IANAL, but he is using enough of the song to be recognized, and specifically using that song for it's emotional message. Although profit is not a test of fair use, you could argue he is using the songs emotional message to bolster his "brand" in order to profit by gaining the Presidency.

I am not sure quality and volume are necessarily equivalent. Actually, I can attest that I have heard quite a few very loud, yet horrendous bands on any given Monday night at the Rat. (if you recognize the club, you're probably old too...)
To be fair, I am not sure the original design anticipated the amount of bandwidth that HD Video and the like use. TANSTASFL, or free bandwidth for that matter.
This is incorrect. Adobe says you can freely write software that will create PDF format documents as long as you don't break the spec and give them copyright credit on it.
And Apple(Beatles) is currently suing Apple (Computers) for using the name in the music space after agreeing not to in the origianl trademark infringement settlement.
Copyright for music is exactly that - copyrighting a permutation of musical notes. No one can say that George Harrison sounds like the Chiffons, but he lost a copyright suit because My Sweet Lord used the a melody (permutation of musical notes) that was recognizable as He's So Fine.

Use Barry Bonds numbers all you want, use his name and/or picture and you are infringing in trademarks and copyrights. These folks don't make their money playing a game, it's from media rights, endorsements, and all the other stuff that makes it more an entertainment event than sports event now. But that is another debate...
I am not sure Hal has the mythological stature - except possibly in geek circles - that this question addresses. More to the point, Freud divided the human psyche into sexually driven component of id, ego, and superego. This has become pretty much accepted (even when abstracted as unconcious mind, etc...) The question is, did these things exist before he defined them, or did his definition create them? This is different than did some guy see a science fiction movie and get inspired to invent a moon ray.
