They put the freq and power setup logic in the driver because it's simpler, and more flexible, and easier to change (like, in France they only recently freed some channels for WiFi that was used by the army) or adapt to other countries. Well some do claim to have OSS drivers, even under GPL: http://www.linuxdevices.com/news/NS548876786 9.html , however their "driver" is only a stub to load a closedsource module, and I even wonder if they don't break the GPL by releasing a closed source driver under it.
Those were _presentations_, that is run by yellowTAB, not by an independant *g* journalist.

Why, oh why are they always trying to take away our freedom ? Why do they always want to deny us fair use ? Why do they want us to stop pirating when they make billions and don't redistributes half to artists and even only to the big ones, those who wouldn't need that much, and never to those many awesome artists that majors don't even care about ???

I have my main mail account @ISP1. I connect to Internet at ISP2. ISP1 doesn't want to send mail comming from ISP2, and ISP2doesn't want to relay mail with a From:@ISP1.
We all heard about the "legacy-free PC" concepts from wintel, or how to dump functionnal, documented and supported ports such as RS232 and centronics from the PC in favour of supposedly newer and incompatible, undocumented, licenced (= $$), patent-encumbered ports (USB, but also this "debug" connector which will take some years to be itself debugged and which you don't know how to wire a vt100 on). Now what I would call legacy is really this TCPA thingy...
So the question is: Will you provide legacy-free BIOSes to custommers who ask/need them ? (That is the version without TCPA) Will this version be available directly to customer at shops ? or will we have to ask you for a replacement flash file ??
Will we even be able to flash our own (and owned !) BIOS ??? (and flash it again with the TCPA-enabled once we want it without loosing any signature ?)
Finally put in a simpler way will we still be able to _own_ the things we buy ???

This thing already exists, it has a command line, and all drivers available as forth modules to be used directly by the OS... and that's called OpenFirmware. Macs use it, Sun stations use it... But of course PC makers are to tied up to obscure and featureless BIOS.
Will you opensource your BIOS so _we_ (so-called users of trusted BIOS) will be able to verify that your product doesn't harm our privacy or infridge our legally own rights (whichever country we come from) ? So that WE can trust YOU ?
Btw, now that I've ported ffmpeg and it supports WMA (the only FreeSoftware and OpenSource WMA decoder, no more DLL hack:)), well I have one less reason to boot windoze from time to time:) And there is even a port of mplayer comming along nicely. Oh, and I ported XEmacs, so you really don't need anything else =)))
As far as I'm concerned, I used Linux for some time, then I switched to BeOS one year ago, and since then I use it for 95% of the time. It does all I need, and it just works. It's really nice for desktops... And to shut the mouth os those who'll ask "BeOS ? Mouaahh it's dead": it's far from dead.
