If the bill was about civil rights from employers to employees, fine. But it wasnt, it was a direct, case specific implementation of basic employment law already on federal books. No need for activist courts, just a need for a court to interpret and apply employee protection law to this case. And no, you cant make a contract that states "and also law X doesn't apply".
