    I agree with nearly everything you said, however... Apple did not compare it's mark to Windows. The /. headline did. Apple's response included a line saying that MS should understand the topic of trademarks because they have worked so much defending their mark Windows. Now, where we disagree is if the term "App Store" is generic or not. And that is what will ultimately what we will need a ruling on.

    I'm not arguing nor agreeing with that logic. I'm saying Apple's response does not present that logic.

    nope, they have it. It's very tricky to enforce though. X Windows is fine Lindows is not. see their own site; ie; http://www.microsoft.com/about/legal/en/us/IntellectualProperty/Trademarks/Usage/Windows.aspx "Windows is a registered trademark of Microsoft Corporation in the United States and other countries."

    That isn't their point at all. Their point was that MS knows the dispute is BS because they have gone to GREAT lengths to try and protect "Windows." MS's cases ARE the legal precedent for why Apple feels it will this.

I expect my phone to wake up with me Friday morning, go camping me Friday and Saturday night, and still have enough charge for the alarm to wake me up Monday morning for work if I forget to get it on the charger Sunday night. This 4 hour battery time BS Droids seem happy with is ridiculous.

    A lot of people on here mistakenly seem to think shareholders own the company. You are wrong. Any people with with $343.44 + commission has the same "ownership" of Apple I do or any other share holder does, (none.) In most companies a holder of a substantial amount of stock has some pull simply because they can threaten to sell their 15-20% which would drive the stock price down significantly. I don't really see Apple caring about this. It is possible to take over a company buy a large amount of stock so that you can get a majority rule at the stock holder's meeting and then replace the board, a hostile take over, but again, I do not see Apple caring about this. So, whatever Apple decides to do about this "push hard for succession plan" it will simply be a goodwill gesture.

    yes. If the in-app purchased content is also advabile outside of iOS it must the same amount in either place.

    there app would be banned from the iTunes for again failing to follow the rules. However, one idea I've heard, that they *might* beable to get away with would be to raise ALL the prices %30, or whatever, then on the website put a bottom right below it to get a %30 discount. I imagine Kindle's revenue would higher to simply let Apple process in-app purchases, considering thing like impulse buys, credit card merchant fee, the cost of running a VISA/MasterCard complaint payment system, hosting costs, traffic costs, etc....

    reply, fail. sorry wrong. In-app purchasing can not be used for tangible product. We are only talking about content purchased in-app. ebay, Amazon, newegg are all unaffected. Before you start the netflix/hulu argument, you can not sign-up for netflix using the netflix app, so, no, that doesn't fall under this under. Only in-app purchases for things that extend or enhance the original app.

    The rules are clear. If the same in-app content is purchasable outside of your iOS app it must the same price as inside.

    Fuel per / fixed mileage is much more easily understandable. You drive the same distance regardless of the MPG of your vehicle, only the amount of fuel you buy changes. IE, say I drive 10,000 miles per year. I am comparing a car that burns 3.3 gallons per 100 miles to a car that burns 4 gallon per 100 miles. I can easily see the math of .7 x 100; I'd buy an addition 70 gallons a year with the lower mpg car. Looking at a figures 25mpg and 30mpg make it very difficult to understand real world implications.

    I've never had ports swap names on a reboot, but I have seen it after a kernel upgrade. I've seem Mac servers with small tree cards also do it after an OS upgrade.

    I think this could actually be a good thing. Lets figure out exactly what ISP should retain and what would be available for law enforcement with and which without a warrant. For example, I do not have a problem with ISP keeping track of what subscriber had what IP address for the last two years. However, I find requiring an ISP to keep a copy of my IMs or browsing history without a signed warrant simply unacceptable. If we could come to something reasonable this data would not be unreasonably large. Users with DSL/cable often have a simi-static IP anyway now.. We'd also set terms so after, (lets say two years,) an ISP would purge the data for fear of being sued for privacy invasion.
