You shouldn't. Nobody's forcing you, right? If you want to spend the money for the iPod, then do it. If you don't, then, er, don't.

  3. Re:Of course... on Andreessen Interview Discusses Post-Crash Innovation · · Score: 2, Insightful

The real innovation happens at companies populated with nineteen year olds. At nineteen years old, you don't have the kind of doubts you'd have at thirty.

Well, from my over thirty perspective I'll tell you this: at nineteen I thought I was a pretty hotshot programmer, but I didn't have anywhere near the focus or discipline that I have now: qualities that have allowed me to work independently from home making a decent living without worrying about a commute, "vacation" time or having a boss.

Being nineteen, talented and full of energy may lead to success (e.g. see Microsoft, Apple and id Software), but don't kid yourself: the majority of successes in business (including the tech world) are made by us "older" folks.

Sharing music files over p2p could be legalized tomorrow if you could just get enough votes in Congress to repeal copyright.

Isn't that overkill? Nothing is wrong with copyright per se; it does exactly what it is supposed to do: protect the artist from having his/her work stolen.

Without copyright, there is no incentive to capitalize on creative works. As we are a capitalist society, I wouldn't bet on the overturning of any laws that support such a huge industry.

  6. Re:Legal Samples? on RIAA Extends Legal Action · · Score: 2, Informative

Each sample would likely be fair use, but reconstructing the original work would still be copyright infringment. I suppose it would be just like cutting pages from a book and then reconstructing the book to distrubute for free -- nothing legal about that.

Yeah there is a lot of cruft out there in terms of lame hosting sites. But some of the best are ZeBOX (free mp3s and videos from indie bands -- all genres) and CDBaby (free sample streams and links to indie band web sites that often have mp3s -- or buy a CD from a band you like and screw the RIAA).

Maybe we just need to stop letting people trademark common words. To me it is ridiculous that anyone can trademark a word that is found in a dictionary.

To me it is ridiculous that you would even suggest this. Can you imagine having to remember made up names for every product in the world?

    Xevutsy Toothpaste
    Cryunhoot Coffee

Please. Using a common word as a trademark is fine -- it only stops direct competitors (in your market segment) from using the same word in their product or service. This insures that consumers aren't confused and that you (as the trademark holder) don't have to worry about harm to the goodwill you've built around your product/service name.

People seem to be confused that a trademark stops all common or public usage of that word (witness all the other "I'm going to trademark the word 'the' and sue all you guys" comments around here). That just isn't so folks!

So let's not get all worked up over trademarks -- it's a good thing.(TM)

And you can read Jef's comments on the incredible amount of published "history" of the Xerox trip and its relation to the Macintosh here.

Where you got the notion that Jobs' "ideas" (whether you believe stolen or not) have anything to do with the Macintosh is beyond me. He took over the project, but he was not an engineer.

  17. Re:The name "Big Mac" on Big Mac Officially Ranks 3rd · · Score: 1

Generally, a trademark offers protection in a market segment. For instance, Domino's Pizza and Domino's Sugar each have a respective trademark. You cannot start a confectionary supplier called "Domino's" nor can you start a Pizza place called "Domino's."

Big Mac is certainly a trademark in the food industry, but that may not preclude its use for other products, e.g. the name of a supercomputer. Especially if there is not likelihood of confusion on the part of the consumer (nobody is going to think the supercomputer has anything to do with sandwiches).

But I say "may" because McDonald's could conceivably argue dilution of trademark...it's an extremely famous mark.
