Yes, and the penalities are actually much less for stealing property, if you get caught.

Your analogy is flawed, those are made up words that were trademarked and then became common words. Not common words that were trademarked.

Not just a loss-leader, it's also about control. If MS can control the application that most users browse the Internet with, that gives them a lot of leverage to embrace and extend. They can enforce their own proprietary standards (with IIS and so on), and lock out everyone else.

You're assuming that E-Bay wants to to fix this .. I tend to think that the rules favour sellers by design, since they are the ones paying E-Bay for the auctions.

Good point about going after other P2P apps. I was thinking their main goal is to implement this feature, then lobby to governments to force other P2P apps to follow suite as a way to combat piracy, and collect royalties on the patent at the same time. Win-win for Sony if it would have worked.

Pod and iPod have totally different meanings. I could understand if Apple is worried about people using the term iPod, but Pod is a common word. What's next, Apple trying to stop people from using the word Book since it might be confused with iBook?

Its one thing to have an accidental character in your text, its another to completely mess up the rest of the line.

Sounds like you should be using Microsoft products. Excel and Word will detect your caps lock is on, and turn it off automatically for you. Drives me nuts, since I usually notice it's on after I type the first word, then turn it off, but Word has already turned it off, so I turn it back on, ugh. (and yes, I know you can turn off the autocorrection feature).
