It was a search like any other--someone saw something, generating probable cause, which warranted a search. But the search couldn't be completed because the drive was encrypted. After he's been convicted just on the testimony maybe the information can be subpoenaed to investigate others...but I still don't see how you can punish someone for not doing something.
