    The billboards can be and in most places are regulated by the local governments. In many cases, it costs a lot of money to have those signs.

    That is why you never see anyone advertizing Nigerian money scams there.

    These are products designed for e-commerce in which Microsoft and IBM and have millions of patents. If you are licensing this software, you must be covered for patents. You need to check which patents you are already licensing as they may be enough.
    Also, as soon as this firm tries to sue anyone big, their patents will be history.

    If it became cheaper to litigate these matters, it might not be as much of a problem.
    Imagine if all patent litigation was cheap and affordable to all. The odds seem reasonable. If only half are valid, and a small percentage actually apply, this would not be a problem.
    Or, we just need to decide to divide all lawyer's bills by 10 or 100 and encourage them to produce results and not bills.

    It wasn't that long ago Auckland was shutdown without any power and Ansett no longer exists.
    Just let them run Sydney for a while and it will be shut down for free.
    Mind you, if you dug deep enough you could probably find a few Aussies that were in charge of these things also - so it is probably not such a big deal for Sydney anyways.
    Just make sure you find a dodgy accountant to shred all the documents, pay of a few politicians and use white boards for anything you want to hind from FOI. Too easy...

    The problem also lies with those or us that desire the copyright works. If you have no desire for an X-box. How much does the copyright really matter?
    If we can eliminate the attachment or wanting for these corporation's works, their power is as real as the value in a dot gone's stock options.
    Think about it, if your parents wont lend you a car and you never wanted the car from the start it will not affect you that much.

    The salary surveys seem to indicate Programmers cost around AUD$45k to AUD$60k in Brisbane (a little more down south). If you can find any decent programmers in the USA happy to be paid $32k, hire them.
    Australia has a very good university system creating very skilled IT professionals. Even when you add office space, super (Aussie 401(k)), and other costs (total of maybe 40% to 50% extra) it is very reasonable to set up shop here. Many of the large corporations IBM, MS, etc are doing it also.
    Australians also have a similar business mind to Americans and understand basic conepts of fairness and contract law (yes they should be related). You can contract for a job and if things get messed up - it will not cost you a cent in bribe money to get a fair outcome if you need to go to court.
    There is a large time difference but at least the Internet bandwidth is decent and your code and builds should replicate quickly. Phone calls from the USA can cost under 12c/min and Australia's DSL prices compare with the USA so tele-commuting employees may be able to help bring down costs further.

    You said that is our duty to inform ourselves, opt out, etc. etc.
    I don't know where this will end. If we were to actually read every contract, term and condition, update, and other document relating to our $20 phone bill and other contracts, we would not have enough time to live.
    Qwest has a legal team that has nothing better to do to write this stuff.
    If it was a truely equal world, we would be able to negotiate this contract and insert our own terms and conditions. However, this is not possible - is it?
    I am having a real difficulty getting Verizon to expain how they calculate USF. It is not a tax that I have to pay (FCC web site) but it is on my bill and there is no set percentage in the original contract. They have not answered this question and avoid it. Do I have to take them to small claims to get them to explain it? What contract negotiating power do consumers have?

    Other words that come to mind include Drongo, Wanker, Wally, Sepo, and Rubber. In fact, anyone that wants to see African animals roaming Australia should go away. Australia has been damaged enough by foreigners. The native Australians had the right idea (live with the land without destroying it). Everyone else needs to tread lightly.

    I am sure Kerry has good intentions - but please consider the impact on the hosting nation.

    I have already been offered $250 from one telemarketing firm - but I want to go to trial. Also, since I have used the JunkBuster anti-telemarketing script, I am lucky to get any calls at all. The last call was from Qwest on last month - a month after I was sent a letter from one of their lawyers explaining I was on their "do not call list". That call will make me $500 to $1500 when we go to court :)

    The patent mentions "The circular buffer is implemented by a digital memory". To me there is a difference between permanent storage (hard disk) and memory (RAM). The delay when TIVO starts is because it uses the hard disk not RAM.
    If this is the case, then they are using a different mechanism and this patent does not apply. TIVO is much more than a "pause" system.

    But really, it is the same as lending a video to your friend. If this is legal, then sending it via the internet is the same.

    If the law does not allow the video being shared, this will not be allowed. And if anyone is thinking of creating a napster for this, you might want to add a few lawyers into your business plan - right or wrong you will need them.

    I the crawl space under my floor is unusable, the drain system outside is also inadequate, and the wiring is not very usable. I cannot run a simple network cable from my place to a neighbors - that to me is just as bad as any poorly named variable.

    The fact is we do live in poorly designed stuff. Just like you don't need to be a good designer to code, property developers don't need to be good architects to throw together a development.

    I disagree with the whole idea that IT is worse than other professions. Look at the mess lawyers/governments make with the law. Give me a poorly designed goto any day!

    At the end of the day, Dow Jones would have known that the article would end up in Australia. They probably even have Australian subscribers. If they were serious that it was only a US publication, they would not have any Australian customers.
    I doubt very much if an Australian wanted to buy a Dow Jones publication that their sales department would say "sorry - we only publish to the USA".

    After all, if they insist on running buggy software (IIS) and don't take the time to install security patches, this is negligent.

    1. There is a duty to other internet users not to waste their resource (bandwidth);
    2. There has been a breach of this duty (either running IIS or at least not installing patches); and
    3. It has caused damage (used up my valuable bandwidth and log disk space).

    I think we should all take each IIS server owner to small claims court and extract our few dollars of damages.
    That way, it would make more economical sense to run Apache. The server owners will not have to pay for the software or the legal damages that would follow.
