    1. What's all this talk in the article about DeCSS being used to copy DVDs over the internet? I thought the CSS prevented you from copying from DVD to VHS.

CSS is the Content Scrambeling System. It is an encryption that is used on the raw video/audio on the DVD to prevent reading the data. You can still copy the encrypted video/audio data byte for byte from the DVD. It has nothing to do with VHS copying.

    2. From the article: "The First Amendment also protects a process called reverse-engineering, which was used to create DeCSS. Reverse engineers take things apart in order to learn how to put them back together in a better form. In other words, to build a better mousetrap. The right to take things apart--whether breakfast cereals or pharmaceutical compounds--is a time-honored tenet in American law, held to encourage innovation."

Is that true? Is reverse engineering part of the First Amendment?? Isn't it covered under patent law? Aren't we talking about copyright law? And isn't reverse engineering only protected for purposes of interoperability?

Well it is protected. You can take stuff apart to see how it works. It wasn't a movie that was taken apart. It was the software, specifically the player, that is used to decrypt the data on the DVD to get the keys. There would not be different brands of cars if reverse engineering was illegal. There would not be generic drugs in the pharmacy if it were illegal. Mac users would not be able to play PlayStation games if it were illegal.

It was found that home users making archived digital copies were legal as fair use and an amendment was added to the law. The RIAA web site has not come to terms with that yet. Remember there was a lot of bru-ha-ha about this a little bit over a year ago when the record industry was trying to ban the MP3 format and this was the result.

At a seminar on e-commerce and the Digital Millennium Copyright Act at Yale University this week, Gregory P. Goeckner, vice president and deputy general counsel of the MPAA, said that DeCSS greatly increased the threat of movie piracy on the Internet.

I took this from the article linked to. DeCSS does not increase the threat of movie piracy and here is why. DeCSS is being argued that you can copy a movie onto your hard drive and thus can post it on the internet. You can get an MPEG-2 of a DVD movie from some of the players that are on Windows. If all you wanted to do was post an MPEG-2 you could either set up a huge buffer for the movie in the player or use on of the utilities out there taking advantage of the player. In fact most would see it as more of a pain in the ass to compile DeCSS then to just use the tools already out there. That nulls the comment above because if DeCSS is a tool for piracy it is nothing more then a redundancy.

I am not saying that to justify getting MP3's that you haven't paid for, as in buying the CD or if it ever becomes avaliable, paying for the download. Downloading MP3's illegally if it hurts anyone, it is the RIAA. Metallica has a pretty loyal fan base. If they sold MP3's over a websight, they could easily pull in millions. If they sold 3 or 4 never before heard tunes on MP3 on a website for fans to pay for, selling them for $.25 each, assuming that 4 million fans pay(which is very doable considering their sales) they would get $3 million just from that alone. For just 3 songs! For 4 million sales of their album how much do they see after the RIAA takes their cut?

Power Computing in Round Rock Texas was making the Mac clones and they were doing well. People were buying. They had record profits. The same for some of the other ones. When Power Computing was getting bigger Apple saw that the clone makers were taking a piece of their market. Rather then competing and letting the platform mature, Apple then stopped licensing the MacOS to the clone makers. This resulted in them losing almost all sales because machines preloaded with the MacOS was 99% of their business. This is the reason why I hate Apple.
