Actually what's really important is that all the rights in the Canadian charter are limited by this wording:
"The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society."
What reasonable limits are, what demonstrably justified are, etc, are all up to the courts. In the US, your constitutionally protected free speech is supreme. Here, our free speech can be trumped by laws as long as the court feels it's a reasonable restricting. So much for rights, right?

Wouldn't they want to challenge them on it, kick their ass in court, get some good publicity, and in the end have their attorney's fees covered?

It sounds to me what Microsoft would like is to just be handed a huge chunk of Google's market, because they think it's unfair that new services should have to start at the bottom. Except in any business that Microsoft is leading-it's totally fair that new entrants can't get any market share.
Equal opportunity is not flawed... everybody should have the equal *opportunity* to work for Google. Should everybody actually get hired equally? No, absolutely not... that should depend entirely on aptitude, effort, suitability, etc.
But no matter how much education or whatever you give them, some people will try, indefinitely, no matter what you do or say. So it'd be a good idea if the system were set up to make it as hard as possible for them to defraud credit card holders in the first place.
Basically from a security perspective, you've got to layer on as many different kinds of protection as possible. Criminals should be prevented from becoming criminals, the system itself should be more secure, consumers should be more educated and aware... etc.
