Let's not forget that any evidence that one side brings into court, must be shared with the other side in advance of the case. A contract in this case is evidence that supports the claim that Ceglia is entitled to ownership.
Zuckerberg's lawyers may try to refute the evidence in court.
In any case, if the contract is legit and Zuckerberg didn't retain a copy of it, then he's is more the fool. If Ceglia's claim is proven false, then this battle will likely soon come to an end...... until something else magically come to light...
Stay tuned, it's only going to get more interesting from here.
Many people go to Wikipedia as a 1st search hit. And it's always nice to get decent info. But it's inevitable that it would lose volunteers. It is common for many things. People help, then move on leaving room for others to take up the torch, but somehow the torch gets set down, and no one ever picks it up.
.... to prevent this sort of crap. That would be like letting someone buy a DVD of a movie and only get to watch it once. Or purchasing a book and only being able to read it once. Oh you want to go back and re-read a section because you put the book down for too long? NOOOO. You don't have permission. That part of the book is deleted....
Why would any company shoot themselves in the foot like that? And what is full price? If a play once game is anything over $1 per play, Fuck it, it's not worth it.
Is it really necessary to destroy people in order to go after a corporation or a government operation? Will these individuals feel differently if the results of their efforts directly impact them in a negative fashion? Or will they ensure that their information is kept safe and damn be the rest of the world?
I cannot say I agree with what how high profile companies handle themselves, or even how our own government operates, but neither do I agree they should be hacked and all their customer's data or citizen info be dumped out in public for all eyes to see.
If you feel it is ok to dump out customer information because you're teaching corporations and governments that they aren't very secure, why aren't you divulging who you are so that this is done on the up and up level. It seems to me that the various groups are hell bent on keeping their identity and information private and secure but everyone else's info is fair game, to this I disagree.
It was in the 1970's when games really Pong came out and the industry has grown since, and so has it's most loyal fans.
I'm a middle-aged female, and I love gaming. I'm not great at it, but I still enjoy it none-the-less. And why shouldn't I. Games have actually brought families together in my household. Friendly challenges between neighbors were always a blast.
This study, in my opinion, is only stating the obvious.
...getting close enough to tag a particular shark or two and playing types of music at random intervals over a given time frame, say a year or so.
Keep try to pick music of the same base level to play for a designated amount of time. Try other types of music that have higher pitches and lots less base. Use vocals, don't use vocals, and record your findings which include the Name of the Song, the album it was played from, the artist, the length of time the music played for, on what type of system the music was played on, GPS locations, time of day, weather conditions, water conditions and any other key data. Once you have all of this nice wonderful data, put it out on the web for others to research and study as well.
I'm curious, was the music was of the best sound quality or super compressed? What equipment did he use to play the music in the water? Does he know how loud the music volume was? The lowest sound to the highest volume? Was it feeding time? Was the shark in the area before music was playing or after?
.... then I think it's time for the ISP providers to stop bitching' about having to build the infrastructure and just build it already, because that's an awful lot of info being passed around, whether or not it's music, videos, movies or what ever. The world is ever changing, people and companies have to constantly change with the technology if they wish to stay up with the world. As more and more companies push for people to go through the web to do business more and more people will get online, and if the ISP providers just keep sitting on their profits, complaining on how all the investments are theirs, they forget that so is the potential business. The faster, more reliable, less limited the service provider makes things, the more business they will bring in.
I've always found that reading through older articles, that one retains more of the facts as they unfolded versus today's news reporting which seems to be mostly heavily biased towards sensationalism and less facts.
But then again maybe that's how reporting always took place, and I only remember the good ole days because the actual fact is my memory is selective in how I remember those days.
But if there is no leader or membership, then I have to ask why would Anonymous make posts stating (I'm paraphrasing) "Anonymous did not do this" when referring to the Sony theft of data. "http://www.dailykos.com/story/2011/05/04/973151/-Anonymous,-Sony,-and-the-rule-of-law"
Or when the one church blamed Anonymous of attacks against that church, Anonymous responded ""Our best guess is that you heard about us on that newfangled TV of yours and thought we might be some good money for your little church." â"Anonymous response to the Westboro issue[140]." http://en.wikipedia.org/wiki/Anonymous_(group)
The idea of the collective is a moving number, which I do well understand, but if you've ever been a part to any action for which Anonymous has implemented, the rest of the world see's Anonymous as one collective. And it is, even it if is subset of that moving number that makes up Anonymous. There are leaders within Anonymous, for there are those who are posting rebuttals, but once again, they are only representing a sub-set of those who partake in a collective action (again a subset).
From the same Sony article: "We do not forget, even if others fail to remember. We not forgive, even if others forgive our enemies for those things for which we are attacked. We are legion, and will remain so no matter how many of our participants are raided by armed agents of a broken system. We are Anonymous."
It sounds to me that there are individuals who don't follow the same ideology as a majority of the group called Anonymous. But since the word Anonymous is the generic word for "The concept of many online community users generally considered to be a blanket term for members of certain Internet subcultures, a way to refer to the actions of people in an environment where their actual identities are not known" (from Wikipedia: http://en.wikipedia.org/wiki/Anonymous_(group)), how can you discern on sect from another.
If you are Anonymous in the collective term, then where one goes, you all go. It is part of the concept of Anonymous. True that only a small sub-group has made the decision to perpetrate a company and steal information, but their actions reflect on all those who associate themselves with Anonymous. If Anonymous as a whole disagrees with what some members do, punishment will be within and will likely be pretty swift.
This to me is not Civil war, but punishment for breaking of the ranks.
Basically, gadgets are toys in my eyes. I do believe from personal experience that the more we rely on gadgets to do for us, to simplify our lives, the more we are willing to give others control over ourselves, which includes common sense.
A few examples, phones that can hold memory or relay info such as caller id. Phones with memory hold phone numbers that we used to either had to look up in a phone book or had to memorize. I know that today, without my phone I can't remember anyone's phone numbers. Degradation of memory, by user choice of course.
GPS devices are electronic maps / weather stations. People used to learn where they were going by taking care note of what turns they made or by reading signs or memorizing landmarks and even studying a map (/gasp). Today, I've seen younger members of my family get lost even using a GPS, because they no longer understand N / S / E / W directions and they to retain info about where they turned to get to a location. Another family member will now rely on the GPS to traverse streets he's driven on for years. Common sense, and education of simple map reading are all but gone. A GPS is good in many situations such as going somewhere you've never been for the first time, for those who have difficulty driving at night on unfamiliar roads. But it's become a massive crutch.
Phones / iPOD / iPAD / hand held games are time killers to be sure, but where humanity used to fill time with their mind and relaxing, today people require constant interaction with something. No downtime from gadgets leads to poorer sleeping habits, less mental relief, and poorer memories from lack of down time. Creativity is lost, problem solving is weakened.
We build gadgets based on sets of rules. People begin to accept limits. We then blindly agree on strict rules like "zero tolerance" and lose common sense behavior.
This response make it sound like I'm blaming gadgets for the degradation of society, it wasn't my intent. But I do feel that constant reliance on gadgets lead to a way of limited thinking which leads to the ability to lose common sense.
These are only observances of mine with those around me, and it's a very narrow perspective of the world and society as a whole. So please only take this opinion with a grain of salt.
Even cell phones with those tiny SIM cards allow a User to be tracked. So why wouldn't makers of cell phones that do everything but cook for you do any less?
Any officer or city official in plain clothes who travels to and from any location and takes different routes and clearly identify where hot spots are for speed traps. The reality is that once GPS data is turned over there a database may be compiled following the path of any unidentified subject and begin to pinpoint common begin and end points. Eventually, they will use such data in a court of law as a matter of historical record.
Defendant: "Your honor, I submit was not speeding, here's my GPS proof." Prosecutor: "Since the defendant is submitting their GPS data, we would like to submit the defendant's historical GPS data on the signal identifier, which shows that the defendant habitually passes through said area in speeds in excess of x mph." Manufacturer of GPS devices Term of Agreement....by using this item you are agreeing to be tracked by law enforcement...
While this not be the case yet, I am predicting that this is how the data will be used eventually.
With an expected 3/4 million people flocking to that area of Florida, it's disappointing to see a delay. But I am glad that our engineer are still following the safety guidelines. Traffic will be ugly for those trying to leave the coast and people on their daily commute, but this is life here in Florida. Those many people will grumble about the traffic, but it's part of the excitement. At least the tolls were suspended to help ease the traffic burden through Orlando.
For those who get to see the launch, you will experience something wonderful. For those of you who have never experienced it up close, the feeling of the rumble from the shuttle envelops you as the sound way passes you. The heat of the flame warms your skin. Goosebumps explode all over your skin and your sense of American Pride is enough to make a grown man cry tears of happiness.
Microsoft is trying to ensure the life of their company. XP is not bringing in the revenue for them any longer, so from their perspective it's time to move on. This is really bad for the consumers. People are happy with the product. Companies are saving $$$ by not replacing software and licenses.
This is potentially good for the economy, because corporations across America will soon be forced to update the operating systems and IT departments may need to hire new techs for installations. Conversely, companies may increase their IT budget but folks will not get raises or additional staff to help with ever demanding workloads.
The situation may have come down to the Use it or Lose it Budget practices of the govt. In many instances, Govt. funds are handed out to the various agencies and if at the end of the fiscal year you don't use you're allotted budget, the following happens. 1.) That department must return all unspent funds back to a general govt. pool and 2.) The next fiscal year your budget is cut to more closely reflect your department's spending.
So basically, it was waste it now or we won't be able to get funding when we need it later.
At least this is what I'm speculating was how this board of 44 people decided.
She was my First Doctor's (Tom Baker) assistant (Elisabeth Sladen). It was the way that her chemistry bounced off of Tom Baker and the great adventures they went on together that drew me into Dr. Who. I was hooked.
In the last year or so, I've been re-introduced to Dr. Who and was delightfully surprised when she appeared on some more recent episodes with David Tennant (I think it was David).
She was wonderful and fun and I hope her spirit lives on beyond her. Good bye Sarah Jane.
Is this guy really touting that he hacked this stuff, because he was let go from his job? Embarrassing a company is nothing new these days. Assuming his claims are indeed true, he's now boasted about his mis-deeds and it will only served to be used against him in a court of law.
With technology moving so fast, even developers have to read up on new technology to keep up with it; so it makes sense to me that we have judges who are facing these technological questions to be at least a little be knowledgeable about the subject matter before their court.
I would much prefer a judge to be knowledgeable about a subject.
This makes me wonder, should we now have judges who must have a background in the subject matter to be the only judge who would ever hear cases that pertain to that subject matter? How bad would this be?
WTF! 6-months is crap and assuming that because I keep an email on a server for more than 6 months it's abandoned? Has the fool who is proposing this ever considered that life and the things we deal with doesn't always clear itself up in 6 months. And why should anyone ever just simply be allowed to look at my emails simply because of a time stamp.
Services like Gmail and Yahoo and Hotmail etc....have made it a point to provide the average user with room to keep their emails, and so we do. This should not imply that we've abandoned an email that a provider has allowed us to keep on their server as long as we have not used up the allotted storage.
I believe our govt is stepping way too far over the line into the citizen's personal lives and it's becoming ridiculous.
Sadly, Facebook is the Crack cocaine of the internet. Facebook has put oodles of web games on their site that kids dig. Children are very social creatures, and this is basically the cookie jar that's within reach and a tiny bit of innovation (lying) from kids to get that cookie. The problem is that kids don't think through things, when they lie.
They may say they are 14, and then have open discussions about all the 3rd grade class stuff the kid does and posts from other friends to post dates and times and ages.
