    This from IBM's ammended response to SCO's complaint:

    "Nineth Defense

    Caldera's claims are improperly venued in this district.

    Wherefore, defendant IBM demands judegement dismissing plaintiff's complaint and respectfully requests that the Court award IBM reasonable attorneys' fees and expenses and the costs and disbursements of defending this action along with such other and further relief as the Court deems just and proper."

    Can't vouch for the rest of Unix, but I worked on IRIX (SGI) in 1996 - 1998, and Irix seemed to "like" having certain devices with certain ID's. Can't prove it, but when I set up a system with odd-ball SCSI IDs, it was flaky until I went back and fixed it.

    My service provider charges both the sender (assuming it's from a cell phone) AND the receiver. So, if my husband sends me a message from his phone, we get two charges on our bill. Now THAT sucks.

    Did I just read the same court opinion that the rest of you read? Micrsoft didn't win. The appeals court turned over the preliminary injuction granted against them for illegal monopoly powers.

    The appeals court AFFIRMED the preliminary injuction against them for violating the settlement agreement and Sun's copyrights.

    Microsoft lost.

    I caught this on Good Morning America this morning. They interviewed the heads of some telemarketing companies about the registry. One guy actually said that they would have no problems selling stuff, because they would just start sending more email.

    Because the crash investigators estimated nearly 100MPH.

    It would be like you getting into an accident and killing someone -- then walking into court and saying "Your Honor, I drank one beer... nothing else" when the police officer is saying that you couldn't even walk straight. Someone's clearly wrong, so they pull out the blood alcohol level test. 4x the legal limit? Go to jail, do not pass go, do not collect $200.

    And rightfully so. (arrested) Breaking the door would have fed the fire, or could have created a backdraft situation. (Fire "eats up" all of the oxygen in the structure, and is starving. Some dumb@ss opens a door or window, fire gets sudden infusion of oxygen == BOOM!) We had a backdraft in an apartment building about two months ago -- sent four of our guys to the hospital w/ burns.

    I go through about 30/month (I have a little business printing wedding proof catalogs). The last time I checked the boxes, they said that they were warrantied against defects until the expiration date on the box. Any time I'm buying cartridges, I check the expiration dates on the bottom before I buy them. But then, cartridges don't seem to last very long at my house (a couple of days max).

    My printer takes three different cartridges, my print jobs only require the use two of them. About the time that their gui shows them 3/4 empty, I start getting "cartidge empty!" warnings on the computer and printer. I click them away and keep running the cartridges until I see photos coming out that have a color missing. Then I change them. I run those suckers DRY.

    There's gotta be something more to the equation. I go through about 7 - 8 movies / month, and have always gotten my first choices, except for one time. That one time, they sent me something a bit lower on the list (maybe 3rd or 4th), and then when the first choice became available they sent that too even though I already had 3 movies out. I got an email that day saying that the 4th movie was "on them" to make up for the fact that there was a wait for the 1st choice, and that I would get my next movie after I sent back two.

    I was a happy camper. :)

    For me, the beauty of Netflix is that my local Blockbusters (all 3 of them) are inconvenient for me to get to. With Netflix, I just put it in the pre-addressed/stamped envelope, drop it in the mailbox, and three days later, I've got a new movie. It's the ultimate in laziness. :)

    To go one step further: I wanted to setup a network at home and didn't want to be hassled by Comcast, so I called them to actually purchase two more IP addresses for a whopping $6.95/month each. I spoke to two different reps (because I didn't believe the first one) and they both told me the same thing.

    "If your computer doesn't need a real-world ip address, purchase a Linksys wireless router and set them up behind NAT. There is no need to purchase additional IPs from us unless your computer needs a 'real' ip."

    I know others who were told the same thing (here in Maryland). So there you have it... Comcast is actually *telling* it's customers to put in a router & NAT.

    Back in 1995, I worked for a long distance reseller. I was the system admin, but also had to maintain the PBX system. Verizon's (Bell Atlantic back then) decision to add new area codes was disasterous. Executone PBX's came from the factory knowing ("hard coded") that an area code was a three digit number with either a 1 or a 0 in the middle (ie: 301, 410, 202....). The two new Maryland area codes were 443 and 240. Executone forgot to tell us about this little "problem" until I called them after working on the PBX for 14 hours, trying to figure out why the he** we couldn't call the new area codes.

    I have a sinking feeling that they (the PBX industry) haven't learned a whole lot from that mess.

    I think the thing that pisses me off the most about Comcast offering me NetZero service (that doesn't run on my Linux workstation) is that they're doing it with a REFERAL ID. WTF? Are they trying to make a few bucks off of my misfortune or what?

    Before we go subjecting Bush to the electronic equivalent of an @ss whooping, let's at least give him the benefit of the doubt on the religion question. Maybe he (or his staffers?) just didn't take the time to type out EVERY SINGLE religion and school of thought that exists today..... you gotta admit, there's a lot of them out there. It looked to me like he picked a couple varying examples and left it at that.

    I think that's a bit of a "crime" too... I personally have not decided who I'm voting for yet (sad, I know.. it's such an important decision). I was just using Nader as an example because it's the most well known one. I think that if the "3rd" parties could get exposure in the debates (host a debate w/ just the 3rd parties... let the top 5 candidates overall in the debate... SOMETHING needs to be done!) the poll #s would be much higher. The other problem is in the polls themselves.... I read somewhere (I'm currently looking for the reference) that Nader has such a low % because most of the people that WOULD vote for him are people that don't habitually vote... and the polls are only contacting/counting people who voted in the last election. (That's obviously not the "gospel".. I'm looking for a reference right now).

    How can the two of you (and your respective parties) justify:

    1. refusing access to third parties to debate with you?

    2. refuse to allow Ralph Nader to attend the debates as an audience member w/ a valid ticket?

    The debate commission which sets the rules for the three debates is owned joinly by the dems & repubs. Those two parties own the elections... until the "third parties" get equal access to the debates & the public, the poor people of this country will be afraid to vote for anyone other than the D or R. Let's face it, at this point, a vote for anyone else is almost a wasted vote.. and that's truely sick and sad. Instead of seeing "_________________ won 7% of the vote, maybe we should start listening to the people that voted for him" we'll be hearing things like "_______________ took 7% of the vote away from ____ (---insert four letter word of your choice here)

    Can I get a "none of the above" choice on my ballot please?

    Exactly... I would be perfectly happy with that. Besides, if I want a CD quality recording to put on my laptop, I'll record my own darned CD's. I would even be happy with a version that self destructs after it's been played once. Or a site that I logon to that streams the whole song w/ no way of capturing it, and lets me listen to each song once. Anything, so long as I could legally "try before I buy" that's all I really want.

    Besides, I kinda like having CDs around. (But then I buy all of my software too.... ok, you guys can stop laughing at me now.)

    I can definately understand that arguement, but I would venture to say that there are a lot of people like me... I think that having a digital copy of a song is great, but there's just nothing in the world like having that nice CD in my hand, with way cool cover art.. I can take it everywhere with me, play it in my home stereo, car stereo, laptop.. etc. I don't have a CD burner, have no need for one, and don't want one.

    I think that a lot of the people actually stealing the music, and never purchasing it are probably kids & people who just don't have $20 to purchase a CD. $20.... geeze, that was two weeks worth of allowance for me.
