    I think that Google may include a claim for libel. Their implication to the methods that they accept is that those methods
    are subject to fraud.

    The next step that should be included is the abandonware should have the product available (or a place from which) to download. Even better, with source code. The concern would be be insuring the integrity of the code from loss or trojans. One step further would be a code escrow for companies that the code would be released when instructed or the company disolved.

    Issues of embedded code would have to be dealt with, but that could be worked into the system.

    GPS input takes out the need for gauges. It can argued that the speedometer is not calibrated, but the police will always testify that their speedometer/radar gun has been calibrated. A GPS can be accurate within .75 mph with no calibration.

    I got stopped for doing 76 in a 75 zone in El Paso.

    Cop: You were going 76 mph.
    Me: No, my GPS said I was going 75.
    Cop: My radar gun is calibrated.
    Me: My GPS uses government satelite signals.
    Cop: The speed limit will be reduced to 65 at sunset.
    Me: I know, my car will tell me when.
    Cop: Be careful.
    Me: Thank you.

    Results: No ticket.

    The next step is to have a built in system. You have the GPS data fed into the 4 images (from each side of the car), that is stored in ram for about 10 minutes while the car is moving. Then when the other car runs the red light, claims the light was green, then claims that you were speeding, you can then save that set of images to prove them wrong. Or, when you get pulled over when the cop says that you were speeding, but you have a record that says you were follong the speed limit.

    These guys can't figure that out. I had a friend take a system to them and misdiagnose as a bad hard drive. It had an obvious damaged windows installation. Geek Squad? Bah....How dare they even use the word.

    They could not figure out that it could be reformated.

    Even the "think tanks" and scientists do not know enough to start tinkering
    with the weather on a large scale. It is not understood fully.

    One of my favorite examples is in 1988. I was called by a recruiter looking for someone with at least 10 years of PC DOS experience. Giving impossible requirements and having a recruiter unable to fill it is another trick.

    If the owner of the dance place knew women were outside saying come on in, and the owners were making money from this, then found out that these women were really mean, then that would be similar to the date sites.

    Back in February, I consulted with a law firm on a dating site fraud case.

    The client sued a dating site because he saw a profile (faked), joined, chatted for 2 hours,
    then "she" gave him a get lost jerk phone number.

    In discovery, the email address given by this "woman" was phony.

    While the dating site is protected under the CDA (see http://www.techlawjournal.com/topstories/2003/2003 0813.asp) and the case was dropped. I can see
    a case against a site for failing to do a basic check of the email address and removal of a phony profile. That by not checking, the dating site gets an unfair benefit from the deceptive information posted -- a person being tricked into paying a fee to contact the person in the fake profile.

    True, the key word is win. Many attorneys will take very little risk -- they want a cookie cutter case a sure win.

    I spoke to a large firm about taking a contingency on a spam case, but they were not set up to work that way. Of couse, after receiving over $250k in judgments this year and collecting over $100k, a partner in the firm took me out to lunch.

    There are somepeople who believe they can handle it as well as an attorney. There are some cases that are on the cutting edge and some attorneys don't like to take chances.

    On contingency cases, attorneys take them because they are likely to win and collect. Not just win.

    No, they lie!

    They advertise "always on", but when there is connection problems, well ... "it's always available." -- you just have to power cycle your modem a couple times a day. And it is up to XXXmb/sec because we don't guarantee it. If you want better service upgrade to business, it is only double the price.
