  1. What are you talking about? on Apogee(r) Bans Negative Reviews? · · Score: 1

If they grant you special permission to use their logo they dont want you slinging mud. Journalistic laws get around this by allowing you to use it without infiringing, this should be easy to knock down.
However, regardless of your obvious inflammatory spin on the situation, which I consider to be bad journalism, you fail to miss that it does not ban bad reviews. It bans bad reviews by people who are given special privelege to use logo's and such.
These are two separate issues. This does not effect most of use who post an actual review, it only effects people who review in slanderous or libelous ways.

Paragraph (3) describes the elements which must be present in a notification, including: "A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

Based on eBay's statements, the Church of Scientology has sworn under penalty of perjury that it has an "exclusive right" to copyright on the material that was posted in the auction.

Read a little more closely, it says that 'under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed'

It does not say that they are swearing the exclusive right is valid, only that they have the legal right to act on behalf of the company and notify you of the infringement. That is a pretty noticeable difference.

Just as a comment... this is less likely in a private company, where the people running the business have more autonomy. The situation you are talking about is much more likely in a public company. Basically the point I am trying to make is that maybe the "IPO Madness" has something to do with this environment. Companies are more at the mercy of the public than they would be if they stayed private and built the business from the ground up.

I like the open source model, but I have to feed myself. The current models work best for college students and people working in their free time. There is alot of good development, made mostly by the people who have a real stake. Now you can get a real stake, and if the product does well you will get credit.

These guys may not have the answer, but they are heading down the right path. And in the business market right now, a little hype goes a long way towards making things a reality.
