No argument there, the OS should NEVER spy on the user or report their software, web browsing, keystrokes, or anything else to anyone not explicitly authorized by the user.
Encryption is NOT a right. Access to it could be considered a right, but if your want "secure" communications, you're going to have to pay for it rather than expecting free software to do it for you.
