Really? Just how do you do a ping or a telnet without a shell? I'm serious, I use ping daily on my Win2k box at work, and I've never found it under Start->Programs->Ping
This is a GREAT point. As much as I want to see the DMCA tested in court, I do not know that I would swap places with him... I have not seen the EFF promising to feed his family, or to bring them here to visit him in jail.

Use the Digital Out from your drive to the Digital In on the sound card. Now use a normal cdplayer app like GTCD or Windows Media Player, then capture that audio with some kinda wave recorder like Soundrec or something. Take the resulting wave file and convert it to.mp3.ogg.wma or whatever. Granted you have to rip at 1x but still, you beat them at their own game, and you are not "circumventing" a copy protection control, you are using a built in function of the CD-Rom drive you legally bought.
I have to wonder if Adobe backed off because they didn't want the DMCA to be struck down with ease. Drop the case, and then no precedent is set, when a case that is more suited to Adobe, or another company that will strengthen the DMCA will they be so quick to drop it?

Then next year when you want something new, and you go back to your local dealer, and they are gone because EVERYONE bought mail order what are you going to do? Listen to it online? Through your 50 dollar computer speakers? There is a reason local dealers for stuff like this cost more, it's the fact that you can listen to it to make sure you like it first.

Would mass sending of MP3's to our Congressmen/Representatives have an effect? What about to the exec's at the RIAA? Would they even notice? I say they would. Since this judge has decided that Napster is not a conduit, and therefore not subject to the law, shall we make email work the same way? It seems to me that the RIAA/Metallica/Dr. Dre attack on Napster is about one of the most negative things I've ever read about on/. everyone seems against it.
