On this same note, I really don't see the PS3 using this as their major interest is getting everyone to buy a PS3. This would destroy them. No they are going to use this for Music and Movies they publish, possibly for the PS3, but not for games.

Quite possibly the speach itself was physically threatening to certain people at the school. Such speach is not protected. What the school did not understand was that simply offering a forum for free speach does not hold the forum creator instantly liable for the speach in said forum. Possibly if takedown request to the individual messages that contained threatening speach were ignored only then would there be a case against the forum owner.

This isn't the same pay per month get unlimited access as the rental music services either, though such offerings would be appealig in the TV world. Similar services exist in the form of HBO/etc though a on-demand HBO with a full library that has a monthly service fee instead of per view would be a huge hit. Kinda like netflix??.. Which isn't popular at all is it?

Sure MPAA probably rakes in a good amount of money but its spent in lobbying or other things, its not there to make a profit. Though it probably does make more money than it spends, this difference goes into the paychecks of the people running the place, you can be a non-profit and still rake in money you just can't maintain a profit balance.
