    Before the iPhone was first unveiled(January 2007) there was a phone (LG Prada) that actually did look a lot like an iPhone

    LG Electronics has claimed the iPhone's design was copied from the LG Prada. Woo-Young Kwak, head of LG Mobile Handset R&D Center, said at a press conference, “We consider that Apple copied the Prada phone after the design was unveiled when it was presented in the iF Design Award and won the prize in September 2006.”[8]

    Note: While the LG Prada was not released until after the iPhone, the design and concept were released before we saw any of this from Apple.

    Becuase the problems of Somalia have a lot more to do with the land, resources, general instability of the region, and mostly their history (You don't go from being an incredibly poor country to a fully developed one overnight)

    Also Somalia hasn't had a centeral government in over 10 years. some parts of the country(Somaliland) are well governed, fairly stable, and actually doing quite well considering the region they are in.

    You're thinking of civil contempt vs criminal contempt - which does not depend on whether the case is a civil case or a criminal one.

    Civil Contempt is used used to get you to comply with a court order (such as reveal the password). This is for an indefinate period until either you comply with the order (reveal password) or a judge decides to let you free.

    Criminal Contempt is a punishment for something you have done (Generally interfereing with the courtroom process, which could be anything from repeatedly yelling in court to trying to bribe jurors.) this has a set time before sentencing

    this would be civil contempt

    22. When a file is being uploaded to Megaupload.com, the Conspiracy’s automatedsystem calculates a unique identifier for the file (called a “MD5 hash”) that is generated using amathematical algorithm. If, after the MD5 hash calculation, the system determines that theuploading file already exists on a server controlled by the Mega Conspiracy, Megaupload.comdoes not reproduce a second copy of the file on that server. Instead, the system provides a newand unique URL link to the new user that is pointed to the original file already present on theserver. If there is more than one URL link to a file, then any attempt by the copyright holder toterminate access to the file using the Abuse Tool or other DMCA takedown request will failbecause the additional access links will continue to be available.

    23.The infringing copy of the copyrighted work, therefore, remains on theConspiracy’s systems (and accessible to at least one member of the public) as long as a single link remains unknown to the copyright holder. The Conspiracy’s internal reference databasetracks the links that have been generated by the system, but duplicative links to infringingmaterials are neither disclosed to copyright holders, nor are they automatically deleted when acopyright holder either uses the Abuse Tool or makes a standard DMCA copyright infringementtakedown request. During the course of the Conspiracy, the Mega Conspiracy has receivedmany millions of requests (through the Abuse Tool and otherwise) to remove infringing copiesof copyrighted works and yet the Conspiracy has, at best, only deleted the particular URL of which the copyright holder complained, and purposefully left the actual infringing copy of thecopyrighted work on the Mega Conspiracy-controlled server and any other access linkscompletely intact.

    24. In addition to copyrighted files, other types of illicit content have been uploadedonto the Megaupload.com servers, including child pornography and terrorism propagandavideos. Members of the Conspiracy have indicated to each other that they can automaticallyidentify and delete such materials on all of their servers by calculating MD5 hash values of known child pornography or other illicit content, searching the system for these values, andeliminating them; in fact, such files with matching hash values have been deleted from the MegaConspiracy’s servers. Members of the Mega Conspiracy have failed to implement a similarprogram to actually delete or terminate access to copyright infringing content.

    25. On or about June 24, 2010, members of the Mega Conspiracy were informed,pursuant to a criminal search warrant from the U.S. District Court for the Eastern District of Virginia, that thirty-nine infringing copies of copyrighted motion pictures were present on theirleased servers at Carpathia Hosting, a hosting company headquartered in the Eastern District of Virginia. A member of the Mega Conspiracy informed several of his co-conspirators at that time that he located the named files using internal searches of their systems. As of November 18,2011, more than a year later, thirty-six of the thirty-nine infringing motion pictures were stillbeing stored on the servers controlled by the Mega Conspiracy

    if you're particularly lazy just read 22 and 25.

    although none of this is proof of anything i would assume the had evidence to back this up.

    there's other stuff in there regarding their business model about how they profit of files but there's a lot of it. and it's all advertising/subscription based and would also cover legitimate files. so no single dollar would come from infringing files alone (according to indictment their advertising is sold at an upfront cost not a per click/view basis)

    there are 4 scenarios(that i can think of) that are relevant to this situation.

    1. Person A purchases a new game. They re-sell games or trade old games for a new one.
            - There are more new sales to this person in a system with used game sales due to them having more disposable income that they assign to purchasing games. ignoring what happens to the games he trades in or re-sells there is a positive effect on new game sales

    2. Person A doesnt trade in old games for newer games, and doesn't really re-sell them. they are short on cash or just clearing up space and decide they might as well sell their old games they dont play.
          - this increases the pool of used games with no new sales (if they were to use this money to buy new games they should really be in category 1)

    3. Person B goes into a purchase a game and when offered a used copy at 10% discount he opts for that.
          - There are less new sales to this type of person as they may just buy the used game over the new game. ignoring purchasing decisions of the games before they were originally returned this has a negative effect on new game sales.

    4. Person B has $X they like to spend on games a month. they generally look in the used games bin because they are cheaper.
          - this has a negative effect on new game sales.

    Your economic theory on used games and their effect on the new games market seems to only take into account Scenario 1.
    I'm not trying to argue that publishers deserve these extra sales. I dont plan on doing the reasearch to figure out the net effect of all these scenarios. but you'r argument that used game sales does not hurt publishers is weak and most likely incorrect.

    Like it or not, advertising is the primary way websites fund themselves, and punishing all of them instead of targeting specific misbehavior (like Flash advertisements that destroy usability of a site or consume lots of system resources, or ad networks that track cross-site) they decide to cut off all advertisements for all sites.

    Yes, that's how it works. I don't want to see any advertisements, ever. EVER.

    Myself, I block ads selectively when they disrupt the usability of a site in one way or another.

    that's just how it is with all designer products. some people really care a lot about labels and owning products/clothing from said labels fills them with joy and they are perfectly happy to pay a higher price for the same product without the label.
