Ford Motor Company has officially and unconditionally conceded its complete, utter, and perpetual loss on the merits of the FORD v. 2600 "FuckGeneralMotors.com" case. Ford has dismissed its appeal to the Sixth Circuit U.S. Court of Appeals, meaning that Ford has completely given up all attempts to reverse the victory that 2600 Enterprises won on December 20, 2001. The mutually agreed dismissal papers were officially entered by the Sixth Circuit on June 27, 2002.
In the words of another FORD from Michigan -- former President Gerald Ford, "Our long national nightmare is over."
2600, which has given up nothing other than an extremely improbable claim for getting its attorneys' fees back from FORD, has expressly reserved the right to point "FuckGeneralMotors.com" anyplace whatsoever that 2600 pleases -- including at the FORD homepage -- at any time whatsoever, with or without notice.
Of course, the plan in March, 2001, when the lawsuit arose, was to point the address someplace more suitable than the FORD homepage, probably as soon as mid-April or early May, 2001. In other words, the lawsuit has actually delayed 2600's prior plans (several other domain names that were part of the same project have been re-pointed several times, while FuckGeneralMotors.com has remained pointed at FORD). Now that the lawsuit has been won, 2600 will be soliciting suggestions during the H2K2 conference, for the best place to point the Domain Name. Ultimately, this just proves how silly and counterproductive FORD's litigation strategy always has been from the beginning.
In December, 2001, Judge Robert Cleland of the Eastern District of Michigan, dismissed FORD's lawsuit in its entirety for "failure to state a claim upon which relief may be granted" -- which means that even assuming every single allegation in FORD's pleadings to be true (but the allegations weren't all true), FORD still had no legal right whatsoever to prohibit 2600 from pointing FuckGeneralMotors.com at FORD's homepage.
Needless to say, FORD did not like that outcome. Neither did a lot of other intellectual property interests all over the world. Indeed, a google search will reveal a number of PowerPoint(tm) presentations published on the Web (e.g., http://austlii.edu.au/ hkitlaw/resources/Pun_IP.pdf) by various intellectual property lawyers, emphasizing that the decision is being appealed. Well, now it isn't.
The decision stands. It is published at 177 F. Supp. 2d 661. And it is binding precedent. The decision has even been cited by the Sixth Circuit already, in an interim order that was issued in the "TaubmanSucks" case handled by Paul Levy of Public Citizen. http://www.citizen.org/documents/TaubDecision-3-11 -02.pdf.
When FORD filed its appeal to the Sixth Circuit U.S. Court of Appeals in January, 2002, FORD sought to have the case reinstated so that FORD could take it to trial. 2600 filed a cross-appeal, solely on the issue of whether FORD should be required to reimburse 2600 for its legal bills (such fee awards, in cases under the Lanham Trademark Act, are not especially common and occur only in "exceptional" cases -- so the Sixth Circuit was likely to defer to Judge Cleland's decision to award 2600 its "costs" but not its attorneys' fees). 2600 still gets to take its "costs" back from FORD, and our lawyer is preparing to serve a deposition notice on Bill Ford, to gather the information necessary to garnish FORD's bank accounts, unless FORD cuts us a reimbursement check forthwith.
But the key point is that 2600's victory is permanent and FORD has voluntarily foregone any appeals. The savings, in terms of attorneys' fees, from our standpoint, are enormous.
It seems that all the web includes multiple listings of the same directory on my site. I run a php enabled webserver so it tries a bunch of directories with ?M=D or ?A=S and then procedes to list them. Click here for an example of this. It also lists every single sub directory in all 5 or 6 subdomains that I host. Google is much better at not going into sub directories and just giving the main site. Google is by far a better choice when looking for main pages and not having to filter through all the/whatever/ directories.
Just a thought, how about don't have an irc channel? If all you're going to do is tell the people to go fuck themselves, and you get all hot and bother about being asked the same questions, why put yourselves in that position? If you're going to do something like, at least act someone civil and tone down your egos.
People are coming to you for help, that means they are probably going to use your software and quite possible give you money if they like it and get a quality product. You can't just put something out there and expect people to just hand over some fat cash because they downloaded it. It just doesn't work that way.
You gpl something so that people use it, build on it, and it propogates through out the community. You don't gpl something and say "well we delievered, give us money before we'll do another damn thing for you". I don't do it for the possibility of cash. That would just be an extra bonus. I do it because I can say, oh cool I helped make that.
Maybe just the sense of helping eachother make the internet a better place is lost to the SmoothWall people. Oh and I've done the answering 40 questions a day thing. It's called isp tech support. Don't think you're the only one who hasn't dealt with that. But you know if i did what they do on irc to customers, i'd be fired before i could hang up the phone.
We run an OpenBSD firewall at the lab I work in but lately it's been flakey and I'm the only one who knows how it works. So I was sent on the task on seeing if we should switch to another firewall since I have to rebuild the machine anyway, or stick with openbsd:] OpenBSD does have the easiest setup for what it does with ipf/ipnat. However, you actually have to know what you're doing to set it up. I highly recomend openbsd for all your firewalling needs if you want something you can just setup and never touch again.
Since my boss sent me to look into their software, I could have also recomended to my boss that we purchase their software that supports what we were looking for. I had the intention of going in and finding out if the GPL'ed version had the requirements I needed. No where on the site does it mention the fact that what I was looking for wasn't in their package. Also since linux supports what I was looking for normal, I think it's reasonable to believe that they might have plans to put it in, or one could edit their software to perform such functions.
Instead of getting a even remotely helpfull answer, I get kicked, banned, insulted and later banned from the server. I get insulted for my family's herritage as well.
I don't know about you but if you go into a store and ask questions, you aren't asked if you need an adults help, nor are you insulted for the way you look or what your name is. Sterotyping will get you no where in life. Especially when you're selling something.
Twice this evening I've tried to get questions answered about their gpl'd smoothwall because my boss saw this slashdot article. And both times I've been nothing but insulted by Richard Morrell, the founder. The first time I was childish and incompetent all because I had the nickname 'nameless'. The second time I was k-lined from the server and he insults me because I have a german last name.
It's very possible to have 4 years experiance at age 20. I have 4 years experiance because I got a job for an ISP doing tech support (and I turn 21 in feb). I currently have two jobs doing php for a company and system administration for a lab at my college. If you were to count those as double the time, then I'd have 5 years. Just because someone is 19 doesn't mean they can't have worked in a the computer industry for more than 1 or 2 years.
I do some work for one on the side, http://www.echo-inc.com. They allow transactions with credit cards and checks online. They are also working on getting some shopping carts with direct transactions enabled in them. I beleive they charge like $15/month for an account and they have been around for a very long time. If you are looking in to doing business online dealing with cc/checks, i recomend looking into them.
I started just using linux and freebsd when I was like 16 and just learned everything on my own. Then I got a job at a small isp doing techsupport which required some use of adminstering user accounts on their freebsd server. This was not too techincal but I was able to learn more from the other people working there. Now I'm a system adminstrator for a computer engineering lab. I've learned more just working there than probably anywhere else. I'm still in college (a Junior CS major at Virginia Tech). I've found that being a CS major, you don't really learn too much immediately usefull stuff. It's all theory for the most part here at VT and nothing that would really pertain to being a systems administrator. Personally I wouldn't recomend any systems administration job because if you don't have patients for people who don't know what they are doing, you will burn out fast. I'm only 20 and already I've come close to losing it. Also if you have your system setup great and you never have any major problems, you'll be doing a lot of sitting on your ass waiting for stuff to break. Just my 1.5 cents.

It took me about a month and a half to get reverse dns from @work (@home's business connections). It was a pain.
But when thermo-couples die...both sides become hot :) You have less than 5 seconds to rip it off your beer or your cpu as the case may be :) -mwhahaha
