I completely disagree. It should have been noted from the start that any membership in any group that in anyway relates (positively or negatively to the defense) to the case should be immediate grounds for dismissal. I also think this is a blatant failure of the defendant's lawyers to not scream bloody murder in regards to his affiliation with any group having to do with copywrite.
Imagine if you will, facing a judge in a murder trial who is not only pro-death penalty but also part of a group that is trying to advance that idea. Imagine also that the judge's membership in that group is also tied into the thought that all accusation of murder is considered guilt upon conjecture of the defendant being tried for said murder (which could be construed as correlating if this judge found copyright to be soo horrible that he joined a group to fight pirates). I'm pretty sure that allowing an obviously biased judge in a case like this is a grave injustice to the defendants and they should be allowed a re-trial based solely on the judge's bias.
Ethical Hackers Against Pedophelia Great group of kids helping fight against child porn, lot of talented "hackers" involved for that time period...and ya know what........they were considered outlaw vigilantes. SO I ask, what kind of authority is a government going to be willing to give to a "hacker". Especially in light of the fact that any non-technical politician isn't going to know the difference between Black, White, and Gray hat hackers.
I meant that as more of a general admonishment, and not directed at you in any form. I merely hope that people of a like mind, would concur, and potentially figure out a way to get that ball rolling, and find a way to spread the word, I throw the idea out there mostly because I have no idea how to get it going myself, thus posting here, where we have thousands of extremely intelligent, creative people, one of whom may see one of those posts and go "ZOMG! I know how to do that" and "Bam!" you got yourself some RIAA roasting on a spit.
Your efforts are more than commendable good sir, and are also more than a lot of people are willing to bear. I think you're doing a helluva good job, just trying to get others to help find a way to do this things in another way, so we can nail those RI-tards to the wall.
My point in making that comment was to get people thinking on their definitions of "news worthy" The only reason I even brought that part of it up is because (for reasons even I don't know so I shouldn't expect anyone else to) I've been p1ssy about that lately.
I only can correct you in the assumption that I think "we'll never get anywhere". Obviously we have, because we've drawn their ire, unfortunetly in the form of litigation. I just have a hard time listening to people dream big without any true plan on how to live those dreams. I think that we're making progress in this venture daily, however, I feel that taking a different tack on this could work to benefit our cause further. In that regard, I advocate trying to make more people see the light of our understanding of those(RIAA) people's evil. I also try to point out that though/. has a significant amount of traffic, we are a niche of a much larger collection called America (and others of course) and without the other 99.9% of our population, attacking corporation sponsored evil, that is hell bent on raping our rights, doesn't get us very far.
I meant you, nor anyone no disrespect (Ghost Dog....frickin Forest Whittaker as a Samurai....awesome) and I as well was...and in quite a few ways still am a "noob". Hell I just recently learned about Ubuntu, which I had never heard of before Slashdot (/ducks) and am now considering a dual boot system at home so the wifey (yes beleive it or not I am married, and no I don't need to inflate her) can still boot Winblowz, and I can run off Ubuntu which I never would have thought to do without the information I garnered here. I appreciate your candor in that response and am fully aware that I am contradicting myself to an extent here, however I gotta have something to do while I'm working my late night here in lonely ole' IT Support, so I posted my internal rant
I hope people find your comment insightful, and if I had MOD points, I'd hit ya up,(and if I hadn't commented here already....which kinda makes that point moot but whatever)
I'm not saying I don't agree with the message getting across, however with the amount of resources they have to bear, we may be "biting hard" to use my own analogy, but what is it truly accomplishing? They are still a factor, they still have money and influence, and they still have the ability to do stupid, assinine things like this without any true reprisal.
I am proud of the work that you do good sir, and wish you and the FSF the best of luck in everything you do, I just think that shifting the focus in this campaign towards true information dissemination, in a sense of making it more accessible and understandable to the masses, would be beneficial in a sense of passing on the outrage these morons perpetuate into the public realm, by educating people on just WHY this is wrong and evil. I think if you get the public more aware of this matter, and more involved in the vocalisation of their anger towards these fools trying to steal our rights, then you create a self sustaining constituency of supporters who will add their voice to ours in seeking the downfall of the RIAA and their associated ilk, not to mention garnering more people and more voices in relation to Congress in letting their reps know just how much they hate the idea of the DMCA and the existance of the RIAA may help in having more legislation enacted to reverse or at least amend these ignorant laws.
The only thing newsworthy I got from this is that the RIAA is just slightly more petty than I thought. Of course the Free Software Foundation is about making software "FREE", and of course, anyone with a blog aimed at bringing to light the RIAA's idiocy is going to be the target of their Ire. The thing people need to get over, and real quick, is the thought that the second they see anywhere in media the acronym RIAA, that they need to immediately post it on Slashdot.
We also need to realize, as a whole, that the RIAA hates us as much as we hate them, and we also need to note that the RIAA is a litigous bunch of pr1cks and that they will bring DMCA takedown notices, and law suits, and anything their multi-million dollar legal team can come up with against anyone who thinks differently than they do. The thing is, they have this crazy thing called MONEY backing them. When you have a band like Metallica, or Universal Studios supporting your cause, you can then afford frivolous lawsuits and such because money is no object
What we need, to effectively fight back against their idiocy, is SUPPORTERS. Find some corporation (good luck) that shares our ideals, or even a political movement. Then get them to help with the money to cover the expenses of all these court proceedings, offer legal support to the unfortunate few that get randomly targeted by the RIAA (like the ACLU does) and find someone to help us get some lobbying going in Washington.
Those are the things we need to do, or maybe even get some of us geeks to inundate media with easily comprehended information that average Joe blow can read and care about, and help spread the word to the masses about their evils. Find a way to make the average citizen give a crap about this issue, and you've found a way to get some money and influence behind this issue on a side that is NOT the RIAA. But until then, we'll always be a flea, biting the back of the Mammoth that is Industrialized politics at work.
I meant it more as a joke. I think it's truly hard to debate something like this until it is more thoroughly fleshed out in the courts and the legislature. Once things become more defined, and boundaries on how they mean it are set, then I think we can have a more informed decision on if this is just another blue law, or if it's something to be up in arms about.
With the way people in this country have become so litigous, I don't blame them for getting something on the books early regarding this issue, since I'd rather not have people conducting their own hybrid experiments in MY town, and Having to fight off ManBearPig (again).
At least this is better than some of the random blue laws on the books that you see, especially in some Southern and Mid-Western states. Things like, It is illegal to ride your Donkey down a state maintained road unless traveling at the proper speed limit
How would you enforce that policy? A 3 strike policy before RDAs or something? probably not.
You have to look at the industry to be able to properly view this kind of question because in the end, as all of us know, IT can only do so much to influence the users we support. And lemme tell ya, we tried a Power Down policy here, and in this industry we don't get the most technical people for users, so people were hibernating their PCs, or rebooting, some just turning off their monitors et.al
Not only that, but once it was realized it wasn't working, my first question came about. What do we do to punish users who don't power down? Can you imagine the HR nightmare that would spawn from someone getting disciplined over powering down? (And no I don't think that is "OK", just the reality of the situation".
It's sad that businesses not only don't seem to care about cost saving measures, but also don't prop people up when they FIND those cost savings for them......innovation is dying because no one is nurturing it
OK, My money has been taken out of my check, automatically, without my permission, and being used to pay for services I will never be able to benefit from. I then pay MORE taxes, to even more agencies for infrastructure maintenance that I have no say over what gets fixed, or when. THEN I get to pay even more taxes on the goods I purchase with what little money I have left after all those previous taxes, and now they've found ANOTHER whole new way to tax me.
I understand the whole "taxation without representation" thing, but this is getting as bad. Why am I paying into programs that, because I'm 27, will never be able to use because they'll be long bankrupt by the time I'm old enough to benefit from them?
Also, how are they going to dictate who gets this tax, and how is it reported? and what do they do in an international purchase? Will I have to pay tariffs for items purchased overseas? Will they charge me another tax, to pay for the foundation of this new taxation system?
America is going tooooo far with what is expected of it's citizens to pay already!!! We've somehow now become endebited to the banks, because we'll get stuck paying for the bailout. Though it would have been CHEAPER to just hand every American Citizen over 10 Million dollars a piece. We're seeing record highs in unemployment across the board, it is becoming more and more frequent that companies are cutting cost of living increases and merit wage increases, not to mention bonuses, 401k matches, etc.
How do they expect us to now pay MORE with LESS? It's incredible that people are ignorant enough to think that it is somehow OK in this nasty economic climate to impose even MORE cost on normal citizens for something we already can't afford!!!
People will pay more for ANYTHING if you attach a "green" association to it. I would think you could make this endeavor feasible by simply upping the fare so people can ride in a "green" cab. Trust me, not everyone would go for it, but enough people would to justify the change.
Since when has morality had any place in government? I'd ask good ol' Thomas Jefferson that one....maybe he could have one of his children explain the fine art of subtlety to you while you wait.
Also, the only Kool-Aid I drink is from j0 m0mm4:)
I'm just trying to make people see beyond the fact that simply because one small demographic of our nation finds the RIAA reprehensible (which I've never disagreed with) doesn't mean it will make any impact on government policy whatsoever. Your average person, which is Obama's average constituent, doesn't even know what the RIAA is/stands for/fights against. We all are small....and not all that vocal (politically) members of a nation that is either too (pick your favorite slander of Joe Blow American here) fat/lazy/idiotic/slovenly/etc. to care, or, like I said in another post, the people that are intelligent enough to care, also realize that their powers of persuasion could be used in a different realm that may have an impact on more important matters. With our nation tanking in almost every feasible sense, how can you expect people to work themselves into a fine lather over the hiring of a former RIAA lawyer to a government job, while we're watching our children's and grandchildren's futures being stolen from them, and handed to nasty, greedy, filthy pigs, who ran our economy into the ground, and then expected a handout to help them out of their hand dug graves?...........
I think the only way something like this would come as a surprise to anyone would be if a respected company that had no relation to a certain OS made this kind of comment.
I mean did anyone really expect Microsoft to help sell/train/promote their competition?
In light of the completely corrupt and basically un-constitutional regime that we just got out of, how quick are some of you people to forget what has already happened in America? MY god, I read comments like "this decision makes me certain I won't vote for him again!"
Wow, I'm pretty sure for one thing, your one meesly vote doesn't mean sh1t to anyone, Obama in the slightest. And also, if you're so quick to vote whatever idiot the Republicans decide to put up in the next election, than by all means, throw your meaningless vote away to JEB Bush, none of us care.
You think in the grand scheme of things, one position in the Justice Department being given to a former RIAA lawyer means ANYTHING to the grand schemes going through Washington, and the world right now? I'm pretty sure the economy is still tanked, and that there are still American soldiers in battlezones across the globe, not to mention China and Russia, strutting around the world like the old/new SuperPowers they were/almost are.
Bah....I'm ranting a lot today, but you'd think people would have a lot more to worry about in times like these then a man's prior affiliation with a "news on slashdot" generating group. I mean come on, devote 1/10th of your concern of Obama "making a HUGGGE mistake" and focus that energy on how to fix even 1/10th of the REAL problems we have today.....I mean we're all pretty much smart people, so why not have some way to organize through what is essentially a thinktank the size of Maine's population, and put us to some good use, get us discussing things that matter.....which the RIAA, while being very bunk, just doesn't mean a whole h3ll of a lot right now.
I though this sentence: "Likely to span multiple generations and evolutions in culture" really said THIS:"Likely to spam multiple generations and evolutions in culture" and thought to myself, "Now I've got really long range clocks spamming me!?!?!?!?! How many gmail accounts do I need before I get something REAL!
Then I realized exactly how sad that thought really was, and now kinda wish the 10,000 year clock WOULD spam me....just to take up some of those 10,000 lonely years.........:(
I got a comment p0wnd the other day for what I figured would get tagged as flaimbait since it goes against the grain of common concept here at slashdot lately, and got flagged "Redundant", though it wasn't redundant in the slightest, yet THIS P.O.S posts as "News" that is pretty much the same exact issue discussed in the previous thread
YOUR REDUNDANT!
(ahhhh Karma to burn...........sorry for the rant)
Since when has the "nerd" community ever bought into the concept of shunning someone based on their "social" standing as opposed to their talent? I remember being proud of the fact that this community used to think like I did, that talent and skill would always mean more than one's affiliation with a group. I say if this lawyer has talent, and is worthy of the appointment, what does it matter if he did work with the RIAA? Since when have "nerds" thought it was ok to ostricize people?
And I can already hear the replies, "Ohhh the RIAA is evil" and "Wahh the RIAA stolez my MP3's" and "OMG my 3m4cs p0wn the R144!"
Get a grip, if people do their jobs well, they deserve to be recognized, regardless of a minority's stance on the issues that said person was hired to work with.
How in America, we seem to have lost the concept of continously upgrading our own infrastructure? When was the last time anyone can remember a significant (>50 miles) of road being constructed where there was no road before? It seems like we've lost all motivation to make America any better in a sense of infrastructure and I think even this will end up being just talk because A.) The cost alone to offer broadband to the "boonies" will be enormous and B.) the people in "rural" areas, when surveyed, didn't much care about getting broadband internet access, since they all seemed to have the mentality that since they don't have it now, they can't miss it.
Also, do a side by side comparison of our Cellular networking compared to countries like China or Japan. Hell even countries like Ukraine, Italy, Spain, Brazil, etc have better/faster/more efficient Cellular networks then we do in America.
Part of the multi-hundred billion dollar bailout, should have been geared towards updating our infrastructure and had it writtin in a way that would force the construction to begin, before a $ of the bailout reached anyone's hands.
So you're saying that somehow, because YouTube created a format to allow people to share videos of themselves and things they find interesting, they are somehow obligated to allow their patrons to dictate what they do and don't keep up on their site? I want you to know that isn't how business works man. Could you imagine going into a store....say Subway, and telling them that they HAVE to put something back onto their menu that you enjoyed simply because you've used their service (the sandwich) before, and therefore they are obligated to supply you with that same sandwich on your next visit? Even though it costs them more to maintain the ingredients than it does to sell YOU (and the minority of other patrons that enjoy that sandwich) said sub? They would laugh in your face once they realized you were serious
Supply and demand only matters when you are enough of the marketshare to directly impact their business model, and YouTube wouldn't even notice the blip of reduced traffic if everyone that genuinely cares about this issue boycotted them. Instead people in this discussion are actually talking about trying to jack their costs of doing business up in order to have them fight your crusade for you? And you don't think that's wrong?
Use the Subway example again, and say everyone who liked that sandwhich decided to all go to their Subways en masse, and order 2 sandwiches a piece and then refuse to pay for them, thus causing waste across the board. Not only should that be illegal, and the organizer of that effort be brought up on charges, but it is also immoral, because you're genuinely being a selfish little child who is having a tempertantrum over not getting his Special sammich!
People need to grow up and realize that while an ideal may be worth fighting for, you shouldn't punish an entity for not being willing to fight that fight FOR you. IF you want that, create Whinnypantstube.com and generate millions of views, and THEN sack everything you work for in order to appease a small chunk of your users.
That people expect a service that provides easily searchable, accessible, and embeddable content, to fight your crusade for you. Why SHOULD they fight fair use battles if that wasn't their implied mission from square one? I know that if I was the owner/operator of YouTube I'd do everything that I had to do to protect my business from being sued by DMCA happy lawyers.
You also have to keep in mind that crusaders of Fair Use are in the Minority, because your average Joe doesn't even know what the DMCA is or ever even heard of the RIAA, and THAT is the audience a huge site like YouTube is focusing on.
I agree that it sucks, and that the DMCA sucks and is abused, but you can't expect everyone to chance everything to fight something that garners No common interest among the majority of it's users population.
Write em' an e-mail, and gripe to them, just don't expect anything to happen at the speed you'd like to see.
I completely disagree. Dude,
You really wanna eat bacon that was "Grown in a Vat"?
think about that for a minute while you hand in your Man Card for trying to mess with the Divinity that is Bacon!
Which is a hell of a lot more than I am doing.

Then I realized exactly how sad that thought really was, and now kinda wish the 10,000 year clock WOULD spam me....just to take up some of those 10,000 lonely years......... :(
I got a comment p0wnd the other day for what I figured would get tagged as flaimbait since it goes against the grain of common concept here at slashdot lately, and got flagged "Redundant", though it wasn't redundant in the slightest, yet THIS P.O.S posts as "News" that is pretty much the same exact issue discussed in the previous thread
