Whenever religion rears it *UGLY* head everyone runs for cover and poor EBAY would be out on a limb. I actually feel a little sorry for EBAY(in this instance only) they are in a truly no win situation. First off I don't think I would never ask a person for an example of their code. Having said that there are questions you can ask about certain languages that will show rather well if the applicant is proficient. If the person is a good story teller just let him/her run with it and then ask specifics. That usually cuts the weed from the chaff. If you are well versed let the person tell you a story on how they solved a really difficult problem. That will tell you a lot about the candidate and their problem solving abilities. You can also get a chance to hear a BS story (if they aren't qualified) and then you know instantly if they are qualified or not.
I think you are comparing apple to oranges here. I believe that that the Telco's don't want to be held responsible for an obviously illegal act. This is their attempt to say "I am safe from any lawsuits that *MIGHT* occur from this law(questionable). You do not give "FUTURE" immunity from your example. You are giving immunity for past crimes. In the FISA law that is the worst possible thing to do because this essentially gives a free get out of jail card to the telcos for *ANYTHING* that may happen in the future. They shed the great employees in the 1990's and IBM will never be the same. We used to be able to trust IBM to look out for us (customers) not anymore. Not anymore it is a 1-800 call to order almost anything. The mainframes were the mainstay of IBM and those cost several million dollars. The "sales man" was the go getter for the team. Now its lucky you see any IBM types in weeks (sometimes more). Our IBMer (now retired) always got the biggest orders in his region as he worked the real people who did the ordering. Not anymore you call the 1-800 number sigh.
If you need IBM help on software issues you either call 1-800 or create a PMR online. IBM is (and has been) shedding people to the take care of customers. The IBMers no longer service the customers they serve themselves.

Oh but its encrypted... hmmm there is a "secret" front door code that HS or FBI or you name it can bypass. I do NOT trust the current republican Fascists just look at the water boarding incidents. Bottom line is that you cannot trust them so they must be stopped before this can become the "norm". Vote against any congress/Senator who voted for the Patriot Act.

As you may recall there was a merger (take over) between AOL and Time INC a few years ago. AOL argued that their mail servers were better than the mail servers that Time was using and in a cost saving moment Time agreed to use the AOL mail server code. It was a *TOTAL* disaster response time was in minutes and eventually the Time Inc servers went back to their original software.
This indicates to me that when it comes to *REAL* corporate environment The servers (LIKE AOL's) don't hold a real candle to real life.
This is exactly what will happen, IMO to YAHOO if MS takes over. I have already started to move my 20+ YAHOO groups over to Google mail.
Your right on in this. BUT here is (what maybe a side issue). At one time the White house used VM (IBM's OS) as its email system (I do NOT know if this is still done). *IF* this is still being done then recovery is close to being impossible. I knew the IBM rep that was "there" during the Nixon administration and he worked quite hard to get the emails back and I believe he was marginally successful in some cases but generally was unsuccessful. You are 100 percent right about back up though. *IF* an email system is *NOT* being backed up (it most likely wasn't because of legal/political issues like this). Then the data is GONE. Fire the IT department for not having backups (unless it was done for legal/political issues).

I am extremely livid with the Bush administration and they are above the law attitude. Its no different (until the Supreme Court said differently) that allowing some states to let them observe segregation. Its similar but a different concept. The founding fathers had no idea what it would lead to, I would have hoped they would have had better fore sight. Its taken the court system 200+ years to catch on to what is fair and what isn't. Usually any state that has minimal (or no) state taxes has been basically run by the corporations. Is this fair? Not really as the people "own" the state not the corporations. The corporations are always crying fowl on almost any tax, so do the average citizens. The corporations are the ones that hire the lobbyists if we had politicians that really represented the people this type of tax exemption(or minimal taxation) for corporations would not occur. Its easy to blame it on the politicians as they veil everything either in secrecy or in legalese and the poor tax payer is left out in the cold. Should the corporations be allowed to hire politicians and lobbyists I would say no as they present an unfair "balance" to a politician. On the other hand corporations do have a legitimate need to present their case(s). I cannot think of a reasonable alternative though as there will always be a fine line what a corporation wants to the needs of the average joe citizen. One option though is to really enforce the rule of *NO MONEY* (hard or soft) can be given to any politician or elected person. That rule has to be really enforced and *STIFF* fines need to be levied and jail terms that are not club fed.
One option is to enforce a minimum tax on Corporations that operate across state lines do it as a federal tax and have a separate fund for disbursement be set up to return the proceeds back to the states where the corporate HQ resides. If a corporation send jobs out of the country then a tax fund be set up and the money be paid into US IRS. If an 'non-cost' center is moved overseas (or is formed) then a tax per person needs to be paid back to the US.
This is a step in the right direction, of course if a corporation does business in the US then it should be taxed at the US based corporate rate. There is not a universal answer. But until all corporations are equably tax this state issue will always be with us.
I rarely get any real email at YAHOO and even if I report it as spam the same companies just keep on with the spam. I somehow think they pay YAHOO extra to get past the SPAM filters. It will even be worse with MS in charge. I think this is why YAHOO makes so much money (not compared to MS) but still a nice chunk. I am also guessing that MS MESSENGER will also be the only way to communicate. If they do that will kill all the MAC users as well.
This story has caught my attention. I am an owner of over 30 YAHOO groups. If MS is successful in their bid quite a few of the YAHOO groups will be moved over to Google. Yahoo is bad enough with all their service interruptions but throw in MS and it will be all men overboard abandon ships. I certainly hope this does not happen. YAHOO for all its faults could not be any worse than MS and its total screw ups. Its gotten so bad at MSN that people are leaving that in droves to come over to Google and YAHOO. Yahoo for years has been selling email addresses and or sending out emails on clients behalf. Approximately 90 percent of the email I receive on YAHOO is SPAM. YAHOO spam filter don't work as I have been getting email from the same company for over 2 years and even though I tell YAHOO its spam it still gets through. Apple's email program is decent so is just about every non MS agent out there is decent at filtering out spam. Except for YAHOO's. I will leave YAHOO if this goes through.
