You leave out the fact that many web devs work under ridiculous constraints put upon by end clients including tight deadlines as well as technically poor choices "because it looks good" or because they refuse to try to understand the benefits of good technical designs. Many end clients want everything for cheap and done yesterday! In the end web devs have the skills to develop for most circumstances but are not given the appropriate time or resources to do so.

IANAL but if you choose to be part of an agreement wherein the other party has more power in altering the agreement due to specific language, that can really not be nullified by the courts. It may not be ethical but it sure can be legal.

This is not really that strange or without precedent. There are many TV shows that have not been released to DVD, Bluray, or digital release because of one or more songs used in the show that were not explicitly given permission to be released in other formats. Some of these series will never be re-released in these formats because the cost of buying permission is prohibitive.

That's simply not true. What about when I travel by bus or plane where there is no Internet connection but my friend and I both have our laptops? What about when I was injured and hung out in the ski lodge playing LAN games with friends who were taking a breather? What if you are on vacation in a place where Internet access is too slow or simply not accessible like a hotel room or out in the desert 4-wheeling or staying in a cabin on vacation and you want to play some LAN Starcraft II before going to sleep? There are plenty of places where you would want this feature.

I read an interesting take on the news in a comment on Robert X. Cringely's latest update about this:

I’ve read some postings by engineers with the Ares project that suggest it’s something of a boondoggle. They claim important engineering decisions were made according to some political agenda. What congressional districts benefit the most from NASA projects? The cynic in me thinks that certain congressmen, senators or bureaucrats have fallen out of favor with the White House. My point is: money is power in Washington. There is more to this decision than lack of vision. Money has stopped flowing, the result: some politico is less likely to be reelected/reappointed/promoted. I wonder who? There’s an interesting story in there somewhere.

The problem with this theory is that it presumes causation. A macroeconomic environment the size of the United States is complicated to say the least. Thus it's near impossible to state with certainty that policies passed and implemented during one administration account for economic booms during that same time period. The boom or bust that occurs during any particular administration could just as easily be attributed to policies that were enacted years before. Reagan's policies could have influenced and even been a main contributing element in the boom that Clinton policies were credited with.

This can be seen in the current economic debacle. Although it fell apart under Bush II's watch, that administration had inherited problems ignored or exacerbated by the Clinton administration and maybe even Bush I. It's simply too complicated an issue to attribute success or failure to 4-8 years of voting for programs, implementing them completely in that time, and seeing the fruit of the effects.

Who says all people were passive recipients in their education? Moreover, there are resources to guide one in establishing a decent pedagogy. As a former elementary and secondary teacher in training, I know this to be the case. Many adults are quite capable of supplying their children with a well rounded and complete education. I'm not saying this applies to everyone who claims this to be true, but surely you cannot in turn apply your argument to all cases. Some parents have to ability to handle the responsibility and thus there should not be a blanket ban against it.

Just as Christian fundamentalism should not seek to dictate the lives of others, neither should humanist/academic fundamentalism do in kind.

In high school (secondary) did you ever sit in class and realize that listening to the teacher was a mistake and you were better off simply using the textbook to learn for yourself? Did you ever listen in anguish as the instructor taught the students something that you knew to be fundamentally incorrect? Did you do this in college? I know I had moments like this. Lacking some government certification does not necessarily mean that parents cannot perform at an equal or superior level than so-called experts in the school system. Many involved homeschooling parents are humble and intelligent to pick up a book for themselves, spending time and resources, and teach their children in a complete and responsible manner. Being a passenger in an airplane doesn't make you a pilot but learning to fly a plane does. The pioneers of aviation didn't need some certification to be smart enough to do that. Parents smart enough to educate their own children shouldn't be castigated for being above the cut.
