    Don't assume that Napster's terms of service are enforceable. No one knows whether the click through license during install or the posted terms on the website are enforceable legal documents. I can think of many arguments to defeat both.

    Could be. I happen to be looking at a Microsoft license for one of the biggest companies in the world as I type this. This company is paying recurring maintenance, but the license fee is a one-time charge.

    Will someone please explain to these Fools that index funds are tied to the performance of the U.S. stock markets? They act like their precious funds are unaffected by fluxuations in sector equities. You talk the talk, but if you were a truly savvy conservative investor, you'd be playing equities, bonds and currencies, as well as foreign markets.

    Of course, if you've got more money in the bank when you're 65 than I do, I'll take all this back.

    I hear this all the time from Europeans. It's like saying, "y'know that Brad Pitt is one of the most self-centered guys in the world." Do you think Brad Pitt cares what you think? Do you think your moaning about Brad's bad attitude makes him any less popular or powerful? Brad will be famous, rich and adored. He will continue to enjoy a successful life regardless of your opinion of him.

    And think about how lame it is to stand around worrying jealously about Brad Pitt's success when you could be making yourself into somebody. This is how you Euros look to those of us in the United States.

    Try post WWI Germany for a fine example of how idiotic multi-party systems can become. There is value in the two party system, whether you like it or not. The truth is that you have defined yourself outside the mainstream (which is entirely within your rights.) But don't expect to be empowered in a system that rewards those who can amass the greater quantity of individual votes. I suspect that all those who complain about the two party system are actually closet demogogues who have Machiavellian fantasies of getting things done the RIGHT way --- their way. You think Ralph Nader has his head on straight? Guess again.

    When they start digging Nader's skeletons out of the closet, you'll see how creepy he really is.

    Just like everything else in life, you have to be strong to survive. Simpering in the corner and moaning about how big companies are hurting you is weak and feeble behavior. If you had any real conviction, you'd quit voting for losers and start influencing the hearts and minds of those with a legitimate chance to win.

    Still missing the point. It was fair use of the document. Do you think there was a copyright violation when they played back the tape of Texaco bigwigs saying racist things about their black employees? You have no real knowledge of the law, so clam up! Also, get some perspective. You're defending @home for God sakes!

    The copyright laws are intended to facilitate works of authorship. The "legislative intent" behind the mandate for copyright protections is to encourage artistic expression, NOT to make the machinations of corporations opaque to their loyal consumers. Sheesh.

    Excuse me while I puke. Your defense of a company's right to "privacy" is digusting.

    While companies are certainly afforded the right to keep certain information confidential in order to sustain a competitive market, they should not be allowed to hide abusive policies that are designed to squeeze the last penny out of their customers.

    I have two words for knee-jerks that desparage OS X: try it. I didn't like OS X dp4 for a number of reasons (largely the same as those brought up by Ars Technica.) I do, however, love OS X pb because it works brilliantly. I haven't had so much fun on my Mac since the day (way back in the 80's) when I discovered resEdit.

    Most FUD-offenders that take aim against OS X probably don't know how to use Macs to begin with. Their fundamental mistake is assuming that because the MacOS is a consumer-oriented OS, that it should make itself obvious to them. If you came over to my house talking all this crap about OS X, i'd just sit you down and run you through the following tests: (1) i'd put a cd in my PBG3 and i'd tell you to boot off it, (ii) then i'd make you eject an external zip disk without using the mouse, and then (iii) i'd fire up my OS X partitition and ask you to launch the non-Aqua Darwin. If you passed my rather easy test, then you could bitch and moan about misplaced widgets and candy-colored immaturity. If not, then you could STFU and die.

    Those of us that use Macs seriously know every tweak, every key combo, every workaround, every jerry-rig that's never been documented -- just like Linux geeks. We're psyched to get a chance to upgrade our OS. I don't see OS X as late -- I see it as better than it would have been in 1994. I'm not the kind of loser that depends on promises from marketing people like Steve Jobs. I just work on my f'ing machines and I work with whatever comes along. The FUD-police are always trying to persecute Macs, but those of use who use them know the real story.

    This is a half-truth. While OS X does add functionality that Win/Lin users have had for a while, it goes much, much further. Maybe you discount user experience as fluff, but I'm here to tell you that a gunner is only as good as his gun.

    Here's a guy who wants Apple to stick with OS 9- versions and he's complaining that OS X is not enough of a leap ahead. What a loser!

    That's great, but if you don't disclaim the warranties that UCITA implies then you really haven't done your customers any favors.

    Here's what you really want:

    The accompanying software is guaranteed to operate in exact accordance with the source code provided, under condition that it is compiled using an error-free compiler and executed on bzrp error-free hardware. The parties disclaim all other warranties, including any implied warranties under state law derived from the NCCUSL's Uniform Computer Information Transactions Act.

    Or something along those lines. Once again, a cavalier and righteous attitude toward lawyers will only get you in trouble.
