If one's circuitry is by its nature not disrupted by Macrovision, it must be deliberately crippled so it will be.
That would be redundant if your interpretation is correct, since not implementing protection would be circumventing it.
Congress including 1201 (k) specifically indicates that they felt it necessary to specifically mandate that a certain system for protection be made to work.
That would seem to indicate that they felt that non-circumvention does not mean a product is required to implement protection (otherwise, no need for 1201 (k) since not respecting Macrovision would already by illegal).
Legislative intent goes a long way in the courts, so simply ignoring a do-no-copy flag might not be ruled illegal, until Congress passes an equivalent to 1201 (k) which covers such a system, however, a program which unsets that flag would be illegal.
Of course, the court could rule illogically, and you could have a mult-million dollar judgement against you and/or a multi-year prison sentence...
Sad that the FSF had to resort to a lawsuit to get Cisco's attention, to get their compliance act together. But everyone wins in the end.

But it's a safe bet that I'm more secure than any Linux distro out there (which I've proven via a friend who runs Debian, by betting his system would get FUBAR'd before mine after 3 consecutive days of surfing and downloading from some very disreputable sites. His system was tanked in two days, mine never got touched.)

I put the libflashplayer.so in the plugins directory which didn't even exist, and Firefox said it couldn't find any plugins, even though it was in ~/.mozilla/firefox/{bunch of hex} or whatever the profile is. I finally find where the system one is, and get it to see the plugin, and all flash content is silent! No, my soundcard ain't burned out, stereo broken or cables not working. mpg123 works fine!!!! But getting Flash, which is missing from Linux Firefox out of the box working is a pain.
Windows just works, at least up until it started crashing and now fails to boot. But things mostly worked, without tons of unnecessary and useless tweaking (some tweaking is good, this was not).
In Nevada they can forcibly take a blood sample from you, use it against you if high, but still suspend/revoke your license for refusal even though they did obtain it (albeit by force) and even if it is not high (a refusal penalty still holds even if you are not guilty of DUI).
And if/when the software as a service shuts down, goes away, increases prices, and the data is held hostage, temporarily unavailable or lost, how much will THAT cost?
1 year in prison can be very damaging to a person mentally and physically, especially if they are not tough and wise to prison life.

I've never seen flashing yellow on one direction and flashing red on the other.
