VNC will work on any graphical system, Windows, X, And most others.... that's the point it is *not* tied to X and so can be universal
The X approach is wrong (for various reasons)
- But X is simple enough that it's inadequacies can be worked around Windows is wrong (for various other reasons)
- But this is Windows so there is no way to work around it's inadequacies...

Since they only count public downloads they are undercounting.......there are many other ways of copying a game, any many private torrents etc that are not counted
But saying that many downloads do not result in a pirated copy, and most pirated copies would never be bought...(many are using it as try before you buy)
Any case would be trying to prove he used protected information illegally or actually hacked an ATM for gain........he can't be prosecuted for publishing known information (freedom of the press)
Most People without jailbroken phones won't bother because your app is not recommended by friends and they cannot try it...

If your CPU is not at 100% then the lag is not due to the CPU
