I did the "clean" upgrade option (which basically puts all existing windows folders into a .OLD folder). At the time the download from digital river could not be made into an ISO and burned to a DVD to do the 100% format and reinstall. The workaround for this came out after I had everything up and going.

However the fact the issue came up as soon as the 11/25 patches came out is a sign those patches broke a lot more then just the black screen issue.

As an owner of an unmodded 360 who is a paying customer for live I appreciate and applaud this move since other people like to mod their boxes for making online experience worse for others (i.e cheating).

As for the prorated refund do they have any legal reason to do so? I've seen many places state if you get kicked out (bars, amusement parks, etc.) if you get kicked out you get no refunds.

Let us assume that OS becomes rock hard and no malware can infect the machine then what will most likely happen is malware writers will just write stuff to destroy users data. The date (photos, docs, etc) is the valuable part of the machine to them and losing that (for most) would be devastating.

Of course if more users move to an online application/doc repository (i.e google docs, MS live, whatever) then the potential damage malware might be redeuced to near zero (assuming the OS is hard as a rock so it can't capture key strokes and log into online applications/repository).
