  1. Re:China as a threat on Playstation 2 Under Export Controls · · Score: 2

One problem with your theory is that the U.S. is the only place China can get it's information from; and that's a very biased view. I think you are confusing the inability of the U.S. govt. to keep *it's* secrets secret, with it's refusal to allow American companies to be competitive in the global market. Yes, they should guard their secrets better; but no, they should not control what U.S. companies can produce, especially if it's already freely available outside the U.S.

Since when have politicians let "unworkable" policy stop them from passing bad laws? If anything, claiming that it is unworkable makes things *worse*, because people will focus on the techical side, not the actual problem!. Focusing on the technical side is like saying the law is O.K. in priciple, but technically not feasible. Please fight this, but fight the real problem, not the symptom.

This is just one more step in the long road to complete govt. control of peoples lives in au. First it was the guns, now it's information. Next, who knows? I'm not sure how books and magazines are treated there in Australia, but seeing as the content will be controlled on their Internet connections, just changing the law to include all media types wouldn't be a big stretch. I hope that this serves as a wake-up call to people in the U.S.A., who currently have protection via the bill of rights, but whose protection is being chipped away every day in the name of safety. I think it was Hume that said "It is not often that liberty (freedom) is lost all at once."

Technically, it's easy. Either put in the timebomb, or you don't get access to the API's to program SDMI. Very similar to what the justice dept. was proposing with the encryption key escrow debate. What they are trying to leverage is the fact that they feel that everyone will have to program for SDMI for market reasons ... and what they have failed to understand is the open source movement programming for more than simply market reasons. That reason, more than any other, is why this will fail.

Yes, but that idea has been perverted since then, and money is not returned to the people individually; rather, it is returned to the states in a lump sum, making it a very big deal to them. That is how the control granted the states by the constitution is wrested from them by the federal govt. And how I got so far off topic! ;-)

  9. Kind of a moot issue ... on State rights v. Patent law · · Score: 1

The (US) federal government doesn't have the right to do alot of the things it does! The 55 mph speed limit, the drinking age set at 21, etc. They don't pass laws about it; they just set _policy_ by witholding tax dollars that have been sent to it by the states. Example: The feds can't set a national speed limit at 55; it's unconstitutional. So what do they do? They raise taxes on citizens, and then refuse to give that money back to the states/people until they set their state speed limit to 55 mph. Voila! Instant national speed limit. No state wants to give away that money, so they pass the law ... It's a slippery slope from there.
