    The 9th Amendmaent:
    The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

    Rights are inherent, they are not granted by the government, In the eyes of the founders, ALL men are granted these rights on the basis that they are alive.
    How can we be a country of freedom when we no longer believe in the basis of that freedom?

    Forget the backhoe what he needs is a Ditch Witch. We had the same issue in Oregon, we lived on 280 acres and lived 1/2 a mile from the main road. It really is your only option if you are going to live in the boondocks.

    Ok then look at it this way, in 2001 when iTunes was launched, tied to an extremely popular mp3 player. Now not having actually been granted a patent they could do nothing. To then sit and write a competeing product (and maybe they had worked on a prototype, I don't know) would be fruitless, as even back then we (ie. the slashdot crowd) saw that iTunes/iPod were going to dominate the market. I just don't think these guys are the usual patent troll scum we have come to know and hate.

    Really, is it Zapmedia's fault that it took 7 years for the USTPO to review and award the patent. Have you heard of Patent Pending, it used to be printed on a bunch of toys I had has a kid. With patents your protection begins from the date of application but you cannot go after anyone until it is granted. Since the patent was granted on tuesday I have a hard time seeing this as a submarine patent, and it's not like these guys have a huge patent portfolio, they have two, both similar but one with more asset management features (aka DRM).

    Well, that depends what company you are talking about. There is plenty of unethical behavior in the "Adult Entertainment Industry". Vivid though tends to be one of the more ethical companies out there.

    Morals are subjective and thus have no place in this argument.

    Ummm, yes really, If you don't believe me read up on Common Carrier status and ISP's pay close attention to the phrase "Enhanced Service Provider" as it provides different protections.
    There are provisions that protect an ISP's liability for information they transmit but Common Carrier status is not one.

    Look at it this way, if ISP's were covered by Common Carrier then Spam blocking would negate that provision. Now go back and research before you put your foot in your mouth again.

    Quick answer they are not. In fact no ISP in the US of A holds Common Carrier status. I am not sure where this idea originated from but it seems to be a common misconception.

    Why do you think ISP's have common carrier status? No really I see this falsehood on slashdot all the time and wonder where this misinformation comes from.

    Read up on Common Carrier status and on ESP's (Enhanced Service Providers).

    But please stop perpetuating tis myth.
