privileges if brought to court on the matter (they would still forfeit any time and costs they incurred acquiring it, however).

      I don't think so. Piracy *is* stealing, Yes, that is the quote from the MPAA, but it is legally true in most countries.

      You don't own the rights to a product, and you haven't bought the right to own the product itself, therefore owning it equals theft.

      In most legal systems, possessing copyrighted material that you didn't buy is less punished than distributing it, (and so it should be, IMHO) but it is still illegal.

      So, if you configure your torrenting client to only connect to official tinyBuild seeders, and to not seed to anyone, then as you download it no one breaks the law. Of course that defeats the purpose of the BitTorrent protocol, but whatever.

      I'm thinking of compiling a bunch of music for my sister's birthday, and giving it to her on CD. What I'll probably do is buy it from Amazon, then write it to a few CDs, then give them to her.

      Technically, if I do that, I'm breaking lots of copyright laws (ie. distributing coprighted works, and because I'm in the UK transfering from one medium to another). If I don't do it, I won't buy the music.

      I'd be breaking the law just as much if I downloaded what I wanted illegally - there is no incentive legally for me to buy these songs rather than get them for free.

      The law is fucked.

      Also, stealing necessarily deprives someone of something. Piracy doesn't. Theft and copyright infringement are not equivalent legally in any country I know.

      Both the law, and people, are fucked.

      A purchased CD/.mp3/whatever format, that is then copied for the purchaser's use is fair. We should be able to copy the CD or it contents for use in multiple personal locations, like have a master on the shelf, a copy in the home CD player, one for the car, .flac/.mp3 on the cell, so on. This is roughly what you describe doing for your sis. There is precedence here as people have done this type of copying for years, LP to C90 as one example. Going back further, who would buy sheet music that could be played at one instrument? No one. You would by the music sheet and play it anywhere, on anything. Copying those sheets for sale or to distribute free of charge would be theft.

      Uploading and downloading something which was never purchased is theft. Selling something copied is also theft. Copying/reusing something purchased for personal use is fair usage.

      So, the law expanding "theft" to include copying for personal usage is fucked, as is people who copy stuff that they never purchased.

      To be "theft" someone does not need to be deprived. If I steal something that you would not miss, like a book not read in years, would it not still be thievery?

    It IS the real game, it's not "fake" in any way. It is also pirate themed. If you want the non pirate themed, go download the OTHER torrent of the game or buy it.

    I dunno, I'm actually half-tempted to buy this game because they're taking the inevitability of piracy, and getting a little bit of humour out of it. That and, unlike the two companies you've mentioned, the developers of this game are not actively prosecuting pirates. If anything, they're rewarding you for pirating... if you like pirate-themed games.

      I need a non-torrent link, my ISP prohibits torrenting. Yes, really.

      Since they uploaded it, it's a legal download, but my WISP is using some weak-sauce tech that they described as "running out of frames" when people torrent. I don't know what they meant by that really. I know what a frame is, but it sounds specious to me.

      What you need is a real ISP.

      No such thing is available where I live. In theory I could put up a private point to point link to someplace where I could get real access, but I don't know anyone to whom I have LoS.

      I want to try the game before I buy it. I think most games aren't worth the money. I simply will not buy a game without trying it any more. Not only do I not have the disposable income, but it's a stupid way to buy games.

      Allow me to translate: we haven't paid for enough bandwidth to cope with the demands of all of our clients. We'll use word "frames" here to refer to data transfer capacity as it will confuse most people and they won't realise it's because we're cheapskate bastards. A minority of our clients use bittorrent, but use a large proportion of our available bandwidth to do so. By blocking bittorrent, we have enough bandwidth for the rest of our clients.

      Seriously, get a new ISP. If they've blocked bittorrent the smart installers and autoupdaters for a lot of popular software won't work for you.

      How does one increase the bandwidth on a wireless frequency exactly? The reason that the WISP can't cope is that it is sharing a frequency among many people, there is no way to increase the bandwidth of the frequency.

      To make that true, you need to add "without also changing the protocol used." The speed of information exchange depends directly on the protocol. For a trivial example, consider modems over phone lines. By changing the protocol used (and negotiating up/down to a mutually understood protocol), various information exchange speeds (300, 1200, 9600, 19200, etc) are achieved.

    Who is stopping you from buying RIAA music?

    The people who make such lame music these days that I don't even want to pirate it, that's who. That basically leaves me with one Wierd Al disc every few years, though I do buy used CDs from time to time.

    When I download music, it's mostly from JASRAC artists, and a bit of whatever Germany's group is. (I love me some Eisbrescher.)

    This is hardly a fake torrent; it's just the game with pirates of the "Arrr" type. Think of it as some sort of demo with a bonus skin.

    They are creating buzz about their game. Its free marketing, and marketing is one of the areas that indies do not have a lot of money to fund.

    I am positive that many people will download it for free and never even consider paying for it. However, I am just as sure that another large group of people will download it, try it, like it, and go and buy the version without pirate hats. (I am assuming that they have something in game or in the downloaded files that tells the end-user how to get a legit copy.)

    I even expect that there will even be a small amount of people that will give money to the developer just for offering their game like this. Reasons for this will be because they legitimize p2p, to encourage more devs to go this route, or even just to give a big FU to companies like EA, Activision, and Ubisoft that think that DRM is the only way to succeed.

    In the end, I would wager that they will make more money on this game by letting people download it for free than if they tried to actual remove their game from filesharing sites. (not that it is ever possible to completely remove a file from the internet.)

      I know at least some people bought it because of this.

      I did, for one. I heard the name long ago and thought it was interesting. When they did this, I thought about pirating it to demo it, but then I just decided to pay the $10.

      I'm not sure it was worth it, but I think once ep2 is out (which we get for free, if we bought) then it will be.

      Yes, this is really the key to a succesful indie game. It's about getting buzz around your release. You can absolutely guarantee that because this has been posted on Slashdot some people on Slashdot will now go and buy it who never otherwise would.

      But also, because the media is so lazy and they just recycle other people's stories you can also guarantee that because at least one site has now covered it, the others will follow suit and cover it too - so the combined effect is all these extra sites covering it mean extra sales.

      Follow it up in a couple of weeks with a story about how "succesful" your awesome idea was and that'll repeat the show. Maybe do another in a month or two following it up again if you fancy milking that last few.

      I never heard about the game, but since it has a Linux version and it only costs around 9€, I just bought the damned thing. Showing a bit support never hurts. It's pretty fun, I played it for an hour over lunchtime. I'm already stuck. I haven't been any good at video games since I've been 14.

      In 1989 I was hired to do tech support for a tiny Mac software firm. My boss would upload the latest versions of our software to a variety of pirate boards.

      At that time it was incredibly hard to get shelf space at brick-and-mortar stores if you were small fry. The buzz generated by those lusty pirates helped our sales in a big way.

      I ripped off Machinarium and World of Goo, liked them so much after 5 mins I searched for the companies and bought the game downloads directly off them. Machinarium even came with a free download of the soundtrack in MP3 which was a bonus download.

      Lots of paid games I have are from indies after I tried a "full demo" and paid for the product immediately. I will certainly be checking this out, I'd rather my money went to a struggling indy label than the bigger names who simply see gamers as cash-cows.

      I went to go pay for the game too just because they put it out in torrent form. I was on the page with all my information filled out ready to click buy sight unseen, and then decided to first check out the torrent. I then read the comments of the torrent.

      The free version is buggy, graphics are less than stellar, and as a whole the game is difficult to play. I decided against sending them my money. If they were going to put effort into putting out a free game that was comparable to the paid game, I would have had no problem paying them for it. I paid $25 for The World of Goo. I think I played it once. It doesn't matter, it was the principle.

      These developers put a half hearted attempt to create a buzz to sell more games, short changing the rest of us. Put the real game out on a torrent and I'll buy it sight unseen, even if I will never play it.

      I would probably buy it (now I don't buy games, because I never have time to play them, but still) just because I want to encourage this kind of behaviour.
      It is much better than to fill the games with DRM and stuff that bothers legit players more than if you pirate the game.

      They posted a torrent of their own product for the express purpose of free peer-to-peer download and redistribution. Please explain how downloading it for free and enjoying the free "pirate" version it is not a legit copy?

      What I find funny is that people act like this is something new when it's not -- it's essentially just an evolution of the old shareware principle that popularized games like DOOM and Duke Nukem 3D.

      This reminds me of Links Awakening where you could steal the bow and arrow, but they'd call you Thief for the rest of the game. That annoyed me so much that I spent hours the next time just shoveling for coins so I could by the thing.

      No a key to a good indie game is to have a great hook and simple idea. I love the idea and the varity is interesting. Just the controls are AWFUL. Seriously. Super Meat boy, as simple as it was, at least locked the controls to the screen. Mouse pointer keeps getting out of damn window, and I PAID for this:P

    Who knows? It might be the original that's buggy and the torrent shows quite how badly written it is.
    (in fact, nowhere does it mention that the pirated game has extra bugs, so it's likely that this is true)

    It would be unusual for a torrented game to be worse and more freedom-restricting than actually paying for it.

    Ok,ok. It's not that I'm suggesting this new idea is a bad one; just that it is a novelty and I can't see it being profitable for EA to put pirate hats on all of the Sims.

    Then pay, you cheap bastard. At least this way you can try the "fake" pirate one and if you like it then buy the non-pirate hat version. But it seems you just want everyone to do everything for you for free. Why don't you write your own damned game in that case, and we can all rip YOU off? This is a smart, sensible business model and I wish the devs the best.

    Who is stopping you from buying RIAA music?

    The people who make such lame music these days that I don't even want to pirate it, that's who. That basically leaves me with one Wierd Al disc every few years, though I do buy used CDs from time to time.

    When I download music, it's mostly from JASRAC artists, and a bit of whatever Germany's group is. (I love me some Eisbrescher.)

    I like Eisbrecher ("Icebreaker") a little (I don't have any of their music, it's a bit too rock/metally but if they play in London I'll go and watch). Until August 2010 they were with independent labels (in August 2010 they signed with Sony, but don't seem to have released anything yet). So, what justifies you copying their music?

    How is this any different from RIAA or MPAA uploading fake torrents of their music and movies to make it more difficult for people to find what they want? They are doing exactly the same - polluting torrent sites by uploading fake content. I want the real game, not some fake pirate themed one.

    The difference is the RI/MPAA is doing it to collect for IPs for their all-lawsuit business model. These people are doing it with the realization that a certain number of people are going to pirate it no matter what so they may as well make a joke out of it. I haven't downloaded the game but it sounds like it's otherwise the same as the original, commercial version save graphics.

    Having a sense of humor about it seems to be a good thing if these types of stories are anything to go by.

      In my case I am permitted about 90GB/mo, I get 2 Mbps down, and a ping to yahoo :) is about 140ms. This is supposedly some kind of CDMA technology. I have a static IP and the device bridges so my router appears to be my border, which is nice anyway. Before, I was using 802.11b to my WISP, with a routerboard I had to pay for. I still have it, and maybe someday it will be part of a long-haul link for me. I also have a buffalo router and two WRT54GS units running tomato... but again, I've got nobody to hit with it anyway. I do have a 12 volt harbor freight solar rig lying around, so in theory I can make two hops with what I have now if I build some cantennae or similar.

      Because they cost next nothing to build. The emulation engines exist on just about every architecture, so all the distributors have to do is take one of the open sourced engines (aiming for BSD license), get a legitimate license for a small number of 80s titles and sell them.

      With the $10 price tag for the retail version the biggest fear those developers have is not piracy - it's obscurity.

      Besides, I believe you are overestimating the percentage of p1rates vs. legitimate users. As teenagers grow up and start earning money they begin valuing their time more than dollars (or euros or roubles, whatever.)

      Personally, I got myself a PS3 a long time ago, and so far I'm happy as a clam. My PCs are no longer bothered by endless video card upgrades, bug fixes and multi-gigabyte installs of stuff. I work on PCs and play on PS3, and that's how I like it. No licensing issues anymore too - it's all transparent to me; just insert the BlueRay disk and you are good to go. Multi-core CPU in PS3 is also not hurting. The video is excellent, smooth and doesn't require me to go out from time to time and buy yet another video card and then have fun time with its drivers. The cost of the console is lost in the noise long time ago; but the advantage of having it remains. I even have the mouse-based controller for it, though I don't use it very often - just no need.

      What this "pirate" is saying is that they dont really want the product, would never pay for it, and wouldn't even want it if it was free.

      Many of those downloads are by people who do not want the song anyway, they would never pay a cent for it, if it was on the publishers site for free they still wouldn't want it.

    Because I have yet to find their music for sale here in the USA on a store shelf. If I do, it will be an immediate purchase. Physical CD copies only, please, I don't buy "music store" MP3s, nor do I do mail order.

    It's difficult enough to find shops selling industrial music in the UK, so I can believe it's just as difficult in the USA. I'm not old enough to know about the "old days", I first went in a music store in about 2000, but what I understand used to be the large music stores now dedicate most of their floor space to films and video games. Last time I looked round the UK's main HMV store on Oxford Street, London, it had a single 1m-wide shelf for "Electronic synth" music, hidden under the stairs up from the basement, which contained three Kraftwerk albums and 15 copies of something by Depeche Mode. But mostly it had Harry Potter on Bluray.

    The independent stores are much better, but the ones I know are smaller and cater for particular genres. It's Resurrection Records in Camden Town for industrial, goth, ebm, black metal, pagan metal, etc. I only know of two brick-and-mortar stores selling industrial music in the UK, but there's probably a few more. 5?

    Anyway, I get CDs from, in order:
    - mail order, from UK Amazon/Play/etc
    - gigs
    - festivals (labels tend to turn up with all their CDs, not just the bands that are playing)
    - my nearest specialist independent music store
    - any of the above, but while I'm on holiday abroad somewhere.

    I'm not sure how I feel about record shops. I'm too young to have spent much time in them -- I bought my first three albums in them, but the fourth was given to me on CD-R by a friend. I like browsing the CDs at a stall at a festival, and I much prefer CDs to downloading MP3s, but I'm not sure where the shop comes in. I buy gig tickets there anyway, just to give it some support.

    Even then, who am I to judge them if it makes them happy? They could eat a steady diet of lettuce leaves for the next 80 years and die miserable, or they could eat what they like for 40 years and die happy. Is the end goal to live a happy life or a long life? I know it's not that black and white, there are all kinds of other considerations like poor health, strain on the public purse, etc. I guess my real point is maybe it's better to educate people about what's better rather than outright bash what they like (they're far more likely to listen if they think you're not looking down on their choices).

    They played other types of game, or engaged with their peers in other related ways (sports, drinking, RPGs, music, etc). If all your peers are playing games then there is a strong imperative for you to play games - that can be broken but it's going against basic human programming.

    4) Plus, pirate hats actually make things better. So yet again the pirates get the best version :) Seriously though, they seem like they've got the right approach and there are some nice incentives to buy (you get "series 2" free apparently). I think it's a pretty clever way to get a demo of your game out there and talked about, I wish more developers took the playful approach rather than the "let's punish legitimate users with horrible DRM and still see pirate copies in circulation two days after launch" approach that seems to be the norm.

    Actually, I would say YES they do live their lives happier thanks to their education or at least a serious work ethic (that led them to be fickle about grammar)

    When Gen X came into the work force, even a college degree would be good enough (or even no degree, again if they had a good work ethic, passion, etc), and today their careers should be doing well (those who didn't lose their jobs thanks to recession anyway). Some might be waiting to take over the top level positions that will be open once the Boomers retire (and be the next ones who'll screw the economy for their own profit ;p)

    As long as their education landed them on a job that is high level enough to NOT be outsourced to China/India, they're better off than Gen Y, whose college degree don't hold as much value it used to be (and going without any degree is near suicide)

    The arguments are real, I agree that it is better to educate people. Notice that that is never done by the US administration, or big media. Lobbyists and big media make a lot of money seeing to that.

    As for strain on the public purse, in the US the health care system is out to make money.

    No, you've just been brainwashed into spouting that response. Let's face it, whether you agree with file sharing or not, there are far, far worse actual, real crimes happening out there in the real world. If you really think someone who downloads a piece of software without paying for it is worse than, or even comparable to a murderer, for instance then your moral compass is definitely broken. Remember, despite the cute marketing job the **AAs are doing, digital piracy doesn't actually equate to real life piracy - if it's wrong then let's discuss it for what it is, not try and turn it into something it's clearly not in order to drive home a point.

    FYI, the 2004 tsunami killed approximately 75 9/11's worth of people (no, I don't know how many that is in Libraries of Congress). I vote you drop the 1993's WTC warning and include the tsunami instead. The 2001 WTC attack was 1.0 9/11's, but the subsequent wars probably account for 50+ 9/11's in collateral deaths, so it is a worthy inclusion.

    Furthermore, Hurricane Andrew only amounted to 8.7 milli9/11's, so I propose you swap that out for a warning regarding the Haitian earthquake, which was approximately 74 9/11's.

    Katrina may be retained, if only by American personal prerogative; it seems reasonable to allow one free-elective warning for the communicator. However, you might swap this out for a warning regarding a different disaster applicable to one's own country or family member's preventable death as well, per same prerogative.

    Plenty of mainstream music and film is good. It's all too easy to claim everything is shit, but you're wrong if you do.

    I started driving for a living about 4 years ago (I'm 33). Prior to that, I was basically into indie and happy hardcore, with little in between. I've been forced to listen to the radio in the UK. Radio 1 is ok, and sometimes great - they push some good new bands. XFM is decent too. Kiss is mass marketed lowest common denominator, but sometimes kick in something new and inspirational. London pirate radio is great occasionally, as is community radio.

    Reading Shakespeare, Neitzshe and Proust, watching Battleship Potempkin and Citizen Kane, listening to Beethoven and the Beatles, and playing Elite, then complaining about the state of modern media makes you look stupid. It makes you look like you've not formed any opinions on your own.

    ps. Shakespeare is about as mainstream as it is possible to be.

    Maybe in the cosmetic or "luxury" or "brand name" (e.g. Lasik) healthcare they do.

    In the US, I had the feeling that the healthcare system charges so much just to survive spurious litigation. Doctors and hospitals don't necessarily need to charge as much as they do for the actual care itself. I think a significant portion ends up in a legal defense fund somewhere.
